Mustadrak al-Hakim — Hadith 2821

حدثنا أبو بكر بن إسحاق الفقيه، أخبرنا أبو المُثنَّى، حدثنا مُسدَّد، حدثنا المُعتمِر، عن أبيه، قال: حدثنا الحَضرميُّ بن لاحِق، عن القاسم بن محمد، عن عبد الله بن عمرو: أنَّ رجلًا من المسلمين استأذن نبيَّ الله ﷺ في امرأةٍ يُقال لها: أم مَهزُول، كانت تُسافِح وتشترط أن تُنفِقَ (1) عليه، وأنه استأذنَ فيها نبيَّ الله ﷺ، وذكَرَ له أمرَها، فقرأ نبيُّ الله ﷺ: ﴿الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً﴾، ونزلت ﴿وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ﴾ [النور: 3] (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) that a man from among the Muslims asked the Prophet (peace and blessings be upon him) for permission to marry a woman called "Umm Mahzul", who used to commit fornication and had stipulated that she would spend on the man (from her own wealth). The man asked the Prophet (peace and blessings be upon him) for permission regarding her and mentioned her whole situation to him, so the Prophet (peace and blessings be upon him) recited this verse: 'The fornicator does not marry except a fornicatress or a polytheist woman', and this was revealed: 'and the fornicatress, none marries her except a fornicator or a polytheist man' [Surah al-Nur: 3] (and that has been made unlawful for the believers).
This hadith is sahih (authentic) in its chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) بالمثناة على البناء للمعلوم، يعني أنها تكفيه النفقة، كما جاء مفسَّرًا في بعض روايات الحديث، يعني أن تنفق عليه هي من كسبها.
Note / Clarification: The word (takfihi) is with "ta'" and in the active voice (ma'lum), meaning that she (the woman) provides for him (suffices him in maintenance), as is explained in some narrations of the hadith, i.e. she spends on him from her own earnings.

(2) إسناده حسن إن شاء الله من أجل الحضرمي، وهو ليس بابن لاحق، كما جاء مقيَّدًا في رواية مُسدَّد خطأً، وإنما هو رجلٌ آخر جهَّله ابنُ المَديني، وقال عنه ابن مَعين وابن عَدي: ليس به بأس. المعتمر: هو ابن سليمان بن طَرْخان التيمي، وأبو المثنَّى: هو معاذ بن المثنَّى العنبري.
Grading: This chain is "hasan", in sha' Allah, because of "al-Hadrami".
Technical note / Defect ('illah): This al-Hadrami is not "Ibn Lahiq", as he was mistakenly specified in the narration of Musaddad; rather he is another man whom Ibn al-Madini declared "majhul" (unknown), while Ibn Ma'in and Ibn 'Adi said: "there is no harm in him" (la ba'sa bihi). Al-Mu'tamir (in the chain) is "Ibn Sulayman bin Tarkhan al-Taymi", and Abu al-Muthanna is "Mu'adh bin al-Muthanna al-'Anbari".
وأخرجه أحمد 11/ (6480) و (7099) عن محمد بن الفضل عارم، والنسائي (11295) عن عمرو بن علي الفلّاس، كلاهما عن المعتمر بن سليمان بهذا الإسناد. والحضرمي عندهما مهمل غير مقيَّد.
Reference / Source: Imam Ahmad (11/ 6480 and 7099) narrated it from Muhammad bin al-Fadl 'Arim, and al-Nasa'i (11295) from 'Amr bin 'Ali al-Fallas, both from al-Mu'tamir bin Sulayman, with this chain. With both of them "al-Hadrami" is left unspecified (muhmal).
وسيأتي بنحوه برقم (3537) من طريق هُشَيم بن بَشير عن سليمان التيمي عن القاسم بن محمد. فلم يذكر هُشَيم في إسناده الحضرميَّ!
Details of the narration: A similar narration will come later at no. (3537) via Hushaym bin Bashir, from Sulayman al-Taymi, from al-Qasim bin Muhammad. But Hushaym did not mention "al-Hadrami" in his chain!
وتقدَّم بنحوه أيضًا برقم (2734) من طريق عمرو بن شعيب عن أبيه عن جده.
Details of the narration: A similar narration also preceded at no. (2734) via 'Amr bin Shu'ayb, from his father, from his grandfather.
