Mustadrak al-Hakim — Hadith 2635

حدثنا علي بن حَمْشاذَ العَدْل، حدثنا محمد بن غالب ومحمد بن شاذان الجوهري، قالا: حدثنا زكريا بن عَدِي، حدثنا عُبيد الله بن عمرو الرَّقِّي، عن زيد بن أبي أُنيسة، حدثنا قيس بن مسلم، عن عبد الرحمن بن أبي ليلى، عن أبيه، قال: شهدتُ فتحَ خيبرَ مع رسول الله ﷺ، فلما انهزم القومُ وَقَعْنا في رِحالِهم، فأخذ الناسُ ما وجَدُوا من جُزُرٍ - قال زيد: وهي المواشي - فلم يكن بأسرعَ مِن أن فارَتِ القُدُور، فلما رأى ذلك رسولُ الله ﷺ أمر بالقُدُور فأُكفئت، ثم قَسَم بيننا، فجعل لكلِّ عشرةٍ شاةً (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

Abd al-Rahman bin Abi Layla narrates from his father: I was present with the Messenger of Allah (peace and blessings be upon him) at the conquest of Khaybar. When the enemy was defeated, we entered their encampments, and the people seized the livestock (sheep and goats) they found there. Only a short while had passed when the cooking pots began to boil (with meat). When the Messenger of Allah (peace and blessings be upon him) saw this, he (peace and blessings be upon him) ordered the pots to be overturned (so that no one would eat before the proper distribution). Then he (peace and blessings be upon him) distributed among us and allotted one goat for every ten men.
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده صحيح، وقد اختُلف فيه على عُبيد الله بن عمرو الرَّقِّي في تعيين شيخ زيد بن أبي أنيسة، فوقع في روايته زكريا بن عدي أنه قيس بن مسلم - وهو الجَدَلي - وخالفه عبد الله بن جعفر الرقي، فذكر أنه الحكم بن عُتيبة، والقول فيه قول زكريا، فقد تابعه يزيد بن عبد الرحمن ¤ ¤ الدالاني عن زيد بن أبي أُنيسة، فقال: عن قيس بن مسلم، وكذلك رواه غيلان بن جامع عن قيس بن مسلم، فالحديث حديث قيس، كما جزم به الدارمي في "مسنده" بإثر (2513)، وابن أبي خيثمة في السفر الثالث من "تاريخه الكبير" بإثر (4587).
Grading: Its chain is sahih.
Technical note / Defect ('illah): There was a disagreement over 'Ubayd Allah bin 'Amr al-Raqqi regarding the name of the shaykh; Zakariyya bin 'Adi said "Qays bin Muslim", while 'Abd Allah bin Ja'far al-Raqqi said "al-Hakam bin 'Utaybah". The correct view is that of Zakariyya, because Yazid bin 'Abd al-Rahman al-Dalani and Ghaylan bin Jami' also narrated "Qays bin Muslim", in support of him. Imam al-Darimi and Ibn Abi Khaythamah also held this to be correct.
وأخرجه أحمد (31/ 19058) عن زكريا بن عدي، بهذا الإسناد.
Reference / Source: Imam Ahmad narrated it at (31/ 19058) via Zakariyya bin 'Adi with this same chain.
وخالفه عبد الله بن جعفر الرَّقِّي عند الدارمي (2512)، وابن أبي خيثمة في السفر الثالث من "تاريخه" (4586)، فرواه عن عبيد الله بن عمرو الرقي، عن زيد بن أبي أُنيسة، عن الحكم بن عتيبة، عن عبد الرحمن بن أبي ليلى. فذكر الحكم بدل قيس بن مسلم الجدلي.
Technical note / Defect ('illah): 'Abd Allah bin Ja'far al-Raqqi contradicted Zakariyya with al-Darimi (2512) and Ibn Abi Khaythamah (4586) and gave the shaykh's name as "al-Hakam bin 'Utaybah" (instead of Qays bin Muslim al-Jadali).
لكن تابع زكريا بنَ عدي أبو خالد يزيد الدالاني فرواه عن زيد بن أبي أُنيسة عن قيس بن مسلم، أخرجه من هذه الطريق ابنُ أبي خيثمة في السفر الثالث من "تاريخه" (4587)، والطبراني في "الأوسط" (505).
Corroborating chains and supporting reports: Zakariyya bin 'Adi was supported by Abu Khalid Yazid al-Dalani, who also narrated it from Zayd bin Abi Unaysah from Qays bin Muslim. Ibn Abi Khaythamah (4587) and al-Tabarani in "al-Awsat" (505) narrated it.
وكذلك رواه غيلان بن جامع عن قيس بن مسلم أبي يعلى في "مسنده الكبير" كما في "إتحاف الخيرة" للبوصيري (4502/ 2)، والطبراني في "الكبير" (6426)، والبيهقي في "السنن" 9/ 197.
Corroborating chains and supporting reports: Likewise, Ghaylan bin Jami' also narrated it from Qays bin Muslim, as transmitted by Abu Ya'la in his Musnad, by al-Tabarani in "al-Kabir" (6426) and by al-Bayhaqi in "al-Sunan" (9/ 197).
