Mustadrak al-Hakim — Hadith 2703

حدثنا محمد بن صالح بن هانئ، حدثنا السَّريّ بن خُزيمة، حدثنا موسى بن إسماعيل، حدثنا وُهَيب، عن معمر بن راشد، عن عبد الله بن طاووس، عن أبيه، عن ابن الزُّبَير، قال: قال رسول الله ﷺ: "مَن شَهَرَ سيفَه ثم وَضَعَه، فدَمُه هَدْرٌ" (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever draws his sword (for rebellion or attack) and then strikes with it, his blood is forfeit (that is, no retaliation or blood money will be claimed for him)."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(2) صحيح موقوفًا على عبد الله بن الزُّبَير، قد اختُلف في رفعه ووقفه عن معمر، فرواه عنه وهيب - وهو ابن خالد - والفضل بن موسى السِّيناني مرفوعًا، ورواه عنه عبد الرزاق موقوفًا، وكذلك رواه ابن جُرَيج عن عبد الله بن طاووس موقوفًا، ولهذا أنكر رفعه عليُّ بن المديني كما في "التعديل والتجريح" للباجي 3/ 1048، والبخاريُّ في "علل الترمذي الكبير" (429)، ومالَ إلى تصحيح وصله ابن حزم في "المحلى" 11/ 307، وعبد الحق في "أحكامه الوسطى" 4/ 73، وكذلك الحافظُ في "الدراية" 2/ 267.
Grading: This narration is sahih as "mawquf" (his own statement) on 'Abdullah bin al-Zubayr (may Allah be pleased with him).
Technical note / Defect ('illah): There is disagreement from Ma'mar over whether it is "marfu'" (a saying of the Prophet (peace and blessings be upon him)) or "mawquf". Wuhayb bin Khalid and al-Fadl bin Musa al-Sinani narrate it from him as marfu', while 'Abd al-Razzaq narrates it from him as mawquf, and likewise Ibn Jurayj narrates it from 'Abdullah bin Tawus as mawquf. For this reason Imam 'Ali bin al-Madini (as in al-Baji's "al-Ta'dil wa al-Tajrih" 3/1048) and Imam al-Bukhari (in al-Tirmidhi's "al-'Ilal al-Kabir" 429) rejected its being marfu'.
Important point: Imam Ibn Hazm (in "al-Muhalla" 11/307), 'Abd al-Haqq al-Ishbili (in "al-Ahkam al-Wusta" 4/73) and al-Hafiz Ibn Hajar (in "al-Dirayah" 2/267) inclined towards authenticating it as "mawsul" (marfu').
وأخرجه النسائي (3546) من طريق الفضل بن موسى، عن معمر، بهذا الإسناد.
Reference / Source: Imam al-Nasa'i narrated it in "al-Sunan" (3546) via al-Fadl bin Musa from Ma'mar with this same chain (as marfu').
وأخرجه النسائي (3547) من طريق عبد الرزاق، عن معمر، به موقوفًا. ¤ ¤ وأخرجه أيضًا (3548) من طريق ابن جُرَيج، عن عبد الله بن طاووس، به موقوفًا كذلك.
Reference / Source: Imam al-Nasa'i narrated it (3547) via 'Abd al-Razzaq from Ma'mar as "mawquf" (as a Companion's statement). Al-Nasa'i also narrated it (3548) via Ibn Jurayj from 'Abdullah bin Tawus likewise as "mawquf".
قوله: "فدمُه هدر" أي: لم يُطلب بثأره.
Linguistic clarification: His (peace and blessings be upon him) saying "fa-damuhu hadar" (his blood is forfeit) means that no retaliation or qisas will be sought for his blood.
