أخبرنا أبو جعفر محمد بن محمد بن عبد الله البغدادي، حدثنا أبو زكريا يحيى بن عثمان بن صالح بن صفوان السَّهْمي بمصر، حدثنا أبي، قال: سمعتُ الليث بن سعد، في المسجد الجامع يقول: قال أبو مصعب مِشرَحُ بن هاعانَ: قال عُقْبة بن عامر الجُهَني: قال رسول الله ﷺ: "ألا أُخبركم بالتَّيس المُستعارِ؟ "، قالوا: بلى يا رسول الله، قال: "هو المُحِلُّ، فلعنَ اللهُ المُحِلَّ والمُحَلَّلَ له" (2). وقد ذكر أبو صالح كاتب الليث عن الليث سماعَه من مِشرَحِ بن هاعان: [التعليق - من تلخيص الذهبي] ترقيم العلميه 2804 - صحيح
It is narrated from Sayyiduna Uqbah bin Amir al-Juhani (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Shall I not tell you about the borrowed billy-goat (the ram for hire)?" The Companions said: "Certainly, O Messenger of Allah." He (peace and blessings be upon him) said: "He is the one who performs halalah (al-muhallil). May Allah Almighty curse the one who performs halalah and the one for whom halalah is performed."
Abu Salih, the scribe of al-Layth, mentioned that al-Layth heard it from Mishrah bin Ha'an.

(2) صحيح لغيره دون ذكر التشبيه بالتيس المستعار، وهذا إسناد رجاله لا بأس بهم، لكن جزمِ يحيى بن عبد الله بن بكير فيما نقله عنه أبو زرعة الرازي كما في "العلل" لابن أبي حاتم (1233) بأنَّ الليث لم يسمع هذا الحديث من مشرح، وأنه لم يرو عنه شيئًا، وأنَّ الليث حدثه بهذا الحديث عن سليمان بن عبد الرحمن: أنَّ رسول الله ﷺ، يعني مرسلًا. وقال البخاري نحو ذلك أيضًا ¤ ¤ فيما نقله عنه الترمذي في "العلل" (274)، حيث قال: ما أرى الليث سمعه من مشرح بن هاعان. واستدلَّ البخاري على ذلك برواية حيوة بن شريح المصري، عن بكر بن عمرو، عن مشرح، وبيان ذلك أنَّ حيوة هذا في طبقة الليث، ومع ذلك لا يروي عن مشرح إلّا بواسطة. Grading: This hadith is "sahih li-ghayrihi" (sahih due to supporting evidence), without the mention of the comparison to the "borrowed billy-goat" (al-tays al-musta'ar). There is no harm in the narrators of this chain, but: Technical note / Defect ('illah): Yahya bin Abd Allah bin Bukayr (as reported by Abu Zur'ah al-Razi in al-'Ilal of Ibn Abi Hatim 1233) stated with certainty that al-Layth did not hear this hadith from Mishrah and did not narrate anything from him; rather, al-Layth narrated this hadith to him from Sulayman bin Abd al-Rahman that the Messenger of Allah (peace and blessings be upon him) said (i.e. as mursal). Imam al-Bukhari also said something similar (al-'Ilal of al-Tirmidhi 274): "I do not think al-Layth heard it from Mishrah bin Ha'an." Al-Bukhari cited as evidence for this the narration of Haywah bin Shurayh (al-Misri) from Bakr bin 'Amr from Mishrah; that is, Haywah is of the same generation (tabaqah) as al-Layth, yet he narrates from Mishrah only through an intermediary. قلنا: ومع ذلك فقد حسَّن إسنادَه عبدُ الحق في "أحكامه الوسطى" 3/ 157، وأقرَّه ابن القطان في "بيان الوهم" 3/ 504، وصحَّحه الذهبي في "الكبائر"! فلم يُصيبوا، والله تعالى أعلم. Grading: We say: nevertheless, Abd al-Haqq declared its chain hasan in "al-Ahkam al-Wusta" (3/ 157), Ibn al-Qattan let that stand in "Bayan al-Wahm" (3/ 504), and al-Dhahabi declared it sahih in "al-Kaba'ir"! But they were not correct. And Allah knows best. وأخرجه ابن ماجه (1936) عن يحيى بن عثمان بن صالح، بهذا الإسناد. Reference / Source: Ibn Majah (1936) narrated it from Yahya bin 'Uthman bin Salih, with this chain. وسيأتي بعده من طريق عبد الله بن صالح كاتب الليث بن سعد، عنه. Details of the narration: This narration will come after it via "Abd Allah bin Salih" (the scribe of al-Layth), who narrates it from al-Layth bin Sa'd. وقد صحَّ لعن المحلِّل والمحلَّل له من حديث عبد الله بن مسعود عند أحمد 7/ (4283)، والترمذي (1120)، والنسائي (5511) و (5579). وقال الترمذي: حديث حسن صحيح. Corroborating chains and supporting reports: The cursing of the one who performs tahlil marriage (al-muhallil) and the one for whom it is done (al-muhallal lahu) is authentically established from the hadith of Abd Allah bin Mas'ud (may Allah be pleased with him), found with Ahmad (7/ 4283), al-Tirmidhi (1120) and al-Nasa'i (5511 and 5579). Al-Tirmidhi said: the hadith is "hasan sahih". ومن حديث أبي هريرة عند أحمد 14/ (8287)، وحسَّن البخاري فيما نقله عنه الترمذي في "العلل الكبير" (273). Corroborating chains and supporting reports: And also from the hadith of Abu Hurayrah (may Allah be pleased with him), found with Ahmad (14/ 8287); al-Bukhari declared it "hasan", as al-Tirmidhi reported from him in "al-'Ilal al-Kabir" (273). ومن حديث ابن عمر كما سيأتي عند المصنف برقم (2842).
