حدثنا أبو العباس محمد بن يعقوب، حدثنا الربيع بن سليمان، حدثنا عبد الله بن وهب، أخبرني سليمان بن بلال، عن كثير بن زيد، عن الوليد بن رَبَاح، عن أبي هريرة، أنَّ رسول الله ﷺ قال: "المسلمون على شُروطِهم، والصلحُ جائزٌ بين المسلمين" (1). رواة هذا الحديث مدنيُّون، ولم يُخرجاه، وهذا أصلٌ في الكتاب. وله شاهدٌ من حديث عائشة وأنس بن مالك: [التعليق - من تلخيص الذهبي] ترقيم العلميه 2309 - لم يصححه وكثير ضعفه النسائي ومشاه غيره
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Muslims are bound by their (agreed) conditions, and making peace (settlement) between Muslims is permissible."
Its narrators are from Madinah, and the two Shaykhs (Bukhari and Muslim) did not record it. It is one of the foundational principles of fiqh, and supporting narrations (shawahid) for it are also reported from Sayyidah Aishah and Sayyiduna Anas (may Allah be pleased with them both).

(1) صحيح لغيره، وهذا إسناد حسن من أجل كثير بن زيد - وهو الأسلمي - والوليد بن رباح. Grading: On the strength of its supporting reports this hadith is sahih, and this chain is "hasan" because of Kathir bin Zayd and al-Walid bin Rabah. وأخرجه أبو داود (3594) عن سليمان بن داود المَهْري، عن عبد الله بن وهب، بهذا الإسناد. Reference / Source: Abu Dawud (3594) recorded it through Sulayman bin Dawud al-Mahri. وأخرجه أحمد 14/ (8784) عن منصور بن سلمة الخُزاعي، وأبو داود (3594)، وابن حبان (5091) من طريق مروان بن محمد الطاطري، كلاهما عن سليمان بن بلال، به. لكن وقع في رواية أبي داود شك، قال: حدثنا سليمان بن بلال أو عبد العزيز بن محمد. Reference / Source: Ahmad (14/ 8784) and Ibn Hibban (5091) recorded it through Sulayman bin Bilal. واقتصر أحمد وابن حبان في روايتهما على قوله: "الصلح جائز بين المسلمين" زاد أبو داود وابن حبان: "إلّا صلحًا أحلَّ حرامًا أو حَرَّم حلالًا". Details of the narration: The narration of Ahmad and Ibn Hibban goes only as far as "Settlement is permissible between Muslims", while Abu Dawud has the addition: "except a settlement that makes the unlawful lawful or the lawful unlawful (that is not permissible)." وسيأتي الشطر الثاني منه من طريق آخر عن أبي هريرة برقم (2344). Details of the narration: The second part of this hadith (the part about conditions) will come at no. (2344). ويشهد له بشطريه حديث كثير بن عبد الله بن عمرو بن عوف المزني، عن أبيه، عن جده، فيما سيأتي عند المصنف برقم (7236)، وهو عند ابن ماجه (2353)، والترمذي (1352)، وقال الترمذي: حديث حسن صحيح. قلنا: ذلك لأنه حسّن الرأي في كثير المزني تبعًا لشيخه البخاري، والجمهور على تضعيفه، وأعدل الأقوال فيه أنه يصلح للاعتبار في المتابعات والشواهد. Corroborating chains and supporting reports: The narration of Kathir bin 'Abd Allah al-Muzani (al-Tirmidhi 1352) also supports it; although the majority declared Kathir weak, his narration is acceptable in corroborations and supporting reports. ويشهد لشطره الأول قول عمر بن الخطاب موقوفًا عليه: المسلمون على شروطهم عند مقاطع حقوقهم، أخرجه ابن أبي شيبة 6/ 570، وسعيد بن منصور (662)، وابن المنذر في "الأوسط" (7286)، وابن حزم في "المحلى" 9/ 517، والبيهقي 7/ 249، وإسناده صحيح، واللفظ لابن المنذر وابن حزم. Corroborating chains and supporting reports: A statement of 'Umar (Ibn Abi Shaybah 6/ 570) supports its first part: "Muslims are bound by their conditions at the points where rights are decided." Its chain is sahih. ولشطره الثاني قول عمر بن الخطاب أيضًا في رسالته إلى أبي موسى الأشعري في صفة القضاء، عند وكيع محمد بن خلف في "أخبار القضاة" 1/ 70 - 73 و 284، والدارقطني (4472)، والبيهقي 6/ 65، ورجاله ثقات. Corroborating chains and supporting reports: The second part is supported by the letter that 'Umar wrote to Abu Musa al-Ash'ari, all of whose narrators are thiqah (trustworthy). قال الخطّابي في "المعالم" 4/ 166: الصلح يجري مجرى المعاوضات، ولذلك لا يجوز إلّا فيما أوجب المال، ولا يجوز في دعوى القذف، ولا دعوى الزوجية، ولا على مجهول، ولا أن يصالحه على دَين له على مال نسيه لأنه من باب الكالئ بالكالئ، ولا يجوز الصلح في قول مالك على الإقرار، ولا يجوز في قول الشافعي على الإنكار، وجوّزه أصحاب الرأي على الإقرار والإنكار جميعًا. ¤ ¤ ونوع آخر من الصلح، وهو أن يصالحه في مالٍ على بعضه نقدًا، وهذا من باب الحط والإبراء وإن كان يُدعى صلحًا. Juristic principle: Imam al-Khattabi (may Allah have mercy on him) says that settlement (sulh) is like an exchange for compensation in financial dealings, so it is not permissible over slander (qadhf), marital rights, or something unknown. According to Imam Malik, settlement on acknowledgment is not permissible; according to al-Shafi'i, settlement on denial is not permissible; while the Hanafis (ashab al-ra'y) permit settlement in both cases, acknowledgment and denial. وقوله: "المسلمون على شروطهم" فهذا في الشروط الجائزة في حق الدِّين، دون الشروط الفاسدة، وهذا من باب ما أمر الله تعالى من الوفاء بالعقود. Juristic principle: The hadith "Muslims are bound by their conditions" refers to conditions that are permissible in religion, not invalid conditions. It falls under Allah's command to "fulfil contracts".
