Mustadrak al-Hakim — Hadith 2405

حدثنا أبو بكر بن إسحاق وعلي بن حَمْشاذَ؛ قال عليّ: حدثنا بشر بن موسى، حدثنا الحُميدي، حدثنا سفيان، قال: سَمِعْناه من داود بن شابُور ويعقوب بن عطاء، عن عمرو بن شعيب، عن أبيه، عن جده عبد الله بن عمرو: أنَّ رسول الله ﷺ قال في كَنْز وجده رجلٌ، فقال: "إن كنتَ وجدْتَه في قريةٍ مسكونةٍ، أو في سبيلٍ مِيتاءٍ، فعَرِّفْه، وإن كنتَ وجدْتَه في خَرِبةٍ جاهليةٍ، أو في قريةٍ غير مسكونةٍ، أو غير سبيلٍ مِيتاءٍ، ففيه وفي الرِّكازِ الخُمسُ" (2). قد أكثرتُ في هذا الكتاب الحُجَجَ في تصحيح روايات عمرو بن شعيب إذا كان الراوي عنه ثقة، ولا يُذكَر عنه أحسنُ من هذه الروايات، وكنتُ أطلب الحجةَ الظاهرةَ في سماع شعيب بن محمد من عبد الله بن عمرو فلم أصِلْ إليها إلى هذا الوقت.

It is narrated from Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said about a treasure that a man had found: "If you found it in an inhabited town or on a much-travelled road, then announce it. And if you found it in a ruin from the Jahiliyyah, or in an uninhabited town, or in a place that is not a thoroughfare, then in it and in rikaz (ancient treasure buried in the ground) one fifth (khumus) is due."
In this book I have given many proofs for authenticating the narrations of Amr bin Shu'ayb when the one narrating from him is trustworthy (thiqah), and nothing better than these narrations is reported from him. I have been seeking clear proof that Shu'ayb bin Muhammad heard from Abdullah bin Amr, but I have not reached it up to this time.

Grading: The chain is "hasan"; al-Humaydi and Sufyan bin Uyaynah are among its narrators.
وأخرجه أحمد 11/ (6891)، وأبو داود (1710)، والنسائي (2285) و (5795 - 5797) من طرق عن عمرو بن شعيب، به. ورواية بعضهم مختصرة.
Reference / Source: Ahmad, Abu Dawud and al-Nasa'i narrated it via Amr bin Shu'ayb.
والطريق المِيتاء، أي: المسلوك، وهو مِفعال من الإتيان، والميم زائدة، وبابه الهمزة.
Linguistic explanation: "Tariq mita'" means a road on which people travel frequently (a public thoroughfare).
قال ابن الأثير في "النهاية": الركاز عند أهل الحجاز: كنوز الجاهلية المدفونة في الأرض، وعند أهل العراق: المعادن. والقولان تحتملهما اللغة لأنَّ كلًّا منهما مركوز في الأرض، أي: ثابت. والحديث إنما جاء في التفسير الأول، وهو الكنز الجاهلي.
Linguistic explanation: According to Ibn al-Athir, the people of the Hijaz understand "rikaz" to mean the pre-Islamic treasures buried in the ground, while according to the people of Iraq it means minerals. In the hadith the first meaning (treasure) is intended.
وقال أبو الطيب العظيم آبادي في "عون المعبود" 5/ 92 - 93: حديث عمرو بن شعيب فيه حكم للشيئين، الأول: ما وُجد مدفونًا في الأرض، وهو الركاز، والثاني: ما وُجد على وجه الأرض في خربة جاهلية أو قرية غير مسكونة أو غير سبيل مِيتاء، ففيهما الخمس.
Juristic point: According to al-Azimabadi, this hadith gives the ruling for two things: first, what is found buried in the ground (rikaz), and second, what is found in an uninhabited place or on a road that is not frequented; in both cases giving the "khums" (one fifth) is obligatory.
