Mustadrak al-Hakim — Hadith 2367

أخبرنا بكر بن محمد بن حَمْدان الصَّيرفي، حدثنا أَحْيَد بن الحسين البامِيَاني ببَلْخ، حدثنا أزهر بن سليمان (1) الكاتب، حدثنا إبراهيم بن طَهْمان. وأخبرني عبد الله بن محمد بن حَمَّوَيهِ، حدثني أبي، حدثنا أحمد بن حفص بن عبد الله، حدثني أبي، حدثني إبراهيم بن طَهْمان، عن يحيى بن سعيد، عن عمرو بن شعيب، عن عبد الله بن أبي نَجِيح، عن مجاهد، عن ابن عباس، أنه قال: نهى رسولُ الله ﷺ يومَ خيبر عن بيع الغنائم حتى تُقسَم، وعن الحَبَالى أن يُوطَأنَ حتى يَضَعْنَ ما في بُطونهنَّ، وقال: "لا تَسْقِ زَرْعَ غيرِك"، وعن لحوم الحُمُر الأهليّة، وعن لحم كل ذي نابٍ من السِّباع (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that on the day of Khaybar, the Messenger of Allah (peace and blessings be upon him) forbade selling the spoils of war before they are distributed, and forbade having intercourse with pregnant slave women until they give birth. And he (peace and blessings be upon him) said: "Do not water another person's crop with your water (seed)." He (peace and blessings be upon him) also forbade the meat of domestic donkeys and the meat of every predatory animal with fangs.
This hadith has a sahih (authentic) chain, and the two Shaykhs (Bukhari and Muslim) did not record it.

Note / Clarification: In the manuscripts the name has been altered (tahrif) to "Salman".

(2) إسناده صحيح من جهة عبد الله بن محمد بن حمّوية - وهو عبد الله بن محمد بن حمويه بن عباد أبو القاسم بن أبي بكر الطَّهماني - وأما أزهر بن سليمان في الإسناد الأول فقد ضعَّفه أبو الفتح الأزدي. يحيى بن سعيد: هو الأنصاري.
Grading: The chain is "sahih" by way of Abd Allah bin Muhammad al-Tahmani, although Azhar bin Sulayman was declared weak by al-Azdi. Yahya bin Sa'id refers to the well-known narrator "al-Ansari".
وأخرجه النسائي (6196) عن أحمد بن حفص بن عبد الله بهذا الإسناد. دون ذكر لحوم الحمر الأهلية، ودون قوله: "لا تَسْقِ زرع غيرك".
Reference / Source: Al-Nasa'i (6196) narrated it, but without mention of "the meat of domestic donkeys" and of "not watering another's crop".
لكن قد ثبت هذا الحرفان عند غير المصنف أيضًا كالطبراني في "الأوسط" (6981) والدارقطني (3051) من طريقين آخرين عن أحمد بن حفص بن عبد الله.
Corroborating chains and supporting reports: These two phrases are established with al-Tabarani (al-Awsat: 6981) and al-Daraqutni (3051) through other routes.
وأخرج مسلمٌ ذكر النهي عن لحوم الحمر الأهلية برقم (1939) من طريق عامر الشعبي، عن ابن عباس، قال: لا أدري إنما نهى عنه رسول الله ﷺ من أجل أنه كان حَمُولةَ الناسِ، فكره أن تذهب حمولتهم، أو حرَّمه يوم خيبر: لحوم الحمر الأهلية.
Reference / Source: Muslim (1939) narrated the prohibition of domestic donkeys from Ibn Abbas; Ibn Abbas used to say that he did not know whether this prohibition was because they were the people's means of carrying loads, or whether they were made definitively forbidden on the day of Khaybar.
وسيأتي عن ابن عباسٍ ما يخالف ذلك، وأنه أبَى أن يكون نُهِيَ عن لحوم الحمر الأهلية، برقم (3275) من طريق أبي الشعثاء جابر بن زيد عنه.
Important point: The opposite is narrated from Ibn Abbas (at number 3275): that he denied the prohibition of donkey meat.
قال ابن القيم في "حاشيته على سنن أبي داود" 5/ 322: التحقيق أنَّ ابن عباس أباحها أولًا حيث ¤ ¤ لم يبلغه النهيُ، فسمع ذلك منه جماعةٌ، منهم أبو الشعثاء وغيره، فرووا ما سمعوه، ثم بلغه النهي عنها، فتوقف هل هو للتحريم أو لأجل كونها حَمُولة، فروى عنه ذلك الشعبي وغيره، ثم لما ناظَرَهُ عليُّ بن أبي طالب جزم بالتحريم، كما رواه عنه مجاهد.
Technical note / Defect ('illah): According to Ibn al-Qayyim, the verified position is that Ibn Abbas at first considered it permissible because the prohibition had not reached him; then, when he learned of the prohibition, he was hesitant about its reason (prohibition, or their use for carrying loads); and finally, after his debate with Ali, he held firmly to its prohibition (being haram).
