Mustadrak al-Hakim — Hadith 2320

أخبرَناه أبو العباس محمد بن أحمد المَحْبُوبي، حدثنا الفضل بن عبد الجبار، حدثنا علي بن الحسن بن شَقِيق، أخبرنا الحسين بن واقِد، عن أيوب السَّختِياني، عن عطاء، عن جابر: أنَّ النبي ﷺ نهى عن بَيع الماءِ (2). تفرَّد به الحُسين بن واقِد عن أيوب، وهو غريبٌ صحيح.

It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) forbade the sale of water.
Al-Husayn bin Waqid is alone in narrating this, and it is gharib (singular) and sahih (authentic).

(2) حديث صحيح، وهذا إسناد قوي من أجل حسين بن واقد عطاء: هو ابن أبي رباح.
Grading: This hadith is sahih, and this chain is strong (qawi) because of Husayn bin Waqid.
Technical note: 'Ata' is Ibn Abi Rabah.
وأخرجه النسائي (6211) من طريق الفضل بن موسى، عن الحسين بن واقد، بهذا الإسناد.
Reference / Source: Al-Nasa'i (6211) recorded it through al-Fadl bin Musa, from Husayn bin Waqid, with this same chain.
والمقصود بهذا الحديث بيع فضل الماء كما وقع تقييده في بعض طرق حديث جابر في الطريق التي قبل هذه.
Important point: What this hadith means is the sale of surplus water, as this qualification has already appeared in some routes of the narration of Jabir (may Allah be pleased with him).
وهو مقيد أيضًا بأن يكون في بئر، دون ما استخرجه صاحبه وحمله في قربةٍ ونحوها، كما فهمه عطاء راوي الحديث، فقد أخرج ابن أبي شيبة 6/ 253 عنه بسند صحيح أنَّ ابن جُرَيج قال له: بيع الماء في القِرب، قال: لا بأس به، هو يستقيه هو يحمله، ليس كفضل الماء الذي يذهب في الأرض.
General principle: This ruling is restricted to well water, not water that the owner has drawn out and filled into a waterskin or the like. This is how 'Ata', the narrator of this hadith, understood it: Ibn Abi Shaybah 6/ 253 reports from him with a sahih chain that Ibn Jurayj asked him about selling water in waterskins, and he said: "There is no harm in it, since he draws the water himself and carries it; it is not like the surplus water that runs away into the ground."
