Mustadrak al-Hakim — Hadith 2700

أخبرنا أبو عبد الله محمد بن عبد الله الصَّفَّار، حدثنا أحمد بن يونس بن المسيَّب الضَّبِّي، حدثنا جعفر بن عَوْن، حدثنا إسماعيل بن أبي خالد، عن قيس بن أبي حازم وعامر الشَّعْبي، قالا: قال مروان بن الحكم لأيمن بن خُريم: ألا تخرجُ فتُقاتلَ معنا، فقال: إِنَّ أبي وعمِّي شهدا بدرًا، وإنهما عَهِدا إليّ أن لا أُقاتل أحدًا يقول: لا إله إلّا الله، فإن أنت جئتني ببراءةٍ من النار قاتلتُ معك، قال: فاخرُجْ عنا، قال: فخرج وهو يقول: ولست بقاتلٍ رجلًا يصلّي … على سلطانِ آخرَ من قريشِ له سُلْطانُه وعليَّ إثمي … معاذَ اللهِ مِن جَهلٍ وطَيشِ أأقتُلُ مسلمًا في غير جُرْمٍ … فليسَ بنافعي ما عشتُ عَيشي (2)
هذا حديث صحيح الإسناد على شرط الشيخين، ولم يُخرجاه. والصحابيان اللذان ذُكِرا وشَهِدا بدرًا يصير الحديثُ به في حدود المسانيد.

It is narrated from Sayyiduna Ayman bin Khuraym (may Allah be pleased with him) that Marwan bin al-Hakam said to him: Will you not come out and fight alongside us? He replied: My father and my paternal uncle both took part in the Battle of Badr, and they both instructed me not to fight anyone who says 'La ilaha illallah' (there is no god but Allah). If you bring me a release from the Fire (a guarantee of salvation), I will fight alongside you. Marwan said: Then leave us. So he went out reciting these verses: "I am not one to kill a man who prays / merely for the sake of the rule of another king of Quraysh / who has his own power, while the sin falls upon me / I seek refuge in Allah from ignorance and rashness. / Shall I kill a Muslim without any crime? / If I did so, my life would bring me no benefit as long as I live."
This hadith has a sahih (authentic) chain of narration on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it. And because of the two Companions mentioned, who took part in Badr, this hadith falls within the scope of the musnad (connected) reports.

Grading: All its narrators are thiqah, but Ja'far bin 'Awn, unlike all the other students of Isma'il bin Abi Khalid, is alone in mentioning "Qays bin Abi Hazim" in this chain. Great imams such as Shu'bah and Yahya al-Qattan (who are students of Isma'il) did not mention Qays, and these imams are far higher in rank than Ja'far bin 'Awn.
وقد جزم إسماعيلُ بن أبي خالد فيما أسنده عنه ابن عساكر في "تاريخ دمشق" 10/ 44 بأنَّ عامرًا الشعبي لم يسمع هذا الخبر، يعني لم يسمعه من أيمن بن خُريم ولا من مروان بن الحكم، وجزم إسماعيل أيضًا فيما أسنده عنه ابن عساكر 10/ 45 بأنه لم يسمع هذا الشعر المذكور من عامر الشعبي. واختُلف فيه عن الشعبي في تعيين الواقعة التي شهدها خريم بن فاتك وأخوه، فوقع في بعض الروايات عنه أنها بدر، وفي بعضها الآخر أنها الحديبية، وخطّأ الواقدي فيه ذكر بدر، لكن اعتمده البخاري وأبو حاتم وابن منده وابن السكن في إثبات شهودهما بدرًا، فيما نقله عنهم ابن عساكر 16/ 347، وابن العديم في "بغية الطلب" 7/ 3235، وقال ابن عساكر 16/ 351: ذكر الحديبية هو الصواب.
Technical note / Defect ('illah): Isma'il bin Abi Khalid stated decisively (as in Ibn 'Asakir's "Tarikh Dimashq" 10/44) that 'Amir al-Sha'bi did not hear this report, neither from Ayman bin Khuraym nor from Marwan bin al-Hakam. Isma'il also stated decisively (Ibn 'Asakir 10/45) that he himself did not hear these verses from al-Sha'bi. There is disagreement from al-Sha'bi over which event Khuraym bin Fatik and his brother witnessed: some narrations mention "Badr" and others "al-Hudaybiyah". Al-Waqidi declared the mention of "Badr" an error, but Imam al-Bukhari, Abu Hatim, Ibn Mandah and Ibn al-Sakan relied on it to establish that they were present at Badr, as Ibn 'Asakir (16/347) and Ibn al-'Adim in "Bughyat al-Talab" (7/3235) reported from them. However, Ibn 'Asakir (16/351) said that the mention of "al-Hudaybiyah" is correct.

