Mustadrak al-Hakim — Hadith 2568

حدثنا أبو عبد الله محمد بن يعقوب الشَّيباني، حدثنا يحيى بن محمد ابن يحيى، حدثنا مُسدَّد، حدثنا حُصين بن نُمير، حدثنا سفيان بن حسين، عن الزُّهْري، عن سعيد بن المسيّبِ، عن أبي هريرة، قال: قال رسول الله ﷺ: "مَن أَدخل فرسًا بين فرسَين، ولا يأْمَنُ أن يَسبِقَ فليس بقِمارٍ، ومن أدخلَ فرسًا بين فرسَين، وقد أَمِنَ أن يَسبِقَ فهو قِمارٌ" (1). تابعه سعيد بن بَشير الدمشقي عن الزُّهْري، وأقامَ إسناده:
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever enters a (third) horse between two horses (for a race), not being sure that it will win (that is, the outcome is not fixed beforehand), then it is not gambling. But whoever enters a horse between two horses about which he is certain that it will (surely) win, then that is gambling."

(1) إسناده ضعيف، سفيان بن حسين - وإن كان ثقة - ضعيف في الزُّهْري، وقد تابعه سعيد بن بشير الدمشقي كما سيأتي عند المصنف بعده، لكنه ضعيف الحديث، وخالفهما الثقات من أصحاب الزُّهْري كمعمر بن راشد وشعيب بن أبي حمزة وعُقيل بن خالد فيما ذكره أبو داود بإثر (2580)، فرووه عن الزُّهْري عن رجال من أهل العلم.
Grading: Its chain is weak.
Technical note / Defect ('illah): Although Sufyan bin Husayn is thiqah (trustworthy), his narration from Imam al-Zuhri is weak. Sa'id bin Bashir al-Dimashqi corroborated him, but he himself is weak in hadith. The trustworthy students of Imam al-Zuhri (Ma'mar, Shu'ayb, Uqayl) contradicted them (as Imam Abu Dawud mentioned after 2580).
وأخرجه أبو داود (2579) عن مُسدَّد، بهذا الإسناد.

وأخرجه أحمد 16 / (10557)، وابن ماجه (2876) من طريق يزيد بن هارون، وأبو داود (2579) من طريق عباد بن العوّام، كلاهما عن سفيان بن حسين، به.
Reference / Source: Imam Ahmad (16/ 10557), Ibn Majah (2876) and Abu Dawud (2579) narrated it via Sufyan bin Husayn.
وأحسن أحواله أن يكون من قول سعيد بن المسيب كما بيّنا في تعليقنا على "مسند أحمد" و "سنن أبي داود".
Important point: The best that can be said of this narration is that it is (not a saying of the Prophet (peace and blessings be upon him) but) Sa'id bin al-Musayyab's own saying, as we have made clear in our notes on "Musnad Ahmad" and "Sunan Abi Dawud".
قوله: "أن يَسبِق" الضمير فيه عائد إلى الفرس المُحلِّل الذي هو ثالث الفرسين، والمعنى أنه لا يحوز أن يُدخل بين الفرسين فرسٌ بطيء يؤمن منه أن يسبق، بل لا بد أن يكون كفئًا للفرسين، بحيث يُخاف أن يسبق هو ذينك الفرسين، أفاد ذلك الخطابي في "المعالم 2/ 255.
Note / Clarification: In the words of the hadith "an yasbiqa", the pronoun refers to the "faras muhallil" (the third horse). The meaning is that it is not permissible to include in the race a slow horse about which it is certain that it cannot win; rather it must be a match for both horses, so that there is a fear/possibility of it winning as well.
