Mustadrak al-Hakim — Hadith 2346

حدثنا أبو الوليد الفقيه، حدثنا إبراهيم بن أبي طالب ويحيى بن محمد بن صاعِد، قالا: حدثنا عبد الله بن عمران العابِدي، حدثنا سفيان بن عُيينة، عن زياد بن سعد، عن الزُّهْري، عن سعيد بن المسيّب، عن أبي هريرة، قال: قال رسول الله ﷺ: "لا يَغْلَقُ الرَّهْنُ، له غُنْمُه وعليه غُرْمُه" (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه لخلافٍ فيه على أصحاب الزُّهْري، وقد تابع مالكٌ وابنُ أبي ذئب وسليمانُ بن أبي داود الحَرَّاني ومحمدُ بن الوليد الزُّبيدي ومعمرُ بن راشد على هذه الروايةِ. أما حديثُ مالكٍ:
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "A pledge (an item held in pawn) is not cut off from its owner; its gain belongs to him and its loss (or expense) is upon him."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it because of a disagreement among the students of Imam al-Zuhri; however, Imam Malik and other imams have corroborated it.

(1) رجاله لا بأس بهم، إلّا أنه اختُلف فيه على الزُّهْري في وصله وإرساله، واختُلف فيه على سفيان بن عيينة أيضًا، فلم يرفعه عنه إلّا عبد الله بن عمران العابدي وإسحاق بن الطبّاع، وأرسله غيرهما، كما سيأتي بيانه، ومع ذلك حسَّن الدارقطني في "سننه" (2920) إسناد رواية العابدي هذه! لكنه صوَّب في "العلل" (1694) إرسال الحديث، وممَّن صحَّح وصله ابن حبان، وابن عبد البر في "التمهيد" 6/ 430، وابن العربي في "العارضة" 6/ 11، وعبد الحق الإشبيلي في "الأحكام الوسطى" 3/ 279، لكن الصحيح أنه مرسل كما جزم به الدارقطني في "العلل"، وسبقه إلى تصحيح الإرسال أبو داود والبزار، وإذا صحَّ ذلك فهو من مراسيل سعيد بن المسيّب، وهو من أقوى المراسيل عند أهل العلم.
Grading: Its narrators are acceptable, but there is disagreement over al-Zuhri and Sufyan bin 'Uyaynah as to whether it is "mawsul" (connected) or "mursal".
Technical note / Defect ('illah): Only 'Abd Allah bin 'Imran al-'Abidi and Ishaq bin al-Tabba' reported it from Sufyan as connected. Imam al-Daraqutni in "al-'Ilal" (1694) judged it mursal.
Important point: If it is established as mursal, it is among the mursal reports of Sa'id bin al-Musayyib, which the scholars count among the strongest mursal reports.
وأخرجه ابن حبان (5934) من طريق إسحاق بن عيسى بن الطبّاع، عن سفيان بن عيينة، بهذا الإسناد.
Reference / Source: Imam Ibn Hibban recorded it in his "Sahih" (5934) through Ishaq bin 'Isa bin al-Tabba', from Sufyan bin 'Uyaynah, with this same chain.
وخالف ابنَ الطبّاع وعبدَ الله بن عمران العابدي، كلٌّ من الحُميدي وعبد الرحمن بن بشر بن الحكم عند أبي بكر النيسابوري في "زياداته على مختصر المزني" (281) و (282)، فروياه عن سفيان بن عيينة، عن الزُّهْري عن سعيد بن المسيب مرسلًا. قال البيهقي في "السنن الكبرى" 6/ 40: وهو المحفوظ عن سفيان بن عيينة عن زياد.
Technical note / Defect ('illah): Contradicting Ishaq bin al-Tabba' and 'Abd Allah bin 'Imran al-'Abidi, Imam al-Humaydi and 'Abd al-Rahman bin Bishr bin al-Hakam narrated it through Sufyan bin 'Uyaynah from Imam al-Zuhri from Sa'id bin al-Musayyib as "mursal".
Important point: Imam al-Bayhaqi stated explicitly in "al-Sunan al-Kubra" (6/ 40) that the "mursal" form is the preserved (mahfuz, correct) one from Sufyan bin 'Uyaynah.
وأخرجه ابن ماجه (2441) عن محمد بن حميد الرازي، عن إبراهيم بن المختار، عن إسحاق بن راشد، عن الزُّهْري، عن ابن المسيب، عن أبي هريرة، فوصله أيضًا، لكن محمد بن حميد وشيخه إبراهيم بن المختار ضعيفان، وإسحاق بن راشد في حديثه عن الزُّهْري أوهام. ¤ ¤ وقد وصله عن الزُّهْري جماعة سيذكرهم المصنف، لكن في الأسانيد إليهم اختلاف كما سيأتي بيانه في مواضعه، وأنَّ الصحيح عنهم في تلك الروايات الإرسال.
Reference / Source: Imam Ibn Majah (2441) recorded it through Muhammad bin Humayd al-Razi, who gave it as connected (with a continuous chain).
Grading: This chain is da'if (weak).
Technical note / Defect ('illah): Muhammad bin Humayd and his teacher Ibrahim bin al-Mukhtar are both weak narrators, and Ishaq bin Rashid's narrations from Imam al-Zuhri contain errors (awham).
Note / Clarification: Although some other narrators also gave it as connected, their chains too are disputed; the correct view is that this narration is mursal.

قوله: "لا يَغْلَق الرّهنُ" أي: لا يَستحقه المُرتَهِن - يعني الدائن - إذا لم يَرُدّ الراهِنُ - أي: المَدِين - ما رَهَنه فيه، يعني في الوقت المشروط. قال أبو عبيد: وكان هذا من فعل الجاهلية، فأبطله النبي ﷺ بقوله: "لا يَغْلَق الرهنُ".
Note / Clarification: The linguistic and juristic meaning of "la yaghlaq al-rahn" is that if the debtor (rahin) cannot repay the debt at the appointed time, the creditor (murtahin) does not become the permanent owner of the pledged item.
General principle: Imam Abu 'Ubayd says that this was a custom of the Jahiliyyah, which the Prophet (peace and blessings be upon him) abolished with this statement.
وقوله: "له غُنْمه وعليه غُرمه" معناه: أنَّ زيادة الرهن ونماءه وفضل قيمته للراهن، أي: للمدين المالك لهذا الرهن، وعلى المرتهن - أي: الدائن - ضمانه إن هلك، فالغُنم: الفائدة، والغُرم: إقامة العوض.
General principle: This means that the benefit of the pledged item (such as milk, fruit or an increase in value) belongs to its original owner, the debtor, while liability for it (if it perishes) falls on the creditor (murtahin). "Ghunm" means benefit and "ghurm" means compensation for loss.
