Mustadrak al-Hakim — Hadith 2656

حدثنا أبو العباس محمد بن يعقوب، حدثنا العباس بن محمد الدُّوري، حدثنا رَوْح بن عُبادة وعبد الوهاب الخَفَّاف، قالا: حدثنا سعيد بن أبي عَرُوبة. وأخبرنا أحمد بن جعفر القَطِيعي، حدثنا عبد الله بن أحمد بن حنبل، حدثني أبي، حدثنا يحيى عن سعيد، عن قَتَادة، عن الحسن، عن قيس بن عُبَاد، قال: دخلتُ أنا والأشْتَرُ على عليّ بن أبي طالب يومَ الجَمَل، فقلت: هل عَهِد إليك رسولُ الله ﷺ عهدًا دون العامّة؟ فقال: لا، إلّا هذا، وأخرج من قِرابِ سيفه، فإذا فيها: "المؤمنون تَكَافأُ دماؤُهم، يَسعى بذِمَّتِهم أدناهُم، وهم يدٌ على مَن سِواهم، لا يُقتَلُ مؤمنٌ بكافر، ولا ذو عَهْدٍ في عَهْدِه" (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه (1). وله شاهد عن أبي هريرة وعمرو بن العاص، أما حديث أبي هريرة:

It is narrated from Qays bin Ubad (may Allah be pleased with him): Al-Ashtar (al-Nakha'i) and I went to Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) on the day of the Battle of the Camel, and I asked: Did the Messenger of Allah (peace and blessings be upon him) entrust you with any special instruction, apart from the people in general? He said: No, except for this writing. And he took out a scroll from the sheath of his sword, in which was written: "The blood of all the believers is equal (in retaliation); even the lowest of them may grant protection (to someone) and it is binding on behalf of all; they are as one hand (united) against their enemies; no believer shall be killed in retaliation for a disbeliever, nor shall one under a covenant (a dhimmi) be killed while his covenant stands."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

Grading: Its chain is sahih.
Technical note: Yahya refers to Ibn Sa'id al-Qattan, Sa'id to Ibn Abi 'Arubah, al-Hasan to al-Hasan al-Basri, and "al-Ashtar" to the well-known Tabi'i Malik bin al-Harith al-Nakha'i.
وهو في "مسند أحمد" (2/ 993)، وعنه أخرجه أبو داود (4530).
Reference / Source: It is in Musnad Ahmad (2/ 993), and Abu Dawud (4530) narrated it from there.
وأخرجه أبو داود (4530) عن مُسدَّد بن مُسَرْهَد، والنسائي (6910) و (8629) عن محمد بن المثنَّى، كلاهما عن يحيى بن سعيد، بهذا الإسناد.
Reference / Source: Abu Dawud (4530) narrated it from Musaddad bin Musarhad and al-Nasa'i (6910, 8629) from Muhammad bin al-Muthanna, both via Yahya bin Sa'id, with this same chain.
وأخرجه النسائي (6922) و (8628) من طريق أبي حسان الأعرج، عن الأشتر النخعي، عن علي بن أبي طالب.
Reference / Source: Imam al-Nasa'i narrated it with the chain of Abu Hassan al-A'raj from al-Ashtar al-Nakha'i from 'Ali bin Abi Talib.
وأخرجه أحمد (959) و (991)، والنسائي (6911) و (6921) من طريق أبي حسان الأعرج، عن علي. دون ذكر الأشتر، والصحيح ذكره.
Technical note: Imam Ahmad and al-Nasa'i also narrated it by way of Abu Hassan al-A'raj without mentioning "al-Ashtar", but the correct view is that al-Ashtar should be mentioned in the chain.
وأخرج أحمد (599)، والبخاري (111)، وابن ماجه (2658)، والترمذي (1412)، والنسائي (6920) من طريق أبي جُحيفة، عن علي، وذَكَر الصحيفة، قال: فيها العَقْل، وفكاك الأسير، ولا يُقتل مسلم بكافر. قلنا: العَقْل: يعني الدية.
Details of the narration: Al-Bukhari (111), Ahmad, Ibn Majah, al-Tirmidhi and al-Nasa'i narrated it with the chain of Abu Juhayfah from 'Ali, in which that "sahifah" (written document) is mentioned; he (may Allah be pleased with him) said: "It contains the rulings on blood money ('aql), the ransoming of captives, and that a Muslim is not to be killed for a disbeliever".
وأخرج أحمد (615)، والبخاري (1870) و (3179)، ومسلم (1370) و (1508) (20)، وأبو داود (2034)، والترمذي (2127)، وابن حبان (3716) من طريق يزيد بن شريك التيمي، عن علي، وذكر الصحيفة وذكر فيها أشياء ليست في حديثنا، وقال فيها: "وذمة المسلمين واحدة، يسعى بها أدناهم، فمن أخفر مسلمًا فعليهِ لعنةُ الله والملائكة والناس أجمعين، لا يُقبل منه صرف ولا عَدْل"، ولم يذكر تكافؤ الدماء ولا قتل المؤمن وذي العهد.
Details of the narration: Al-Bukhari (1870, 3179), Muslim (1370) and others narrated it with the chain of Yazid bin Sharik al-Taymi from 'Ali, and it has further words: "The protection (dhimmah) of all Muslims is one; even the least of them may undertake it. Whoever breaks the covenant given by a Muslim, upon him is the curse of Allah, the angels and all people".
وقِراب السيف: جَفْنُه، وهو وعاء يكون فيه السيف بغِمْده وحمالَته.
Linguistic explanation: "Qirab al-sayf" is the larger sheath or bag in which the sword is kept together with its actual scabbard and strap.
وقوله: "تَكَافأُ دماؤهم"، أي: تتساوى في القصاص والديات.
Linguistic explanation: "Takafu' al-dima'" means that the blood of all Muslims is equal in retaliation (qisas) and blood money.
وقوله: "يسعى بذِمّتهم أدناهم"، أي: إذا أعطى أحد الجيش العدوّ أمانًا جاز ذلك على المسلمين، وليس لهم أن يُخفِروه، ولا أن ينقضوا عهدَه.
Juristic principle: It means that if even an ordinary soldier of the army grants protection to the enemy, it is binding on all the Muslims; it is not permissible for them to break that covenant.
وقوله: "وهم يدٌ على من سِواهم" أي: إذا استُنفِروا رجب عليهم النَّفير، وإن استُنجِدوا أنجَدُوا، ولم يتخلَّفوا ولم يتخاذلوا. ¤ ¤ وقوله: "لا يُقتل مؤمن بكافر" يدخل فيه كل كافر له عهد وذمة، أو لا عهد له ولا ذمّة.
Juristic principle: "Yadun 'ala man siwahum" means that the Muslims are one hand (united) against others; when they are called out, all will go forth. "A believer is not to be killed for a disbeliever" includes every disbeliever, whether he has a covenant (dhimmah) with the Muslims or not.
وقوله: "ولا ذو عهد في عهده" أي: لا يقتل معاهَدٌ ما دام في عهده.
Juristic principle: It means that a mu'ahad (one with whom there is a peace covenant) is also not to be killed as long as he abides by his covenant.
