Mustadrak al-Hakim — Hadith 2823

أخبرنا أحمد بن سلمان الفقيه، قال: قُرئ على عبد الملك بن محمد وأنا أسمع، حدثنا عبد الصمد بن عبد الوارث، حدثني أبي، حدثنا القاسم بن عبد الواحد، عن عبد الله بن محمد بن عَقِيل، عن جابر بن عبد الله، قال: قال رسول الله ﷺ: "إذا تَزوّج العبدُ بغير إذنِ سيّده، كان عاهرًا" (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "When a slave marries without the permission of his master, he is a fornicator ('ahir)."
This hadith is sahih (authentic) in its chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) إسناده حسن إن شاء الله، وقد روي عن ابن عمر موقوفًا عليه ما يشدُّه، وعليه العمل، كما قال الترمذي وابن المنذر في "الأوسط" بين يدي الحديث (7472)، وقد صحَّحه الترمذي، ¤ ¤ وقوّاه ابنُ القطان في "بيان الوهم" 5/ 293.
Grading: The chain of this hadith is "hasan", in sha' Allah.
Corroborating chains and supporting reports: There is also a report from Ibn 'Umar (may Allah be pleased with them both), as his own statement (mawquf), that strengthens it, and (the scholars') practice is according to it, as al-Tirmidhi said, and Ibn al-Mundhir in "al-Awsat" before hadith (7472). Al-Tirmidhi declared it "sahih", and Ibn al-Qattan considered it strong in "Bayan al-Wahm" (5/ 293).
وأخرجه أحمد 23/ (15092) من طريق همام بن يحيى، عن القاسم، به.
Reference / Source: Imam Ahmad (23/ 15092) narrated it via Hammam bin Yahya, from al-Qasim, likewise.
وأخرجه أحمد 22/ (14212)، وأبو داود (2078) من طريق الحسن بن صالح، وأحمد 23/ (15031)، والترمذي (1112) من طريق ابن جُرَيج، والترمذي (1111) من طريق زهير بن محمد، ثلاثتهم عن عبد الله بن محمد بن عقيل، به.
Reference / Source: Imam Ahmad (22/ 14212) and Abu Dawud (2078) narrated it via al-Hasan bin Salih; Imam Ahmad (23/ 15031) and al-Tirmidhi (1112) via Ibn Jurayj; and al-Tirmidhi (1111) via Zuhayr bin Muhammad. All three narrate it from Abd Allah bin Muhammad bin 'Aqil, likewise.
وأخرجه ابن ماجه (1959) عن أزهر بن مروان، عن عبد الوارث بن سعيد، عن القاسم بن عبد الواحد، عن عبد الله بن محمد بن عقيل، عن ابن عمر، فذكر ابن عمر بدل جابر، وقال البخاري فيما نقله عنه الترمذي في "العلل الكبير" (270): عبد الله بن محمد بن عقيل عن جابر أصح.
Reference / Source: Ibn Majah (1959) narrated it from Azhar bin Marwan, from Abd al-Warith bin Sa'id, from al-Qasim bin Abd al-Wahid, from Abd Allah bin Muhammad bin 'Aqil, from Ibn 'Umar; he mentioned "Ibn 'Umar" instead of Jabir.
Technical note / Defect ('illah): Imam al-Bukhari said (as reported by al-Tirmidhi in "al-'Ilal al-Kabir" 270): The narration of Abd Allah bin Muhammad bin 'Aqil from Jabir is more correct.
وفي الباب عن ابن عمر مرفوعًا، لكن بلفظ: "فهو باطل" أخرجه أبو داود (2079)، وإسناده ضعيف، والصحيح أنه موقوف على ابن عمر كما قال أبو داود والدارقطني. وقد أخرجه موقوفًا عليه عبد الرزاق (12981) و (12982)، وابن أبي شيبة 4/ 261 وغيرهما بأسانيد صحيحة عن نافع عنه.
Corroborating chains and supporting reports: In this chapter there is also a "marfu'" narration from Ibn 'Umar, but with the wording "fa-huwa batil" (then it is void); Abu Dawud (2079) narrated it, and its chain is "da'if" (weak). The correct view is that it is "mawquf" on Ibn 'Umar, as Abu Dawud and al-Daraqutni said. Abd al-Razzaq (12981 and 12982), Ibn Abi Shaybah (4/ 261) and others narrated it as mawquf on him with sahih chains, from Nafi', from him (Ibn 'Umar).