Reference / Source: Imam al-Bayhaqi narrated it in "al-Sunan al-Kubra" (8/193) through Imam Abu 'Abdullah al-Hakim with this same chain.
وأخرجه محمد بن يحيى بن أبي عمر العدني في "مسنده" كما في "المطالب العالية" للحافظ (2864)، والبلاذري في "أنساب الأشراف" 6/ 267 - 268 و 11/ 196، والطبراني في "الكبير" (851) و (852)، والدارقطني في "المؤتلف والمختلف" 2/ 852 - 853، وأبو نعيم في "معرفة الصحابة" (2515)، وأبو عمرو الداني في "السنن الواردة في الفتن" (104)، وابن عبد البر في "الاستيعاب" ص 61، وأبو القاسم الأصبهاني في "الترغيب والترهيب" (2337)، وابن عساكر في "تاريخ دمشق" 10/ 43 و 44، وابن العديم في "بغية الطلب" 7/ 3234. والمزي في "تهذيب الكمال" في ترجمة أيمن بن خريم 3/ 445 من طرق عن إسماعيل بن أبي خالد، عن عامر الشعبي وحده، به. وبعضهم يقول في روايته: عن أيمن بن خُريم قال: دعاني مروان، وبعضهم يذكر عبد الملك بن مروان بدل أبيه مروان بن الحكم، وذلك وهم، كما جزم به ابنُ عساكر، وبيان ذلك أنَّ هذه الواقعة إنما كانت بمَرْج راهِط كما وقع مصرَّحًا به في بعض طرقه، وذلك سنة (65) هجرية، حيث استقام الأمر لمروان بن الحكم بالشام بعد هزيمته للضحّاك بن قيس، فالأليق أن يكون الذي دعا أيمن هو مروان. وقد يكون عبد الملك قال ذلك له أيضًا، إذ كان بصحبة أبيه. وذكر أبو القاسم الأصبهاني في روايته الحديبية بدل بدر.
Reference / Source: It was narrated by Muhammad bin Yahya bin Abi 'Umar al-'Adani in his "Musnad" (al-Matalib al-'Aliyah: 2864), al-Baladhuri in "Ansab al-Ashraf" (6/267-268 and 11/196), al-Tabarani in "al-Mu'jam al-Kabir" (851, 852), al-Daraqutni in "al-Mu'talif wa al-Mukhtalif" (2/852-853), Abu Nu'aym in "Ma'rifat al-Sahabah" (2515), Abu 'Amr al-Dani in "al-Sunan al-Waridah fi al-Fitan" (104), Ibn 'Abd al-Barr in "al-Isti'ab" (p. 61), Abu al-Qasim al-Asbahani in "al-Targhib wa al-Tarhib" (2337), Ibn 'Asakir in "Tarikh Dimashq" (10/43 and 44), Ibn al-'Adim in "Bughyat al-Talab" (7/3234) and al-Mizzi in "Tahdhib al-Kamal" (3/445) through routes from Isma'il bin Abi Khalid from 'Amir al-Sha'bi alone.
Technical note / Defect ('illah): Some say in their narration "from Ayman bin Khuraym, who said: Marwan called me", and some mention "'Abd al-Malik bin Marwan" in place of his father Marwan bin al-Hakam, which is an error (wahm), as Ibn 'Asakir stated decisively.
Important point: This incident took place at "Marj Rahit", as stated explicitly in some of its routes, in the year 65 AH, when Marwan bin al-Hakam consolidated his rule in Syria after defeating al-Dahhak bin Qays; so it is more fitting that the one who called Ayman was Marwan. 'Abd al-Malik may also have said it to him, since he was accompanying his father. Abu al-Qasim al-Asbahani's narration mentions "al-Hudaybiyah" instead of "Badr".
وأخرجه ابن الأعرابي في "معجمه" (1773)، وأبو يعلى (947)، وأبو عمرو الداني (105)، وابن عساكر 10/ 43 و 44 و 46، وابن الأثير في "أسد الغابة" 1/ 188 - 189 من طريق مطرِّف بن طريف، عن الشعبي: أنَّ عبد الملك بن مروان قال لخريم بن فاتك أو ابنه. إلّا أبو يعلى فقال في روايته: لما قاتل مروان الضحاك بن قيس أرسل إلى أيمن بن خُريم. وهذا هو الصحيح الموافق ¤ ¤ لرواية إسماعيل بن أبي خالد عن الشعبي. وكلهم ذكر في روايته الحديبية بدل بدر، إلّا أبا يعلى ومن طريقه ابن الأثير، فذكر بدرًا.
Reference / Source: Ibn al-A'rabi narrated it in his "Mu'jam" (1773), Abu Ya'la (947), Abu 'Amr al-Dani (105), Ibn 'Asakir (10/43, 44 and 46) and Ibn al-Athir in "Usd al-Ghabah" (1/188-189) via Mutarrif bin Tarif from al-Sha'bi, that 'Abd al-Malik bin Marwan said it to Khuraym bin Fatik or his son.
Grading: The narration of Abu Ya'la, which mentions Marwan's fighting al-Dahhak bin Qays and his sending for Ayman bin Khuraym, is the correct one and agrees with the narration of Isma'il bin Abi Khalid.
Note / Clarification: All of them mentioned "al-Hudaybiyah", except Abu Ya'la and, via him, Ibn al-Athir, who mentioned "Badr".
