Mustadrak al-Hakim — Hadith 2345

حدثنا أبو العباس محمد بن يعقوب، أخبرنا محمد بن عبد الله بن عبد الحَكَم، أخبرنا ابن أبي فُدَيك [عن ابن أبي ذئبٍ] (1) حدثني أبو المُعتمِر، عن عُمر (2) بن خَلَدة الزُّرَقي - وكان قاضيَ المدينة - قال: جئنا أبا هُريرةَ في صاحبٍ لنا قد أَفلَسَ، فقال: هذا الذي قضى فيه رسولُ الله ﷺ: "أيُّما رجلٍ ماتَ أو أَفلَسَ، فصاحبُ المَتاعِ أحقُّ بمَتاعِه، إذا وجدَه بعَينِه" (3).
هذا حديث عالٍ صحيح الإسناد، ولم يُخرجاه بهذا اللفظ.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) gave this judgement: "Whoever dies or becomes bankrupt, the owner of the goods has more right to his goods if he finds them exactly as they were (in their original condition)."
This hadith has a high ('ali) and sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it with this wording.

(1) سقط ابن أبي ذئب من النسخ الخطية، واستدركناه من رواية البيهقي عن الحاكم في "السنن الصغرى" (2047)، وجميع من روى هذا الحديث عن ابن عبد الحَكَم أثبته، وكذلك أثبته كل من روى هذا الحديث عن ابن أبي فُدَيك كالشافعي ودُحيم، بل إنَّ مدار هذا الإسناد عند من روى الحديث على ابن أبي ذئب.
Technical note / Defect ('illah): The name of Ibn Abi Dhi'b (Muhammad bin 'Abd al-Rahman bin al-Mughirah) had dropped out of the manuscripts; we have restored it with the help of al-Bayhaqi's "al-Sunan al-Sughra" (2047), since for all the narrators of this hadith this chain revolves around Ibn Abi Dhi'b.

(2) تحرَّف في النسخ الخطية إلى: عمرو، وإنما هو عُمر، وليس هو عمرو بن سُليم بن خَلَدة الزُّرَقي، فذاك أكبر من عُمر بن خَلَدة، ولم يكن ذاك قاضيًا أيضًا، إنما القاضي عُمر بن خلدة، وجاء على الصواب في "السنن الصغرى" للبيهقي، ولم يُصب في "معرفة السنن والآثار" (11825) بعد تخريجه الحديث عن غير الحاكم حيث قال: ابن خَلَدة: هو عُمر بن خلدة، ويقال: عَمرو، وعُمر أصحُّ. قلنا: لعله ظنهما واحدًا.
Technical note / Defect ('illah): In the manuscripts the name is written "'Amr", whereas the correct name is 'Umar (bin Khaldah). 'Amr bin Sulaym was older than 'Umar and was not a judge either, whereas the description of being a judge belongs to 'Umar bin Khaldah.
Note / Clarification: Al-Bayhaqi, in "Ma'rifat al-Sunan wa-l-Athar" (11825), deemed "'Umar" the more correct form.

(3) صحيح دون قوله: "مات" وهذا إسناد ضعيف لجهالة أبي المعتمر - وهو ابن عمرو بن رافع. قال الطحاوي في "شرح المشكل" بإثر (4610): لا يُعرف ولا يُدرى من هو. ابن أبي فُديك: هو محمد بن إسماعيل، وابن أبي ذئب: هو محمد بن عبد الرحمن بن المغيرة.
Grading: Apart from the addition of the word "mata" (he died), this hadith is sahih, but this particular chain is da'if (weak) because Abu al-Mu'tamir (bin 'Amr bin Rafi') is unknown.
Technical note / Defect ('illah): Imam al-Tahawi said that Abu al-Mu'tamir is unknown; it is not known who he is.
Note / Clarification: Ibn Abi Fudayk's full name is Muhammad bin Isma'il, and Ibn Abi Dhi'b's full name is Muhammad bin 'Abd al-Rahman bin al-Mughirah.
وأخرجه ابن ماجه (2360) عن إبراهيم بن المنذر الحزامي وعبد الرحمن بن إبراهيم الدمشقي، كلاهما عن ابن أبي فديك، بهذا الإسناد.
Reference / Source: Imam Ibn Majah (2360) recorded it through Ibrahim bin al-Mundhir and 'Abd al-Rahman bin Ibrahim, with this same chain of Ibn Abi Fudayk.
وأخرجه أبو داود (3523) من طريق أبي داود الطيالسي، عن ابن أبي ذئب، به.
Reference / Source: Imam Abu Dawud (3523) recorded it through Abu Dawud al-Tayalisi, from Ibn Abi Dhi'b.
وأخرجه دون ذكر الموت: أحمد 12/ (7124)، والبخاري (2402)، ومسلم (1559)، وأبو داود (3519)، وابن ماجه (2358)، والترمذي (1262)، والنسائي (6228) و (6229)، وابن حبان (5036) و (5037) من طريق أبي بكر بن عبد الرحمن بن الحارث بن هشام، ¤ ¤ وأحمد 14/ (8566)، ومسلم (1559) من طريق بشير بن نَهيك، ومسلم (1559) من طريق عراك بن مالك، ثلاثتهم عن أبي هريرة.
Reference / Source: Without the mention of "death", this hadith was recorded by Imam Ahmad (12/ 7124), al-Bukhari (2402), Muslim (1559), Abu Dawud (3519), Ibn Majah (2358), al-Tirmidhi (1262), al-Nasa'i and Ibn Hibban through various routes (Abu Bakr bin 'Abd al-Rahman, Bashir bin Nahik and 'Irak bin Malik) from Abu Hurayrah (may Allah be pleased with him).
وقال الخطابي في "معالم السنن" 3/ 157: هذه سنة النبي ﷺ، وقد قال بها كثير من أهل العلم، وقد قضى بها عثمان ﵁، وروي ذلك عن علي بن أبي طالب ﵁، ولا يُعلم لهما مخالف في الصحابة.
General principle: Imam al-Khattabi said that this is the Sunnah of the Prophet (peace and blessings be upon him), held by many scholars. 'Uthman and 'Ali (may Allah be pleased with them) judged in accordance with it, and no Companion is known to have opposed them.
