Mustadrak al-Hakim — Hadith 2837

حدثنا أبو العباس محمد بن يعقوب، حدثنا بحر بن نصر بن سابِق الخَولاني، حدثنا بِشر بن بَكر. وحدثنا أبو العباس غير مرة، حدثنا الربيع بن سليمان، حدثنا أيوب بن سويد؛ قالا: حدثنا الأوزاعي، عن عطاء بن أبي رباح، عن عُبيد بن عُمير، عن ابن عباس، قال: قال رسول الله ﷺ: "تجاوزَ اللهُ عن أمتي الخطأَ، والنسيانَ، وما استُكرِهُوا عليه" (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Indeed, Allah Almighty has pardoned my Ummah for mistakes, forgetfulness and what they are coerced into doing."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) إسناده صحيح من جهة بشر بن بكر، ضعيف من جهة أيوب بن سويد. الأوزاعي: هو عبد الرحمن بن عمرو. وقال الحافظ في "الفتح" 8/ 125: هو حديث جليل، وقد أُعلَّ بعلة غير قادحة.
Grading: This chain is "sahih" by way of Bishr bin Bakr, and "da'if" (weak) by way of Ayyub bin Suwayd.
Technical note / Defect ('illah): Al-Awza'i (in the chain) is "Abd al-Rahman bin 'Amr". Al-Hafiz Ibn Hajar said in "al-Fath" (8/ 125): It is a weighty hadith, and it has been criticised with a defect that is not damaging (qadih).
وأخرجه ابن حبان (7219) عن وصيف بن عبد الله الحافظ، عن الربيع بن سليمان المرادي، عن بشر بن بكر، بهذا الإسناد.
Reference / Source: Ibn Hibban (7219) narrated it from Wasif bin Abd Allah al-Hafiz, from al-Rabi' bin Sulayman al-Muradi, from Bishr bin Bakr, with this chain.
وأخرجه ابن ماجه (2045) من طريق الوليد بن مسلم، حدثنا الأوزاعي، عن عطاء، عن ابن عباس. فأسقط من إسناده عبيد بن عُمير، والوليد معروف بتدليس التسوية كما قال البُوصيري في "مصباح الزجاجة" (728)، قال: فليس ببعيد أن يكون السقط من صنعة الوليد، وجزم بذلك الحافظ ابن حجر في "تخريج أحاديث مختصر ابن الحاجب" 1/ 510.
Reference / Source: Ibn Majah (2045) narrated it via al-Walid bin Muslim, who said: al-Awza'i narrated to us, from 'Ata', from Ibn 'Abbas. He dropped "'Ubayd bin 'Umayr" from the chain.
Technical note / Defect ('illah): Al-Walid is known for "tadlis al-taswiyah", as al-Busiri said in "Misbah al-Zujajah" (728), adding that it is not unlikely that this omission was al-Walid's doing. Al-Hafiz Ibn Hajar stated this with certainty in "Takhrij Ahadith Mukhtasar Ibn al-Hajib" (1/ 510).
وقال أبو العباس القرطبي في "المفهم" 7/ 322 في شرح الحديث: أي رفع إثم ذلك، وهذا لم يُختلَف فيه أنَّ الإثم مرفوع، وإنما اختُلف فيما يتعلق على ذلك من الأحكام، هل ذلك مرفوع لا يلزم منه شيءٌ، أو يلزم أحكام ذلك كله؟ اختُلِف فيه، والصحيح أنَّ ذلك يختلف بحسب الوقائع، فقسم لا يسقط بالخطأ والنسيان باتفاق، كالغرامات والديات والصلوات، وقسم يسقط باتفاق كالقِصاص والنطق بكلمة الكفر ونحو ذلك، وقسم ثالث يُختلَف فيه، وصُوره لا تنحصر، ويُعرف تفصيل ذلك في الفروع.
General principle: Abu al-'Abbas al-Qurtubi says in "al-Mufhim" (7/ 322), explaining this hadith: It means that the sin of that has been lifted, and there is no disagreement that the sin is lifted. The disagreement concerns the rulings that follow from it: are they also lifted so that nothing is binding, or are all its rulings binding? There is disagreement about this. The correct view is that it varies according to the case. One category is not dropped because of error and forgetfulness, by agreement, such as liabilities for damages, blood-money and prayers. Another category is dropped by agreement, such as retaliation (qisas) and uttering a word of disbelief, and the like. And a third category is disputed; its forms are countless, and their details are known in the branches of jurisprudence (furu').
