Mustadrak al-Hakim — Hadith 2794

أخبرنا أبو بكر أحمد بن سَلْمان الفقيه، حدثنا جعفر بن أبي عثمان الطيالسي، حدثنا عفان ومحمد بن سِنان، قالا: حدثنا همّام، عن قَتَادة، عن النضْر بن أنس، عن بَشير بن نَهِيك، عن أبي هريرة، عن النبي ﷺ، قال: "إذا كانت عند الرجُل امرأتانِ فلم يَعدِلْ بينَهما، جاء يومَ القيامة وشِقُّه ساقِطٌ" (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "Whoever has two wives and does not deal with them justly and equally will come on the Day of Resurrection with one of his sides drooping (that is, paralysed)."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

Technical note / Defect ('illah): Hammam refers to "Hammam bin Yahya al-'Awdhi".
وأخرجه أحمد 14/ (8568) عن عفان بن مسلم، بهذا الإسناد.
Reference / Source: Ahmad (14/ 8568) narrated it from 'Affan bin Muslim with this same chain.
وأخرجه أحمد 13/ (7936) و 14/ (8568) و 16/ (10090)، وأبو داود (3133)، وابن ماجه (1969)، والترمذي (1141)، والنسائي (8839)، وابن حبان (4207) من طرق عن همام بن يحيى، به.
Reference / Source: Ahmad (13/ 7936, 14/ 8568, 16/ 10090), Abu Dawud (3133), Ibn Majah (1969), al-Tirmidhi (1141), al-Nasa'i (8839) and Ibn Hibban (4207) narrated it likewise through various routes from Hammam bin Yahya.
وذكر الترمذي بإثره أنَّ هشامًا الدستوائي رواه عن قتادة فقال: كان يقال. ولم يسنده، ولم نقف علي طريق هشام هذه مسندة عند غيره.
Technical note / Defect ('illah): Al-Tirmidhi mentioned after it that Hisham al-Dastuwa'i narrated it from Qatadah and said: "كان يقال" (it used to be said). He did not narrate it with a connected chain (musnad, marfu'), and we have not found this route of Hisham with a connected chain with anyone else either.
وأخرجه الترمذي أيضًا في "العلل الكبير" (287) من طريق سعيد بن أبي عروبة، عن قتادة، قال: كان يقال، فذكره. وصوّب في "الجامع" وفي "العلل الكبير" رواية همام بأنَّه حافظ ثقة. ومقصوده بذلك أنَّ القول قوله، لأنه حفظ ما لم يحفظه الآخران على ثقتهما وجلالتهما.
Reference / Source: Al-Tirmidhi narrated it in "al-'Ilal al-Kabir" (287) through the route of Sa'id bin Abi 'Arubah from Qatadah, who said: "كان يقال" (it used to be said), and then he mentioned it.
Important point: In his "al-Jami'" and "al-'Ilal al-Kabir", al-Tirmidhi judged Hammam's narration to be correct (sawab) because he is "a hafiz and thiqah". His intent is that Hammam's version is the reliable one, because he preserved what (the chain/raf') the other two narrators (Hisham and Sa'id) did not preserve, despite their trustworthiness and eminence.
قال ابن حجر الهيتمي في "الزواجر" 2/ 60: المراد المَيل بظاهره بأن يُرجّح إحداهما في الأمور الظاهرة التي حرَّم الشارع الترجيح فيها، لا المَيلَ القلبي لخبر أصحاب "السنن"؛ وذكر الحديث الآتي عند المصنف برقم (2796).
General principle: Ibn Hajar al-Haytami says in "al-Zawajir" (2/ 60): What is meant (by inclining) is outward inclination, i.e. preferring one of them in outward matters in which the Lawgiver has forbidden preference, not inclination of the heart; because of the hadith of the authors of the Sunan which will come with the author (al-Hakim) later at number (2796).
