Mustadrak al-Hakim — Hadith 2631

حدثنا أبو بكر محمد بن أحمد بن بالَوَيهِ، حدثنا الحسن بن شَبيب المَعْمَري، حدثنا عبد الله بن أحمد بن ذَكْوان ومحمود بن خالد الدمشقيان، قالا: حدثنا مروان بن محمد الدمشقي، حدثنا يحيى بن حمزة، قال: سمعت أبا وهبْ يقول: سمعت مكحولًا يقول: كنتُ عبدًا بمصر لامرأة من هُذَيل، فأعتقتْني، فما خرجتُ من مصر وبها عِلمٌ إِلَّا حَوَيتُ عليه فيما أُرى، ثم أتيتُ الشامَ فغربَلْتُها، كلَّ ذلك أسألُ عن النَّفَل فلم أجد أحدًا يخبرُني فيه بشيءٍ، حتى لقيتُ شيخًا يقال له: زياد بن جارية التَّمِيمي، فقلت له: هل سمعتَ في النَّفَل شيئًا؟ فقال: نعم، سمعت حبيبَ بن مَسْلَمة الفِهْري يقول: شهدتُ رسولَ الله ﷺ نَفَّل الربعَ في البَدْأة، والثلُثَ في الرَّجْعة (1).

Imam Makhul (may Allah have mercy on him) says: I was a slave in Egypt belonging to a woman of the tribe of Hudhayl, and she set me free. When I left Egypt, I had absorbed all the knowledge (of hadith) that was there. Then I came to Syria and sifted through its knowledge as well. Everywhere I asked about "nafl" (an extra reward from the spoils), but I found no one who could tell me anything, until I met an elder called Ziyad bin Jariyah al-Tamimi. I asked him: Have you heard anything about nafl? He said: Yes, I heard Habib bin Maslamah al-Fihri (may Allah be pleased with him) say: I was present with the Messenger of Allah (peace and blessings be upon him) when he (peace and blessings be upon him) gave a quarter (1/4) (of the spoils) as nafl at the start of an expedition and a third (1/3) on the return.

(1) إسناده صحيح. أبو وهب: هو عُبيد الله بن عُبيد الكَلاعي.
Grading: Its chain is sahih.
Technical note / Defect ('illah): "Abu Wahb" refers to 'Ubayd Allah bin 'Ubayd al-Kala'i.
وأخرجه أبو داود (2750) عن عبد الله بن أحمد بن بَشير بن ذكوان ومحمود بن خالد، بهذا الإسناد.
Reference / Source: Abu Dawud narrated it at (2750) via 'Abd Allah bin Ahmad bin Bashir bin Dhakwan and Mahmud bin Khalid with this same chain.
وأخرجه أحمد (29/ 17465)، وأبو داود (2749) من طريق العلاء بن الحارث، وابن ماجه (2853)، وابن حبان (4835) من طريق سليمان بن موسى الأشدق، كلاهما عن مكحول، به. بذكر المرفوع آخره، دون ذكر القصة، وسقط من إسناد ابن ماجه ذكر زياد بن جارية.
Reference / Source: Imam Ahmad (29/ 17465) and Abu Dawud (2749) narrated it by way of al-'Ala' bin al-Harith, and Ibn Majah (2853) and Ibn Hibban (4835) by way of Sulayman bin Musa al-Ashdaq, both via Makhul.
Details of the narration: These narrations mention the marfu' part (the saying of the Prophet (peace and blessings be upon him)) at the end but do not mention the story; also, the name "Ziyad bin Jariyah" has dropped out of Ibn Majah's chain.
وسيأتي بعده من طريق يزيد بن جابر، وبرقم (5563) من طريق ثابت بن ثوبان، وبرقم (5941) من طريق سعيد بن عبد العزيز، ثلاثتهم عن مكحول بذكر تنفيل الثلث فقط.
Details of the narration: This narration will come next by way of Yazid bin Jabir, at no. (5563) by way of Thabit bin Thawban, and at no. (5941) by way of Sa'id bin 'Abd al-'Aziz. All three narrators mention from Makhul only the giving of an extra third (tanfil al-thuluth).
