Mustadrak al-Hakim — Hadith 2612

أخبرَناه أبو علي الحسين بن علي الحافظ، أخبرنا الحسين بن إدريس الأنصاري، حدثنا علي بن مسلم الطُّوسي، حدثنا مروان بن معاوية الفَزَاري، أخبرنا الحسن بن عمرو الفُقَيمي، حدّثنا مجاهد، عن جُنادة بن أبي أُميّة، عن عبد الله بن عمرو بن العاص، قال: قال رسول الله ﷺ: "مَن قَتَل قَتِيلًا من أهل الذِّمَّة، لم يَرَحْ رِيحَ الجنة، وإنَّ ريحَها لَتُوجدُ مِن كذا وكذا" (1). صحيح على شرط الشيخين، ولم يُخرجاه! وله شاهد من حديث أبي هريرة صحيح على شرط مسلم:

It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever kills a dhimmi (a non-Muslim citizen of the Islamic state) will not smell the fragrance of Paradise, although its fragrance can be perceived from such-and-such a distance."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) إسناده صحيح. وقد اختُلف فيه على الحسن بن عمرو الفُقيمي، فرواه عنه مروان بن معاوية الفزاري كما وقع عند المصنف هنا، وخالفه عبد الواحد بن زياد وعبد الرحمن بن مَغْراء وأبو معاوية الضرير، فرووه عن الحسن بن عمرو، عن مجاهد، عن عبد الله بن عمرو، دون ذكر جنادة بن أبي أمية في إسناده. وقد صوَّب الدارقطني في "التتبع" رواية مروان بن معاوية، لكن قال الحافظ ابن حجر في "فتح الباري" 9/ 499 ردًّا على الدارقطني: لكن سماع مجاهد من عبد الله بن عمرو ثابت، وليس هو بمدلّس، فيحتمل أن يكون مجاهد سمعه أولًا من جنادة، ثم لقي عبد الله بن عمرو، أو سمعاه معًا وثبَّته فيه جنادة، فحدّث به عن عبد الله بن عمرو تارة، وحدَّث به عن جنادة أُخرى.
Grading: Its chain is sahih.
Technical note / Defect ('illah): There is a disagreement over al-Hasan bin 'Amr al-Fuqaymi. Marwan bin Mu'awiyah (as here) mentioned the intermediary Junadah bin Abi Umayyah, whereas 'Abd al-Wahid, 'Abd al-Rahman and Abu Mu'awiyah did not mention Junadah. Imam al-Daraqutni held Marwan's narration to be correct, but according to al-Hafiz Ibn Hajar (Fath al-Bari: 9/ 499), since Mujahid's hearing from 'Abd Allah bin 'Amr is established and he is not a mudallis, it is possible that he first heard it from Junadah and then met 'Abd Allah bin 'Amr, or that they both heard it together and Junadah confirmed it for him, so he narrated it sometimes from 'Abd Allah bin 'Amr and at other times from Junadah.
وأخرجه أحمد (11/ 6745) عن إسماعيل بن محمد المعَقِّب، والنسائي (6926) و (8689) عن عبد الرحمن بن إبراهيم دُحيم، كلاهما عن مروان بن معاوية، بهذا الإسناد.
Reference / Source: Imam Ahmad (6745) and al-Nasa'i (6926) and (8689) narrated it via Marwan bin Mu'awiyah with this same chain.
وأخرجه البخاري (3166) و (6914) من طريق عبد الواحد بن زياد، وابن ماجه (2686) من طريق أبي معاوية الضرير، كلاهما عن الحسن بن عمرو، عن مجاهد، عن عبد الله بن عمرو. دون ذكر جنادة بن أبي أمية.
Reference / Source: Imam al-Bukhari (3166) and (6914) and Ibn Majah (2686) narrated it without mentioning Junadah bin Abi Umayyah.
وتابعهما عبد الرحمن بن مَغْراء عند البزار (2373).
Corroborating chains and supporting reports: With al-Bazzar (2373), 'Abd al-Rahman bin Maghra' also narrated it without Junadah, corroborating them.
وقوله: "لم يَرَحْ ريح الجنة" أي: لم يَشَمَّ ريحها، يقال: راح يَرَاح، وراح يَريح، وأراح يُراح.
Note / Clarification: The Prophet's words "lam yarah riha al-jannah" mean: "he will not even smell the fragrance of Paradise". Linguistically it is read as raha yarahu, raha yarihu and araha yurahu (all three ways).
وذكر الحافظ ابن حجر في "الفتح" 9/ 499 عن ابن التين قوله: الأول أجود، وعليه الأكثر.
Reference / Source: Al-Hafiz Ibn Hajar quoted in Fath al-Bari the statement of Ibn al-Tin that the first pronunciation (yarahu) is the best, and that most scholars follow it.
