Mustadrak al-Hakim — Hadith 2781

حدثنا يحيى بن منصور القاضي، حدثنا أبو بكر محمد بن محمد بن رجاء، حدثنا محمد بن أبي السَّرِي العَسْقلاني، حدثنا عبد الرزاق، أخبرنا ابن جُرَيج، عن صفوان بن سُليم، عن سعيد بن المسيّب، عن رجل من أصحاب رسول الله ﷺ من الأنصار، يقال له: نَضْرة، قال: تزوّجتُ امرأة بِكْرًا في سِتْرها، فدخلتُ عليها فإذا هي حُبلَى، فقال لي النبي ﷺ: "لها الصَّداقُ بما استَحلَلْتَ من فَرجِها، والولدُ عَبدٌ لك، فإذا وَلَدَت فاجلِدُوها" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه. وله شاهدٌ من حديث يحيى بن أبي كثير:

It is narrated from Sayyiduna Nadrah (may Allah be pleased with him), who was a Companion from the Ansar, that he married a virgin girl, and when he went in to her he found her pregnant. Then the Prophet (peace and blessings be upon him) said: "Her dowry is established for her, because you made her private part lawful for yourself (through marriage); the child that is born will be your slave; and when she gives birth, flog her (as the prescribed punishment)."
This hadith has a sahih (authentic) chain, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده ضعيف لعلتين، الأُولى: أنَّ ابن جُرَيج - وهو عبد الملك بن عبد العزيز المكي - لم يسمعه من صفوان بن سُليم، كما توضحه رواية عبد الرزاق التي في "المصنف" (10705) حيث جاء فيها: عن ابن جُرَيج قال: حُدِّثتُ عن صفوان بن سُليم؛ وقد عُرفت الواسطة بينهما في رواية إسحاق بن إبراهيم بن كامَجرا عن عبد الرزاق عند الدارقطني (3616)، حيث قال فيها عبد الرزاق: حديث ابن جُرَيج عن صفوان: هو ابن جُرَيج عن إبراهيم بن أبي يحيى عن صفوان بن سليم. قلنا: وإبراهيم هذا متروك. والعلة الثانية: أنه رواه عن سعيد بن المسيب جماعةٌ غيرُ صفوان كما أشار إليه أبو داود بإثر (2131) فأرسلوه، وهو الصواب، وقد نبَّه على هاتين العلتين جماعةٌ، منهم أبو حاتم الرازي في "العلل" لابنه (1259)، وعبد الحق الإشبيلي في "أحكامه الوسطى" 3/ 156، والبيهقي في "السنن الكبرى" 7/ 157، وابن القيم في "تهذيب سنن أبي داود" 3/ 60 - 61.
Grading: The chain of this hadith is "da'if" because of two defects ('ilal):
Technical note / Defect ('illah): The first defect: Ibn Jurayj (who is 'Abd al-Malik bin 'Abd al-'Aziz al-Makki) did not hear it directly from Safwan bin Sulaym, as is made clear in 'Abd al-Razzaq's narration in "al-Musannaf" (10705), where Ibn Jurayj's words are: "حدثت عن صفوان" (I was told on the authority of Safwan). The intermediary between the two is known from the narration of Ishaq bin Ibrahim bin Kamajra (which is in al-Daraqutni 3616), where 'Abd al-Razzaq clarified that between Ibn Jurayj and Safwan there is the intermediary "Ibrahim bin Abi Yahya", and we say that this Ibrahim is "matruk" (one whose narrations are abandoned). The second defect: a group other than Safwan narrated it from Sa'id bin al-Musayyab, as Abu Dawud indicated after hadith (2131), and they narrated it as "mursal" (i.e. without mentioning the Companion), and this is what is correct.
Reference / Source: A group of scholars drew attention to these two defects, among them Abu Hatim al-Razi in "al-'Ilal" (1259), 'Abd al-Haqq al-Ishbili in "al-Ahkam al-Wusta" (3/ 156), al-Bayhaqi in "al-Sunan al-Kubra" (7/ 157), and Ibn al-Qayyim in "Tahdhib Sunan Abi Dawud" (3/ 60-61).
وضعَّف الإمامُ أحمد الحديث في الجملة كما نقله عنه إسحاق بن منصور الكوسج في "مسائله" (2708).
Grading: Imam Ahmad declared this hadith "da'if" overall, as Ishaq bin Mansur al-Kawsaj reported from him in his "Masa'il" (2708).
وأخرجه أبو داود (2131) عن محمد بن أبي السَّرِيّ ومخلد بن خالد والحسن بن علي، عن عبد الرزاق، بهذا الإسناد.
Reference / Source: Abu Dawud (2131) narrated it from Muhammad bin Abi al-Sari, Makhlad bin Khalid and al-Hasan bin 'Ali, all of whom narrate it from 'Abd al-Razzaq with this same chain.

Details of the narration: This narration will come later at number (6659) through the route of Mahmud bin Ghaylan, who narrates it from 'Abd al-Razzaq.
وبعده من طريق يزيد بن نُعيم عن سعيد بن المسيب، موصولًا كذلك، لكنه مُعَلٌّ.
Details of the narration: And after it, it will also come through the route of Yazid bin Nu'aym from Sa'id bin al-Musayyab as "muttasil", but that narration is "mu'allal" (i.e. it has a defect).
تنبيه: قد اختُلف في ضبط اسم صحابي الحديث كما بيّنه ابن القيم في "تهذيب السنن"، وابن حجر في "الإصابة" 1/ 319، فقيل أيضًا: إنه بالباء الموحدة والصاد المُهملة، وقيل: نضلة، بالنون والضاد المعجمة واللام.
Note / Clarification: Caution: there is disagreement over the exact spelling (pronunciation/orthography) of the name of the Companion of this hadith, as Ibn al-Qayyim explained in "Tahdhib al-Sunan" and Ibn Hajar in "al-Isabah" (1/ 319). One view is that the name is "Basrah" (with ba' and an unpointed sad), and another view is that it is "Nadlah" (with nun, a pointed dad and lam).
