Mustadrak al-Hakim — Hadith 2842

حدثنا أبو العباس محمد بن يعقوب، حدثنا محمد بن إسحاق الصَّغَاني، حدثنا سعيد بن أبي مريم، حدثنا أبو غسان محمد بن مُطرِّف المدني، عن عمر بن نافع، عن أبيه، أنه قال: جاء رجل إلى ابن عمر، فسأله عن رجل طلَّق امرأتَه ثلاثًا، فتزوجها أخٌ له عن غير مُؤامَرة منه، لِيُحلَّها لأخيه: هل تَحِلُّ للأول؟ قال: لا، إلّا نِكاحَ رَغبةٍ، كنا نَعُدُّ هذا سِفاحًا على عهد رسول الله ﷺ (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that a man asked him about a man who had divorced his wife with three pronouncements, after which his brother married her, without any (prior) consultation with him, merely with the intention of making her lawful for his brother: would she be lawful for the first husband? He said: "No, unless it is a marriage of genuine desire. In the blessed time of the Messenger of Allah (peace and blessings be upon him) we used to regard such a thing as fornication (sifah)."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) إسناده صحيح. وجوَّد إسناده الإمام ابن تيمية كما في "الفتاوى الكبرى" 6/ 242.
Grading: The chain of this hadith is "sahih". Imam Ibn Taymiyyah declared its chain "jayyid" (good) in "al-Fatawa al-Kubra" (6/ 242).
وأخرجه البيهقي 7/ 208 عن أبي عبد الله الحاكم، بهذا الإسناد.
Reference / Source: Al-Bayhaqi (7/ 208) narrated it from Abu Abd Allah al-Hakim, with this chain.
وأخرجه الطبراني في "الأوسط" (6246) من طريق محمد بن فليح، وأبو نعيم في "الحلية" 7/ 96 من طريق سفيان الثَّوري، كلاهما عن أبي غسان محمد بن مُطرِّف، به.
Reference / Source: Al-Tabarani narrated it in "al-Awsat" (6246) via Muhammad bin Fulayh, and Abu Nu'aym in "al-Hilyah" (7/ 96) via Sufyan al-Thawri; both from Abu Ghassan Muhammad bin Mutarrif, likewise.
