Mustadrak al-Hakim — Hadith 2406

حدثني أبو الحسن علي بن عمر الحافظ، حدثنا أبو بكر عبد الله بن محمد بن زياد الفقيه النَّيسابوري، حدثنا محمد بن يحيى الذُّهْلي وأحمد بن منصور الرَّمادي وعلي بن حرب الموصلي، قالوا: حدثنا محمد بن عُبيد، حدثنا عُبيد الله بن عُمر، عن عمرو بن شُعيب، عن أبيه: أنَّ رجلًا أتى عبد الله بن عمرو يسأله عن مُحْرمٍ وقعَ بامرأةٍ، فأشار إلى عبد الله بن عمر، فقال: اذهب إلى ذاك، فاسأله، قال شُعيبٌ: فلم يَعرفْه الرجلُ، فذهبتُ معه، فسألَ ابنَ عمر فقال: بَطَلَ حَجُّك، فقال الرجلُ: ما أصنعُ؟ قال: أَحرِمْ مع الناس واصنَعْ ما يصنعون، فإذا أدركتَ قابلًا، فحُجَّ وأَهْدِ، فرجَع إلى عبد الله بن عَمرو وأنا معه، فقال: اذهبْ إلى ابن عباس فسَلْه، قال شُعيبٌ: فذهبتُ معه إلى ابن عباس فسأله، فقال له كما قال ابنُ عمر، فرجع إلى عبد الله بن عمرو وأنا معه، فأخبره بما قال ابنُ عباس، ثم قال: ما تقولُ أنت؟ فقال: قَولي مثلُ ما قالا (1).
هذا حديث ثقاتٌ رواتُه حفاظٌ، وهو كالآخِذِ باليد في صحة سماع شعيب بن محمد من جده عبد الله بن عمرو. هذا آخر ما أدّى إليه اجتهادي من الزيادة في كتاب البيوع على ما خرَّجه الإمامان أبو عبد الله البخاري وأبو الحسين القُشَيري ﵄. وقد ذكرتُ في ضمن هذا الكتاب كتبًا قد ترجمها البخاريُّ في آخرِ كتابِ البيوعِ؛ فمنها كتابُ السَّلَم، وكتاب الشُّفعة، وكتاب الإجارة، وكتاب الحَوَالة، وكتاب الحَرْث، وكتاب المُزارَعة، وكتاب المُساقاة، وكتاب العطايا، وكتاب الهِبات، وكتاب القِراض، وكتاب اللُّقَطة، وكتاب المَظالم، وكتاب التعفُّف عن المسألة، وكتاب الرهن، وكتاب الشَّرِكة، وكتاب العِتْق، وكتاب المُكاتَب، وكتاب الشهادات، وكتاب الصُّلح، وكتاب الشروط، وكتاب الوصايا، وكتاب الوقف، وإنما شرحتُها في آخر هذا الكتاب لئلّا يَتوهَّم مُتَوهِّمٌ أني أخلَيتُ كتابَ البُيوع عن هذه الكتب، والله المُعين على ما أُؤمِّله مِن تتبع آثار الإمامَين ﵄، وهو حسبي ونِعْم الوكيلُ. It is narrated from Amr bin Shu'ayb, from his father, that a man came to Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) and asked him about a muhrim (a person in ihram) who had intercourse with his wife. He pointed to Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) and said: "Go to him and ask him." Shu'ayb said: The man did not recognise him, so I went with him. He asked Ibn Umar (may Allah be pleased with them both), and he said: "Your Hajj is void." The man asked: "What should I do now?" He said: "Remain with the people (in ihram) and do the same rites that they are doing. Then, when the next year comes, perform Hajj and offer a sacrificial animal (hady)." The man returned to Sayyiduna Abdullah bin Amr (may Allah be pleased with them both), and I was with him, and he said: "Now go to Ibn Abbas (may Allah be pleased with them both) and ask him." Shu'ayb said: I went with him to Ibn Abbas (may Allah be pleased with them both), and he asked him, and he gave the same answer that Ibn Umar (may Allah be pleased with them both) had given. The man returned to Abdullah bin Amr (may Allah be pleased with them both), and I was with him, and he told him what Ibn Abbas (may Allah be pleased with them both) had said. Then he asked: "What do you say?" He said: "My view is the same as what the two of them said."
This is a hadith whose narrators are trustworthy (thiqah) and hafiz (masters of memorisation), and it is clear proof of the soundness of Shu'ayb bin Muhammad hearing from his grandfather Abdullah bin Amr. These were the last additional hadiths that my ijtihad reached in the Book of Sales, beyond those recorded by Imam Bukhari and Imam Muslim (may Allah have mercy on them both). I have explained them at the end of this book so that no one imagines that I left the Book of Sales empty of these books. And Allah alone is my helper in what I hope for, to be able to follow the traces of the two Shaykhs; He is sufficient for me, and the best disposer of affairs.

Grading: The chain is "hasan", and al-Bayhaqi and al-Mizzi authenticated it.
وأخرجه البيهقي في "السنن الكبرى" 5/ 167، وفي "معرفة السنن والآثار" (10342) عن أبي عبد الله الحاكم بهذا الإسناد.
