Mustadrak al-Hakim — Hadith 2347

فحدَّثَناه أبو علي وأبو محمد المَرَاغِي، قالا: حدثنا علي بن عبد الحميد الغَضائري بحلب، حدثنا مُجاهِد بن موسى، حدثنا [مَعْن بن عيسى] (1) عن مالك بن أنس، عن الزُّهْري، فذكره بإسناده نحوه (2) وأما حديث ابن أبي ذِئب:

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him), with the same chain, that the Messenger of Allah (peace and blessings be upon him) said something similar.

(1) ما بين معقوفين وقع محلَّه بياض في النسخ الخطية، وأثبتناه من "إتحاف المهرة" (18651)، ومن مصادر تخريج الحديث التي خرَّجته من هذه الطريق.
Note / Clarification: The text between these square brackets (ma'qufayn) was a blank space in the manuscripts; we have supplied it from "Ithaf al-Maharah" (no. 18651) and from the other sources of this hadith's takhrij that report it through this same chain.

(2) رجاله ثقات، لكن اختُلف فيه على الزُّهْري في وصله وإرساله، واختُلف فيه أيضًا على مالك، قال ابن عبد البر في "التمهيد" 6/ 425: رواه مرسلًا كل من روى "الموطأ" عن مالك فيما علمتُ إلّا معن بن عيسى، فإنه وصله، فجعله عن سعيد عن أبي هريرة، ومعنٌ ثقة، وقال الدارقطني في "العلل" 9/ (1694): المرسل هو الصواب عن مالك.
Grading: Its narrators are thiqah (trustworthy), but there is disagreement over Imam al-Zuhri as to whether it is mawsul or mursal, and likewise there is disagreement over Imam Malik.
Technical note / Defect ('illah): Ibn 'Abd al-Barr said in "al-Tamhid" (6/ 425) that all the narrators of the "Muwatta'" from Imam Malik narrated it as "mursal" except Ma'n bin 'Isa, who gave it as connected, attributing it through Sa'id bin al-Musayyib to Abu Hurayrah (may Allah be pleased with him); and Ma'n bin 'Isa is thiqah.
Reference / Source: Imam al-Daraqutni said in "al-'Ilal" (9/ 1694) that the "mursal" form is the correct one from Imam Malik.
ثم ذكر ابن عبد البر 6/ 427 عن شيخه خلف بن قاسم أنه رواه عن شيوخه عن زيد بن الحباب وعن محمد بن كثير المصيصي، كلاهما عن مالك، موصولًا كذلك.
Corroborating chains and supporting reports: Then Ibn 'Abd al-Barr (6/ 427) mentioned through his teacher Khalaf bin Qasim that he narrated it from his teachers, from Zayd bin al-Hubab and Muhammad bin Kathir al-Missisi, both from Imam Malik, likewise as "mawsul".

