Mustadrak al-Hakim — Hadith 2319

أخبرَناه أبو الحسين محمد بن أحمد بن تَميم الحَنْظلي، حدثنا أبو قِلَابة عبد الملك بن محمد الرَّقَاشي، حدثنا أبو عاصم، أخبرنا ابنُ جُرَيج، عن أبي الزُّبَير، عن جابر: أنَّ رسول الله ﷺ نهى عن بَيع الماء، وعن ضِراب الجَمَل، وأن يبيعَ الرجلُ أرضَه وماءَه (2). وهذه أسانيد كلُّها صحيحةٌ على شرط مسلم، ولم يُخرجاه (1). وأحسنُ ما في هذا الباب حديث الحسين بن واقِد الذي:
[التعليق - من تلخيص الذهبي] ترقيم العلميه 2288 - على شرط مسلم_x000D_ أَخْبَرَنَاهُ أَبُو الْحُسَيْنِ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ تَمِيمٍ الْحَنْظَلِيُّ، ثنا أَبُو قِلَابَةَ عَبْدُ الْمَلِكِ بْنُ مُحَمَّدٍ الرَّقَاشِيُّ، ثنا أَبُو عَاصِمٍ، أَنْبَأَ ابْنُ جُرَيْجٍ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ «نَهَى عَنْ بَيْعِ الْمَاءِ، وَعَنْ ضِرَابِ الْجَمَلِ، وَأَنْ يَبِيعَ الرَّجُلُ أَرْضَهُ وَمَاءَهُ» وَهَذِهِ أَسَانِيدُ كُلُّهَا صَحِيحَةٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ «وَأَحْسَنُ مَا فِي هَذَا الْبَابِ حَدِيثُ حُسَيْنِ بْنِ وَاقِدٍ» الَّذِي:
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) forbade the sale of water, taking a fee for the mating of a camel, and a man selling his land (together with) its water rights.
All of these chains are sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record them.

(2) حديث صحيح، وهذا إسناد حسن من أجل محمد بن أحمد بن تَميم، وقد توبع، وابن جُرَيج قد صرَّح بسماعه عند مسلم وغيره، وكذا أبو الزُّبَير: وهو محمد بن مسلم بن تدرس. أبو عاصم: هو الضحّاك بن مَخْلَد.
Grading: This hadith is sahih, and its chain is hasan because of Muhammad bin Ahmad bin Tamim. Ibn Jurayj and Abu al-Zubayr (Muhammad bin Muslim bin Tadrus) are established as having heard it, in Muslim and elsewhere.
وأخرجه ابن حبان (5155) من طريق محمد بن معمر، عن أبي عاصم، بهذا الإسناد. لكنه اقتصر على قصة ضِراب الجمل.
Reference / Source: Ibn Hibban (5155) recorded it through Abu 'Asim, but it mentions only the stud fee for a camel (dirab).
وأخرجه مسلم (1565)، وابن ماجه (2477)، وابن حبان (4953) من طريق وكيع بن الجرّاح، ومسلم (1565) من طريق يحيى بن سعيد القطان، ومسلم (1565) من طريق روح بن عُبادة، والنسائي (4682) و (6221) من طريق حجّاج بن محمد أربعتهم عن ابن جُرَيج، به. واقتصر وكيع والقطان على ذكر النهي عن بيع فضل الماء. هكذا بذكر الفضل دون الأصل، لكن زاد ابن حبان في روايته: نهى عن بيع فضل الماء ليُمنَع به الكلأُ.
Reference / Source: Muslim (1565), Ibn Majah (2477) and Ibn Hibban (4953) recorded it through the routes of Waki', Yahya al-Qattan and Rawh bin 'Ubadah. Ibn Hibban's narration has: "He forbade selling surplus water so that pasture would be withheld by means of it."
ولفظ رواية روح: نهى رسول الله ﷺ عن بيع ضراب الجمل، وعن بيع الماء والأرض لتُحرث. ¤ ¤ ولفظ حجاج: نهى رسول الله ﷺ عن بيع ضراب الجمل، وعن بيع الماء، وبيع الأرض لتحترث، يبيع الرجل أرضه وماءه.
Details of the narration: The wording of Rawh's narration is that the Prophet (peace and blessings be upon him) forbade taking a fee for a camel's mating, selling water, and giving land (on rent) for cultivation. Hajjaj's narration has the same meaning.
وسيأتي برقم (2390) من طريق حماد بن سلمة عن أبي الزُّبَير. مقتصِرًا على ذكر النهي عن بيع فضل الماء.
Details of the narration: This narration will come later at no. (2390) through Hammad bin Salamah, mentioning only the prohibition of selling surplus water.
وسيأتي بعده مقتصرًا على هذا الحرف كذلك من طريق عطاء بن أبي رباح عن جابر.
Note / Clarification: The narration of 'Ata' bin Abi Rabah will also contain this same fragment.
وقد ظهر من رواية روح وحجاج أنَّ المنهي عنه بيعُ ضراب الجمل، لا ضراب الجمل نفسُه، فهو مندوب إليه كما في حديث آخر لجابر عند مسلم (988) قال فيه النبي ﷺ: "ومن حقها إطراق فحلها". وانظر ما تقدم برقم (2312).
Technical note: The narrations of Rawh and Hajjaj make it clear that the prohibition concerns the "fee" (sale) for mating, not mating itself. Giving a male animal for mating is recommended, as in the hadith in Muslim (988).

وظهر أيضًا من رواية روح وحجاج أنَّ معنى بيع الرجل أرضه وماءه، هو لأجل الحرث، أي: إجارتها للزرع، وهذا مقيَّد بما يكون فيه جهالة وغرر كما تقدم في حديث رافع بن خديج الذي أخرجه البخاري (2343 - 2345)، ومسلم (1547).
General principle: Selling land and water here means renting it out (ijarah) for cultivation, and this prohibition applies where there is "uncertainty" or "deception" (gharar), as has already passed in the narration of Rafi' bin Khadij in al-Bukhari and Muslim.

Reference / Source: Imam Muslim has also recorded it, but confined himself to mentioning the prohibition of selling surplus water (fadl al-ma')!
