Mustadrak al-Hakim — Hadith 2630

أخبرني الأستاذ أبو الوليد، حدثنا أبو بكر بن أبي داود، حدثنا عبد الملك بن شعيب بن الليث، حدثني أبي، عن جدي، عن عُقيل، عن ابن شِهاب، عن سالم بن عبد الله بن عمر، عن عبد الله بن عمر: أنَّ رسول الله ﷺ قد كان يُنَفِّل بعضَ مَن يبعثُ مِن السرايا لأنفُسهم خاصّةً سوى قَسْمِ عامّة الجيش، والخُمس في ذلك واجبٌ كلُّه (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) would give some of the detachments (saraya) he sent out an extra share (nafl) specifically for themselves, in addition to the distribution to the army at large, and taking out the fifth (khums) from it was obligatory in any case.
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

Grading: Its chain is sahih.
Technical note / Defect ('illah): Here "al-Layth" refers to al-Layth bin Sa'd and "'Uqayl" refers to 'Uqayl bin Khalid al-Ayli.
وأخرجه مسلم (1750)، وأبو داود (2746) عن عبد الملك بن شعيب، بهذا الإسناد. فاستدراك الحاكم له ذهولٌ منه.
Reference / Source: Muslim (1750) and Abu Dawud (2746) narrated it via 'Abd al-Malik bin Shu'ayb with this same chain.
Technical note / Defect ('illah): Imam al-Hakim's making an istidrak of this hadith (bringing it in al-Mustadrak) is an oversight (dhuhul) on his part, because it is already in Sahih Muslim.
وأخرجه أحمد (10/ 6250) عن حجاج المِصِّيصي، والبخاري (3135) عن يحيى بن بكير، كلاهما عن الليث بن سعد، به. ولم يذكر البخاري في روايته الخمس.
Reference / Source: Imam Ahmad (10/ 6250) narrated it from Hajjaj al-Missisi and al-Bukhari (3135) from Yahya bin Bukayr, both via al-Layth bin Sa'd. However, Imam al-Bukhari did not mention the "khumus" (the fifth) in his narration.
وأخرجه بنحوه مسلم (1750) من طريق يونس بن يزيد الأيلي، عن ابن شهاب، به.
Reference / Source: Imam Muslim (1750) recorded a narration of similar meaning with the chain of Yunus bin Yazid al-Ayli from Ibn Shihab.
