Mustadrak al-Hakim — Hadith 2836

حدثنا أبو العباس محمد بن يعقوب، حدثنا الربيع بن سليمان، حدثنا عبد الله بن وهب، أخبرني سليمان بن بلال، عن عبد الرحمن بن حَبيب، أنه سمع عطاء بن أبي رباح يقول: أخبرني يوسف بن ماهَك، أنه سمع أبا هريرة يحدِّث، عن رسول الله ﷺ، سمعه يقول: "ثلاثٌ جِدُّهُنّ جِدٌّ، وهَزْلُهن جِدٌّ: النكاحُ، والطلاقُ، والرَّجْعة" (1).
هذا حديث صحيح الإسناد، وعبد الرحمن بن حبيب هذا هو: ابن أرْدَك من ثِقات المدنيِّين، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that he heard the Messenger of Allah (peace and blessings be upon him) say: "There are three things which, said in earnest, are earnest, and said in jest, are also counted as earnest: marriage, divorce and taking back (a divorced wife)."
This hadith is sahih (authentic) in its chain, and its narrator Abdur-Rahman bin Habib is among the trustworthy narrators of Madinah, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) حسن لغيره، وهذا إسناد رجاله ثقات غير عبد الرحمن بن حبيب - وهو ابن أرْدك - فقد قال عنه النسائي: منكر الحديث. قلنا: وهذا الحديث مسندًا من منكراته، وذلك أنَّ ابن جُرَيج قد روى عن عطاء بن أبي رباح، قال: يُقال: من نكح لاعِبًا أو طلق لاعِبًا فقد جاز. قال ابن عبد البر: لو كان - والله أعلم - صحيحًا عن عطاء (قلنا: يعني حديثه الذي هنا عن أبي هريرة) لما خفي (يعني على ابن جُرَيج) فإنه أقعد الناس بعطاء وأثبتهم فيه. قلنا: لكن في الباب ما يشهد له، وعليه العمل باتفاق كما قال الترمذي بإثر الحديث (1184)، وابن المنذر في "الأوسط" 9/ 259، وأبو بكر الجصّاص في "أحكام القرآن" 2/ 99، وابن عبد البر في "الاستذكار" (24963)، وذكروا شواهده.
Grading: This hadith is "hasan li-ghayrihi" (hasan due to supporting evidence).
Technical note / Defect ('illah): The narrators of this chain are trustworthy (thiqat) except "Abd al-Rahman bin Habib" (Ibn Ardak), whom al-Nasa'i called "munkar al-hadith". We say: narrating this hadith as "musnad" is among his munkar reports, because Ibn Jurayj narrated from 'Ata' bin Abi Rabah that "it is said: whoever marries in jest or divorces in jest, it takes effect". Ibn 'Abd al-Barr said: had it been sahih from 'Ata' (from Abu Hurayrah), it would not have been hidden from Ibn Jurayj, for he was the closest of people to 'Ata' and the most reliable in narrating from him. However, there are supporting reports for it in this chapter, and it is acted upon by agreement, as al-Tirmidhi (1184), Ibn al-Mundhir ("al-Awsat" 9/ 259), Abu Bakr al-Jassas ("Ahkam al-Qur'an" 2/ 99) and Ibn 'Abd al-Barr ("al-Istidhkar" 24963) said, and they mentioned its supporting reports.
وأخرجه أبو داود (2194) من طريق عبد العزيز بن محمد الدراوردي، وابن ماجه (2039)، والترمذي (1184) من طريق حاتم بن إسماعيل، كلاهما عن عبد الرحمن بن حبيب، بهذا الإسناد.
Reference / Source: Abu Dawud (2194) narrated it via Abd al-'Aziz bin Muhammad al-Darawardi; and Ibn Majah (2039) and al-Tirmidhi (1184) via Hatim bin Isma'il. Both narrate it from Abd al-Rahman bin Habib, with this chain.
وقال الترمذي: حسن غريب.
Grading: Imam al-Tirmidhi called it "hasan gharib".
وله شواهد موقوفة ومقطوعة انظرها في "مصنف عبد الرزاق" (10244 - 10253) و"مصنف ابن أبي شيبة" 5/ 105 - 106، لكن كلها بذكر العَتَاق بدل الرجْعة.
Corroborating chains and supporting reports: See its "mawquf" and "maqtu'" supporting reports in "Musannaf Abd al-Razzaq" (10244-10253) and "Musannaf Ibn Abi Shaybah" (5/ 105-106), but all of them mention "emancipation" ('ataq) instead of taking back (raj'ah).
والرّجْعة، بكسر الراء وفتحها، أي: عَوْد المُطلِّق إلى طليقته.
Note / Clarification: "Al-raj'ah" (with either kasrah or fathah on the ra') means: the divorcing husband's returning to his divorced wife.
