Book of Marriage
إِذَا نَكَحَ الوَلِيَّانِ فَهُوَ لِلْأَوَّلِ ، وَإِذَا بَاعَ الْمُجِيزَانِ فَهُوَ لِلْأَوَّلِ
If two guardians give her in marriage, it belongs to the first, and if two agents sell, it belongs to the first

فحدَّثَناه أبو بكر بن إسحاق الفقيه، أخبرنا عُبيد بن شَريك، حدثنا أبو الجُمَاهِر، حدثنا سعيد بن بَشير، عن قَتَادة، عن الحسن، عن سَمُرة بن جندب، قال: قال رسول الله ﷺ: "إذا أنكَحَ الوَليّان، فهو للأول، وإذا باع المُجِيزان، فهو للأول" (1). وقد تابعَ (2) قَتَادة على روايته عن الحسن أشعثُ بن عبد الملك الحُمْراني:
It is narrated from Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "When two (separate) guardians marry (a woman off in two places), she belongs to the first (marriage), and when two (authorised) agents sell (the same thing to two parties), it belongs to the first (buyer)." Ash'ath bin Abd al-Malik al-Humrani also corroborated Qatadah in this narration from al-Hasan al-Basri.

(1) حديث صحيح، وهذا إسناد حسن في المتابعات والشواهد من أجل سعيد بن بشير. أبو الجُماهِر: هو محمد بن عثمان التَّنُوخي.
Grading: This hadith is "sahih", and this chain is "hasan" for corroborations and supporting reports because of Sa'id bin Bashir.
Technical note / Defect ('illah): "Abu al-Jamahir" is Muhammad bin Uthman al-Tanukhi.
وأخرجه ابن ماجه (2191) من طريق وكيع بن الجراح، عن سعيد بن بشير، بهذا الإسناد. مُقتصِرًا على ذكر المُجيزَين.
Reference / Source: Ibn Majah (2191) recorded it via Waki' bin al-Jarrah, from Sa'id bin Bashir, with this same chain, but he confined himself to mentioning the two who contracted the marriage (al-mujizayn).
(2) تحرَّف في النسخ الخطية إلى: تابعه.
Technical note / Defect ('illah): In the manuscripts the word here has been distorted into "tabi'ahu".
