Mustadrak al-Hakim — Hadith 2740

أخبرنا أبو العباس محمد بن أحمد المَحبُوبي بمَرْو، حدثنا محمد بن معاذ. وأخبرنا عبد الرحمن بن حَمْدان الجَلّاب بهَمَذان، حدثنا محمد بن الجَهْم السِّمَّري؛ قالا: حدثنا أبو عاصم الضحّاك بن مَخْلد، حدثنا ابن جُرَيج، قال: سمعت سليمان بن موسى يقول: حدثنا الزُّهْري، قال: سمعتُ عُروة يقول: سمعت عائشةَ تقول: سمعتُ رسول الله ﷺ يقول: "أيُّما امرأةٍ نَكَحَتْ بغير إذن وليِّها، فنِكاحُها باطِلٌ، فنِكاحُها باطِلٌ، فنِكاحُها باطِلٌ، فإن أصابها فلها مهرُها بما أصابها، وإن تَشاجَرُوا، فالسلطانُ وَليُّ مَن لا وَليَّ له" (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه. وقد تابع أبا عاصم على ذكر سماع ابنِ جُرَيج من سليمان بن موسى وسماع سليمان بن موسى من الزُّهْري: عبد الرزاق بن همّام ويحيى بن أيوب وعبد الله بن لَهِيعة وحَجّاج بن محمد المِصِّيصي. أما حديث عبد الرزاق:
It is narrated from Sayyidah Aishah (may Allah be pleased with her) that she said: I heard the Messenger of Allah (peace and blessings be upon him) saying: "Any woman who marries without the permission of her guardian, her marriage is void, her marriage is void, her marriage is void. If the husband has had intercourse with her, then because of that intercourse the woman is entitled to her dowry (mahr). And if the guardians dispute with one another, then the ruler (sultan) is the guardian of the one who has no guardian."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it. Abd al-Razzaq bin Hammam, Yahya bin Ayyub, Abdullah bin Lahi'ah and Hajjaj bin Muhammad al-Missisi have corroborated (Abu Asim) in this regarding Ibn Jurayj hearing it from Sulayman bin Musa, and Sulayman hearing it from al-Zuhri.

(1) حديث صحيح، وهذا إسناد حسن، محمد بن معاذ - وهو ابن يوسف السُّلَمي المروَزي - روى عنه جمع من الحفاظ، ولا يُعرف بجرح، وسليمان بن موسى قوي الحديث.
Grading: This hadith is "sahih", and this chain of it is "hasan".
Technical note / Defect ('illah): The narrator Muhammad bin Mu'adh (Ibn Yusuf al-Sulami al-Marwazi) has been narrated from by a group of hadith masters (huffaz), and no criticism of him is known; and Sulayman bin Musa is "qawi al-hadith" (strong in hadith).
وأخرجه أحمد 40/ (24205)، وأبو داود (2083)، وابن ماجه (1879)، والترمذي (1102)، والنسائي (5373)، وابن حبان (4074) و (4075) من طرق عن ابن جُرَيج، بهذا الإسناد. وقال الترمذي: حديث حسن. وانظر تمام الكلام عليه في "مسند أحمد".
Reference / Source: Ahmad (40/24205), Abu Dawud (2083), Ibn Majah (1879), al-Tirmidhi (1102), al-Nasa'i (5373) and Ibn Hibban (4074 and 4075) recorded it via various routes from Ibn Jurayj, with this same chain.
Grading: Al-Tirmidhi called it "a hasan hadith".

وأخرجه أحمد 40/ (24372)، وأبو داود (2084) من طريق ابن لهيعة، عن جعفر بن ربيعة، عن الزُّهْري، به.
Reference / Source: Ahmad (40/24372) and Abu Dawud (2084) recorded it via Ibn Lahi'ah, from Ja'far bin Rabi'ah, from Ibn Shihab al-Zuhri, as above.
