Mustadrak al-Hakim — Hadith 2796

أخبرنا أبو عبد الله محمد بن عبد الله الصَّفّار، حدثنا إسماعيل بن إسحاق القاضي، حدثنا موسى بن إسماعيل، حدثنا حماد بن سَلَمة، عن أيوب، عن أبي قِلَابة، عن عبد الله بن يزيد الخَطْمي، عن عائشة، قالت: كان رسولُ الله ﷺ يَقسِم فيَعدِل، فيقول: "اللهم هذا قَسْمِي فيما أَملِكُ، فلا تَلُمْني فيما تَملِكُ ولا أَملِكُ" (2). قال إسماعيلُ القاضي: يعني القلبَ. وهذا في العَدْل بين نسائه.
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyidah Aishah (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) would divide (the rights among his wives) and uphold justice and fairness, and then he would supplicate: 'Allahumma hadha qasmi fima amlik, fala talumni fima tamliku wa la amlik' (O Allah, this is my division in what is within my power, so do not blame me for what is in Your control and not within my power (that is, the inclination of the heart)). Isma'il al-Qadi said that this means "the heart", and that it concerns justice (in love) between wives.
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) إسناده صحيح كما قال ابن كثير في "تفسيره" 2/ 382، إلّا أنه اختُلف في وصله وإرساله، ورجَّحَ الإرسالَ غير واحدٍ من الأئمة، والقولُ فيه كالقول في الحديث المتقدم برقم (2794)، وفي معناه حديث عائشة الذي قبله، ويشهد لمعناه أيضًا قوله تعالى: ﴿وَلَنْ تَسْتَطِيعُوا أَنْ تَعْدِلُوا بَيْنَ النِّسَاءِ وَلَوْ حَرَصْتُمْ فَلَا تَمِيلُوا كُلَّ الْمَيْلِ فَتَذَرُوهَا كَالْمُعَلَّقَةِ﴾.
Grading: The chain of this hadith is sahih, as Ibn Kathir said in his "Tafsir" (2/ 382).
Technical note / Defect ('illah): However, there is disagreement over whether it is "muttasil" or "mursal", and a number of imams preferred its being "mursal". What applies to it is the same as what has passed regarding hadith number (2794).
Corroborating chains and supporting reports: Its meaning is supported by the preceding hadith of 'A'ishah, and its meaning is also supported by the saying of Allah the Exalted: ﴿وَلَنْ تَسْتَطِيعُوا أَنْ تَعْدِلُوا بَيْنَ النِّسَاءِ﴾ (And you will never be able to be just between women, however much you may desire it, so do not incline completely (to one) and leave the other as if suspended).
أيوب: هو ابن أبي تَميمة السَّختِياني، وأبو قلابة: هو عبد الله بن زيد الجرمي.
Note / Clarification: Ayyub (in the chain) refers to "Ibn Abi Tamimah al-Sakhtiyani", and Abu Qilabah refers to "'Abdullah bin Zayd al-Jarmi".
وأخرجه أبو داود (2134) عن موسى بن إسماعيل، بهذا الإسناد.
Reference / Source: Abu Dawud (2134) narrated it from Musa bin Isma'il with this same chain.
وأخرجه أحمد 42/ (25111)، وابن ماجه (1971)، والنسائي (8840) من طريق يزيد بن هارون، وأحمد (25111) عن عفان بن مسلم، والترمذي (1140) من طريق بشر بن السَّرِيّ، ثلاثتهم عن حماد بن سلمة، به.
Reference / Source: Ahmad (42/ 25111), Ibn Majah (1971) and al-Nasa'i (8840) recorded it through the route of Yazid bin Harun; Ahmad (25111) from 'Affan bin Muslim; and al-Tirmidhi (1140) through the route of Bishr bin al-Sari. These three (Yazid, 'Affan, Bishr) narrate it from "Hammad bin Salamah" with this same chain.
وقد روى هذا الحديثَ غيرُ واحدٍ عن أيوب عن أبي قلابة مرسلًا، منهم: معمر عند عبد الرزاق في "تفسيره" 2/ 120، وإسماعيل ابن عُلَيَّة عند ابن أبي شيبة 4/ 386 وغيره، وحماد بن زيد عند الطبري في "تفسيره" 5/ 315.
Details of the narration: This hadith was (also) narrated by several narrators from Ayyub, from Abu Qilabah, as "mursal". Among them are: Ma'mar, with 'Abd al-Razzaq in his "Tafsir" (2/ 120); Isma'il Ibn 'Ulayyah, with Ibn Abi Shaybah (4/ 386) and elsewhere; and Hammad bin Zayd, with al-Tabari in his "Tafsir" (5/ 315).
