Mustadrak al-Hakim — Hadith 2530

أخبرني عبد الله بن محمد بن موسى، حدثنا محمد بن أيوب، حدثنا إبراهيم بن موسى ويحيى بن المغيرة، قالا حدثنا جَرير عن عطاء بن السائب، عن سعيد بن جُبير، عن ابن عباس قال: لمّا أنزل الله ﷿ ﴿وَلَا تَقْرَبُوا مَالَ الْيَتِيمِ إِلَّا بِالَّتِي هِيَ أَحْسَنُ﴾ [الأنعام: 152]، ﴿إِنَّ الَّذِينَ يَأْكُلُونَ أَمْوَالَ الْيَتَامَى ظُلْمًا﴾ إلى قوله: ﴿سَعِيرًا﴾ [النساء: 9]، قال: انطَلَق مَن كان عندَه يتيمٌ فعَزَلَ طعامَه من طعامِه، وشَرابَه من شرابِه، يَفصِلُ الشيءَ من طعامه فيُحبَس له حتى يأكُلَه، أو يَفْسُدَ فيُرمَى به، فاشتدَّ ذلك عليهم، فذَكَروا ذلك لرسولِ الله ﷺ، فأنزل الله ﷿: ﴿وَيَسْأَلُونَكَ عَنِ الْيَتَامَى قُلْ إِصْلَاحٌ لَهُمْ خَيْرٌ وَإِنْ تُخَالِطُوهُمْ فَإِخْوَانُكُمْ﴾ إلى ﴿عَزِيزٌ حَكِيمٌ﴾ [البقرة:220]، فخَلَطُوا طعامَهم بطعامِهم، وشرابَهم بشرابِهم (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه، وإنما خرَّجه أئمتنا في الرُّخصة في المُناهَدة (2) في الغزو. وشاهدُه المفسَّر حديثُ وحشيّ بن حَرْب:

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that when Allah, the Mighty and Majestic, revealed these verses: "And do not approach the property of the orphan except in the way that is best" [Surah al-An'am: 152] and "Indeed, those who devour the property of orphans unjustly (only fill their bellies with fire)" [Surah al-Nisa: 10], whoever had an orphan in his care separated the orphan's food completely from his own food and the orphan's drink from his own drink. They would set aside some of the orphan's food, and it would remain there until he ate it, or it spoiled and was thrown away. This situation became very hard on them (the Companions), so they mentioned it to the Messenger of Allah (peace and blessings be upon him), whereupon Allah, the Mighty and Majestic, revealed this verse: "And they ask you about orphans. Say: Improving (their affairs) for them is best, and if you mix with them, they are your brothers" [Surah al-Baqarah: 220]. After that, they mixed their food and drink with theirs.
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it. Our Imams have cited it as evidence for the permission of al-munahadah, that is, sharing expenses jointly during a military expedition.

