Mustadrak al-Hakim — Hadith 2637

حدَّثَناه أبو أحمد محمد بن محمد بن أحمد بن إسحاق العَدْل الصفّار، حدثنا أحمد بن محمد بن نصر، حدثنا عمرو بن طلحة القَنَّاد، حدثنا أسباطُ بن نَصْر، عن سِماك بن حرب، عن ثَعلَبة بن الحَكَم عن ابن عباس، قال: انتَهَبَ الناسُ غنَمًا يومَ خيبر (1) فذَبَحُوها فجعلوا يَطبُخون منها، فجاء رسولُ الله ﷺ، فأمر بالقُدُور فأُكفِئت، وقال: "إنه لا تَصلُحُ النُّهْبةُ" (1).
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that he said: On the day of Khaybar the people plundered some goats, then slaughtered them and began to cook their meat. Then the Messenger of Allah (peace and blessings be upon him) came and gave an order about the pots, so they were overturned, and he (peace and blessings be upon him) said: "Indeed, plunder (plundered goods) is not proper."

(1) كذا جاء في النسخ الخطية، وصحَّح عليها في (ز)، وكتب في الهامش مقابلها كلمة "حنين"، وضبَّب فوقها، وكأنه أشار إلى أنه وقع في بعض الروايات عن أسباط ذكرُ حنين، وأنه غير مستقيم. ¤ ¤ قلنا: كذلك وقعت رواية أسباط للبخاري كما في "تاريخه الكبير" 2/ 173، وكذلك وقعت لابن أبي خيثمة في "تاريخه الكبير" (318)، وجزم البخاري بأنَّ من قال: يوم خيبر، فقوله أصح. لكن وقع في "العلل" لابن أبي حاتم (2222) في رواية أسباط ذكر خيبر لا حنين، وهذا يوافق ما وقع في النسخ الخطية عندنا، فالظاهر أنَّ ذكر حنين وقع في بعض الروايات عن أسباط دون بعضٍ، والله أعلم.
Technical note / Defect ('illah): It has come this way (Khaybar) in the handwritten manuscripts; however, in manuscript (Z) it has been marked as correct, and in the margin opposite it the word "Hunayn" has been written with a mark placed over it, as if indicating that in some narrations from "Asbat" Hunayn is mentioned, which is not sound (incorrect).
Important point: The narration of Asbat also occurs this way in Imam al-Bukhari's "al-Tarikh al-Kabir" (2/ 173) and in Ibn Abi Khaythamah (318), and Imam al-Bukhari stated decisively that whoever said "the day of Khaybar", his statement is more correct. However, in Ibn Abi Hatim's "al-'Ilal" (2222) the narration of Asbat mentions "Khaybar", not "Hunayn", which agrees with our manuscripts. What appears is that some narrators from Asbat narrated "Hunayn" and others "Khaybar". And Allah knows best.

Grading: This hadith is "sahih li-ghayrihi", and like the previous chain this chain too is "hasan", but the mention of Ibn 'Abbas (may Allah be pleased with them both) in it is "ghayr mahfuz" (not established), as has preceded.
وأخرجه ابن أبي خيثمة في السفر الثاني من "التاريخ الكبير" (318)، والطبراني في "الكبير" (10639) من طرق عن عمرو بن حماد بن طلحة القَنَّاد، بهذا الإسناد.
Reference / Source: Ibn Abi Khaythamah narrated it in "al-Tarikh al-Kabir" (318) and al-Tabarani in "al-Mu'jam al-Kabir" (10639) through various routes from 'Amr bin Hammad bin Talhah al-Qannad, with this same chain.
