Mustadrak al-Hakim — Hadith 2736

أخبرَناه الحسن بن يعقوب العَدْل، حدثنا يحيى بن أبي طالب، حدثنا عبد الوهاب بن عطاء، حدثنا محمد بن عمرو. وحدثنا أبو الوليد الفقيه، حدثنا إبراهيم بن أبي طالب، حدثنا عمرو بن علي، حدثنا المعتمِر، قال: سمعت محمد بن عمرو يُحدّث عن أبي سلمة، عن أبي هريرة، أنَّ النبي ﷺ قال: "تُستأمَرُ اليتيمةُ في نفسها، فإن سَكَتَت فهو رضاها، وإن أبَتْ فلا جَوازَ عليها" (1).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه.
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "An orphan girl is to be consulted about herself (her marriage). If she remains silent, that is her consent, and if she refuses, then it (a forced marriage) is not permissible upon her."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) صحيح لغيره، وهذا إسناد حسن من أجل محمد بن عمرو: وهو ابن علقمة الليثي.
Grading: This narration is "sahih li-ghayrihi", and this chain is "hasan" because of Muhammad bin Amr (Ibn Alqamah al-Laythi).
وأخرجه أحمد 12/ (7527) عن عبد الواحد بن واصل الحداد، وأبو داود (2093) من طريق يزيد بن زُريع، ومن طريق حماد بن سلمة، والترمذي (1109) من طريق عبد العزيز بن محمد الدَّرَاوَرْدي، والنسائي (5360) من طريق يحيى القطان، خمستهم عن محمد بن عمرو، به.
Reference / Source: Ahmad (12/7527) recorded it from Abd al-Wahid bin Wasil al-Haddad, Abu Dawud (2093) via Yazid bin Zuray' and via Hammad bin Salamah, al-Tirmidhi (1109) via al-Darawardi, and al-Nasa'i (5360) via Yahya al-Qattan. All five of them narrate it from Muhammad bin Amr.
وأخرجه البخاري (5136)، ومسلم (1419)، وأبو داود (2092)، وابن ماجه (1871)، والترمذي (1107)، والنسائي (5357) من طريق يحيى بن أبي كثير، عن أبي سلمة، عن أبي هريرة، بلفظ: "لا تُنكح الأيِّم حتَّى تُستأمَر، ولا تُنكح البكرُ حتى تُستأذَن" قالوا: يا رسول الله، وكيف إذنُها؟ قال: "أن تسكت".
Reference / Source: Al-Bukhari (5136), Muslim (1419), Abu Dawud (2092), Ibn Majah (1871), al-Tirmidhi (1107) and al-Nasa'i (5357) recorded it via Yahya bin Abi Kathir, from Abu Salamah, from Abu Hurayrah, with the wording: "A previously married woman (ayyim) is not to be married until her instruction is sought, and a virgin is not to be married until her permission is sought." They said: "O Messenger of Allah, how is her permission (known)?" He (peace and blessings be upon him) said: "That she remains silent."
ويشهد للفظ محمد بن عمرو حديث أبي موسى الأشعري الذي قبله، ويشهد لمعناه حديث ابن عمر الذي بعده.
Corroborating chains and supporting reports: The specific wording of Muhammad bin Amr's narration is supported by the narration before it (the hadith of Abu Musa al-Ash'ari), while its meaning is supported by the next narration, of Ibn Umar.
وكذا يشهد لمعناه حديث ابن عباس عند أحمد 4/ (2469)، وأبي داود (2096)، وابن ماجه (1875)، والنسائي (5366)، وإسناده صحيح.
Corroborating chains and supporting reports: Likewise its meaning is supported by the hadith of Ibn Abbas (may Allah be pleased with them both) in Ahmad (4/2469), Abu Dawud (2096), Ibn Majah (1875) and al-Nasa'i (5366), whose chain is "sahih".
وقوله: "لا جَوازَ عليها" أي: لا ولاية عليها مع الامتناع.
Note / Clarification: "La jawaza 'alayha" means that if the woman refuses the marriage, no guardianship (wilayah) over her remains in force.