ثم أسنده ابن عبد البر 6/ 428 عن أحمد بن إبراهيم (ويقال في اسمه: محمد بن إبراهيم) بن أبي سكينة الحلبي، عن مالك، موصولًا أيضًا. ¤ ¤ قلنا: فهؤلاء من غير رواة "الموطأ" قد رووه عن مالك، فوصلوه، لكن لا يسلم شيء منها من مقال كما سيأتي بيانه.
Important point: Ibn 'Abd al-Barr (6/ 428) gave its chain through Ahmad bin Ibrahim (also called Muhammad bin Ibrahim) bin Abi Sukaynah al-Halabi from Imam Malik as "mawsul".
Note / Clarification: We say: these are people other than the known narrators of the "Muwatta'" who narrated it from Imam Malik as "mawsul", but none of these routes is free of criticism, as will be detailed below.
وأخرجه أبو أحمد الحاكم في "عوالي مالك" (58)، وأبو بكر بن المقرئ في "غرائب مالك" (12)، وابن عبد البر في "التمهيد" 6/ 425 و 426 من طرق عن علي بن عبد الحميد الغضائري، بهذا الإسناد.
Reference / Source: Abu Ahmad al-Hakim recorded it in "'Awali Malik" (58), Abu Bakr bin al-Muqri' in "Ghara'ib Malik" (12), and Ibn 'Abd al-Barr in "al-Tamhid" (6/ 425, 426) through routes from 'Ali bin 'Abd al-Hamid al-Ghada'iri with this same chain.
وابن عبد البر 6/ 426 من طريق أبي بكر بن جعفر، عن مجاهد بن موسى، به.
Details of the narration: Ibn 'Abd al-Barr (6/ 426) recorded it through Abu Bakr bin Ja'far, from Mujahid bin Musa, with this same chain.
وأخرجه أبو الحسين بن المظفر في "غرائب مالك" (92)، وابن جُميع الصيداوي في "معجمه" ص 210 - 211، وأبو القاسم الحنائي في "الحنائيات" (62)، والخطيب في "تاريخ بغداد" 7/ 101، والذهبي في "معجم الشيوخ" 1/ 423 من طريق أحمد بن بكر البالسي، عن محمد بن كثير المِصِّيصي، عن مالك به، موصولًا. وأحمد بن بكر وشيخه محمد بن كثير ضعيفان.
Technical note / Defect ('illah): Ibn al-Muzaffar recorded it in "Ghara'ib Malik" (92), Ibn Jumay' in his "Mu'jam" (210-211), al-Hinna'i in "al-Hinna'iyyat" (62), al-Khatib in "Tarikh Baghdad" (7/ 101) and al-Dhahabi in "Mu'jam al-Shuyukh" (1/ 423) as "mawsul" through Ahmad bin Bakr al-Balisi, from Muhammad bin Kathir al-Missisi, from Malik.
Note: Ahmad bin Bakr and his teacher Muhammad bin Kathir are both weak.
والظاهر أنَّ رواية زيد بن الحباب التي طوى ابنُ عبد البر الإسنادَ إليها من طريق أحمد بن بكر البالسي أيضًا، فإنَّ له روايةً عن زيد بن الحباب، كما في كتب التراجم، ولم نقف عليها مُخرَّجةً عند أحمد ممن تقدم ابنَ عبد البر، والله تعالى أعلم.
Important point: It appears that the narration of Zayd bin al-Hubab, whose chain Ibn 'Abd al-Barr abbreviated, is also through Ahmad bin Bakr al-Balisi, since according to the biographical works he has narrations from Zayd bin al-Hubab; however, we have not found it recorded from Ahmad by any author before Ibn 'Abd al-Barr. And Allah knows best.
وأخرجه الخطيب البغدادي في "تاريخ بغداد" 4/ 488، وابن عبد البر في "التمهيد" 6/ 428 من طريق محمد بن المبارك الأنباري، عن أحمد بن إبراهيم بن أبي سكينة الحلبي، عن مالك، به موصولًا. ومحمد بن المبارك الأنماري ترجم له الخطيب في "تاريخه" عند هذا الحديث، ولم يذكر فيه جرحًا ولا تعديلًا، وقد روى عنه هذا الحديث رجلان، وجاء في "اللسان" في ترجمة ابن أبي سكينة أنَّ الدارقطني والخطيب ذكرا أنَّ محمد بن المبارك الصُّوري روى عن ابن أبي سكينة، فإذا صحَّ ذلك فيجوز أن يكون الصُّوري قد دخل الأنبار، والصوري ثقة معروف.
Reference / Source: Al-Khatib al-Baghdadi recorded it in "Tarikh Baghdad" (4/ 488) and Ibn 'Abd al-Barr in "al-Tamhid" (6/ 428) as connected through Muhammad bin al-Mubarak al-Anbari, from Ahmad bin Ibrahim bin Abi Sukaynah al-Halabi.
Technical note / Defect ('illah): Al-Khatib gave the biography of Muhammad bin al-Mubarak al-Anmari under this very hadith but mentioned no criticism or praise of him. "Al-Lisan" states that according to al-Daraqutni and al-Khatib, Muhammad bin al-Mubarak al-Suri narrated from Ibn Abi Sukaynah; if that is correct, al-Suri may have visited al-Anbar, and al-Suri is thiqah and well known.
لكن خالف محمدَ بنَ المبارك هذا سعيدُ بنُ عبد العزيز الحلبي، ثم الدمشقي، عند أبي الحسين عبد الوهاب بن الحسن الكلابي في "جزء من حديثه" (15)، فرواه عن ابن أبي سُكينة، عن مالك، عن الزُّهْري، عن سعيد بن المسيب، مرسلًا، وهذا هو الموافق لجماعة رواة "الموطأ"، فهو الصواب في رواية ابن أبي سُكينة، والله أعلم.
Grading: Muhammad bin al-Mubarak is contradicted by Sa'id bin 'Abd al-'Aziz al-Halabi (later al-Dimashqi), who narrated it from Ibn Abi Sukaynah as mursal.
Important point: This mursal narration agrees with the body of narrators of the "Muwatta'", so in the narration of Ibn Abi Sukaynah this (its being mursal) is correct. And Allah knows best.
وهو في "موطأ مالك" برواية يحيى الليثي 2/ 728، وبرواية أبي مصعب الزُّهْري (2957)، وبرواية محمد بن الحسين (848)، وبرواية سويد بن سعيد الحدثاني (297) عن سعيد بن المسيب مرسلًا، مختصرًا بلفظ: "لا يَغْلَق الرَّهنُ".
Reference / Source: It is in the "Muwatta' of Imam Malik" in the recensions of Yahya al-Laythi (2/ 728), Abu Mus'ab al-Zuhri (2957), Muhammad bin al-Hasan (848) and Suwayd bin Sa'id (297), as mursal from Sa'id bin al-Musayyib, in the short wording: "La yaghlaq al-rahn" (the pledge is not forfeited).
وكذلك أخرجه الطحاوي في "شرح معاني الآثار" 4/ 100، وأبو بكر النيسابوري في "زياداته على مختصر المزني" (280) من طريق عبد الله بن وهب، وأبو داود في "المراسيل" كما في أصل خطيّ ¤ ¤ عندنا منه برواية الحسين بن بكر الوراق عن أبي علي اللؤلؤي ورقة (7) من طريق عبد الله بن مسلمة القعنبي، وأبو أحمد الحاكم في "عوالي مالك" (57)، وأبو الحسين الكلابي في "جزئه" (12)، وعنه أبو القاسم الحِنّائي في "الحنائيات" (59) من طريق أبي نُعيم عبيد بن هشام الحلبي، وابن المظفر في "غرائب مالك" (93) من طريق عبد الرحمن بن القاسم، أربعتهم عن مالك، به مرسلًا أيضًا. ولفظ ابن وهب وابن القاسم والقعنبي مختصر بلفظ: "لا يَغْلَق الرهنُ"، ولفظ أبي نعيم بطوله.
Corroborating chains and supporting reports: Imam al-Tahawi (4/ 100) and Abu Bakr al-Naysaburi (280) recorded it through Ibn Wahb, Abu Dawud in "al-Marasil" through al-Qa'nabi, and Abu Ahmad al-Hakim (57) and others through Abu Nu'aym 'Ubayd bin Hisham, from Imam Malik as mursal. The wording of Ibn Wahb, Ibn al-Qasim and al-Qa'nabi is short, while Abu Nu'aym's narration is long.