(1) حديث حسن، وهذا إسناد رجاله ثقات، لكن عطاء بن السائب اختلط، وجرير -وهو ابن عبد الحميد- ممّن سمع منه بعد اختلاطه، وقد تابعه جماعة لم يتميز سماع أحدهم من عطاء بن السائب، أكان قبل الاختلاط أم بعده وخالفهم حماد بن سلمة، وهو ممّن جزم غيرُ واحدٍ من الأئمة بسماعه من عطاء قبل اختلاطه، فرواه عن عطاء بن السائب عن سعيد بن جبير من قوله لم يذكر فيه ابن عباس، وتابعه على ذلك عمرو بن أبي قيس الرازي عن عطاء، وكذلك رواه سالم الأفطس عن سعيد بن جبير من قوله، فهذا أشبه والله أعلم، على أنه روي عن ابن عباس من وجه آخر حسن في المتابعات، كما سيأتي بيانه.
Grading: The hadith is hasan and its narrators are thiqah.
Technical note / Defect ('illah): Ata' bin al-Sa'ib suffered from ikhtilat (deterioration of memory) at the end of his life. Jarir heard from him after the ikhtilat, whereas Hammad bin Salamah heard from him before it. In Hammad bin Salamah's narration Ibn Abbas is not mentioned; rather it is Sa'id bin Jubayr's own statement (maqtu'), which is the more likely. However, on the basis of other supporting evidence, it has been judged hasan from Ibn Abbas.
وأخرجه أبو داود (2871) عن عثمان بن أبي شيبة، عن جرير بن عبد الحميد، بهذا الإسناد.
Reference / Source: Abu Dawud (2871) narrated it through Uthman bin Abi Shaybah from Jarir bin Abd al-Hamid.
وأخرجه النسائي (6463) من طريق أبي كُدينة يحيى بن المهلّب، و (6464) من طريق عمران ابن عُيينة، كلاهما عن عطاء بن السائب به.
Reference / Source: Al-Nasa'i narrated it through Yahya bin al-Muhallab (6463) and Imran bin Uyaynah (6464) from Ata' bin al-Sa'ib.
وسيأتي من طريق جرير برقم (3223) و (3278)، ومن طريق إسرائيل عن عطاء برقم (3140). وخالفهم حماد بن سلمة عند ابن المنذر في "تفسيره" (1431) فرواه عن عطاء بن السائب عن سعيد بن جبير مقطوعًا من قوله.
Reference / Source: It will come later through Jarir and Isra'il. Hammad bin Salamah narrated it as Sa'id bin Jubayr's own statement (maqtu'), as in Ibn al-Mundhir's "Tafsir" (1431).
ووافقه سالم الأفطس عند أبي حذيفة النهدي في "تفسير سفيان الثَّوري" (203)، فرواه عن سعيد بن جبير من قوله كذلك.
Corroborating chains and supporting reports: Salim al-Aftas also gave it as Sa'id bin Jubayr's own statement, in "Tafsir Sufyan al-Thawri" (203).
وقد روي عن ابن عباس من وجه آخر عند أبي عبيد القاسم في "الناسخ والمنسوخ" (437)، والطبري 2/ 371، والطبراني في "الكبير" (13020) من طريق عبد الله بن صالح، عن معاوية بن صالح، عن علي بن أبي طلحة، عن ابن عباس. قال ابن حجر في "الأمالي المطلقة" ص 62: قالوا: لم يسمع علي بن أبي طلحة من ابن عباس، وإنما أخذ التفسير عن مجاهد وسعيد بن جبير عنه.
Reference / Source: This narration is reported from Ibn Abbas through another chain (Ali bin Abi Talhah) by Abu Ubayd, al-Tabari and al-Tabarani (13020). According to al-Hafiz Ibn Hajar, Ali bin Abi Talhah did not hear directly from Ibn Abbas, but took the tafsir through Mujahid and Sa'id bin Jubayr.
قلت (القائل ابن حجر) بعد أن عُرفت الواسطة، وهي معروفة بالثقة، حصل الوثوق به، وقد اعتدَّ البخاري في أكثر ما يجزم به معلَّقًا عن ابن عباس في التفسير على نسخة معاوية بن صالح عن علي بن أبي طلحة. هذا قلنا: وعبد الله بن صالح حسن الحديث في المتابعات والشواهد.
Technical note / Defect ('illah): Al-Hafiz Ibn Hajar says that when the intermediary is known and he is thiqah, the narration becomes reliable. Al-Bukhari too, in his "Sahih", relies on this same copy (Mu'awiyah bin Salih from Ali bin Abi Talhah) in the tafsir reports he cites from Ibn Abbas without a chain (ta'liq). Abdullah bin Salih is hasan in hadith in corroborating narrations.

(2) المُناهَدة: المُناهضة، بأن يُنهَض لقتال العدوّ، والصمود له.
Note / Clarification: "Al-munahadah" means rising up to face the enemy and standing firm in battle.
