حدثني محمد بن صالح بن هانئ، حدثنا أحمد بن محمد بن نَصْر، حدثنا أبو نُعيم الفضل بن دُكَين، حدثنا بُكير بن عامر، عن ابن أبي نُعْم، حدثنا رافع بن خَديج: أنه زَرَعَ أرضًا، فمرَّ به النبيُّ ﷺ وهو يسقيها، فسأله: "لمن الزرعُ؟ ولمن الأرضُ؟ " فقال: زرعي ببَذْري وعَمَلي، لي الشطرُ ولبني فلانٍ الشطرُ، فقال: "أربَيتُما، فَرُدَّ الأرضَ على أهلها، وخُذ نَفَقَتَك" (1). هذا حديث صحيح الإسناد، ولم يُخرجاه، إنما اتفقا على مناظرةِ عبد الله بن عُمر ورافع بن خَديج فيه (1). It is narrated from Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) that he cultivated a piece of land. The Prophet (peace and blessings be upon him) passed by while he was watering it, and he (peace and blessings be upon him) asked: "Whose crop is this, and whose land is this?" He replied: The seed and the labour are mine, so half the produce is mine and half belongs to Banu so-and-so. He (peace and blessings be upon him) said: "You two have engaged in usury (riba). So return the land to its owners and take your expenses."
This hadith has an authentic chain (sahih al-isnad), but the two Shaykhs (Bukhari and Muslim) did not record it; however, they both agreed on (recording) the debate between Ibn Umar and Rafi' bin Khadij on this matter.

(1) إسناده ضعيف لضعف بُكير بن عامر، كما قال الذهبي في "تلخيصه". ابن أبي نُعْم: هو عبد الرحمن. Grading: Its chain is weak because of the weakness of Bukayr bin Amir, as Imam al-Dhahabi said in "al-Talkhis". Technical note: Ibn Abi Nu'm refers to Abd al-Rahman. وأخرجه أبو داود (3402) عن هارون بن عبد الله، عن أبي نعيم، بهذا الإسناد. Reference / Source: Abu Dawud (3402) narrated it by way of Harun bin Abd Allah, from Abu Nu'aym, with this same chain. وأخرج أبو داود (3399)، والنسائي (4602) عن رافع بن خديج: أنَّ رسول الله ﷺ أتى بني حارثة، فرأى زرعًا في أرض ظُهير، فقال: "ما أحسنَ زرعَ ظُهير! " قالوا: ليس لظُهير، قال: "أليس أرضَ ظُهير؟! " قالوا بلى ولكنه زرعُ فلان، قال: "فخذوا زرعكم، ورُدُّوا عليه النفقة"، قال رافع: فأخذنا زرعَنا ورددنا إليه النفقة. وإسناده صحيح، وظهير المذكور في الحديث: هو ابن رافع، عم رافع بن خديج. Reference / Source: Abu Dawud (3399) and al-Nasa'i (4602) narrated from Rafi' bin Khadij that the Messenger of Allah (peace and blessings be upon him) came to Banu Harithah and saw crops on Zuhayr's land, and said: "How fine Zuhayr's crop is!" They said: It is not Zuhayr's. He said: "Is it not Zuhayr's land?" It was said: Yes, indeed, but it is the crop of so-and-so. He said: "Take your crop and pay him back his expenses". Grading: Its chain is sahih. Technical note: The "Zuhayr" mentioned in the hadith is Zuhayr bin Rafi', the paternal uncle of Rafi' bin Khadij.

Reference / Source: Imam al-Bukhari (2343), (2344), (2345) and Muslim (1547) narrated it. واتفق الشيخان أيضًا على رواية أخرى فيه عن رافع بن خديج، قال: كان الناس يؤاجرون على عهد النبي ﷺ على الماذيانات وأقبال الجداول وأشياء من الزرع، فيهلك هذا ويسلم هذا، ويسلم هذا ويهلك هذا، فلم يكن للناس كِراء إلّا هذا، فلذلك زجر عنه النبي ﷺ عنه، فأما شيء معلوم مضمون فلا بأس به. أخرجه البخاري (2327)، ومسلم (1548) (116)، واللفظ له. Corroborating chains and supporting reports: The two Shaykhs also agreed on another narration from Rafi' bin Khadij: in the time of the Prophet (peace and blessings be upon him) people used to rent out land on the basis of the crop growing on the banks of the water channels or of specific portions, so sometimes one portion would perish and the other would survive; there was no other form of rent besides this, so he (peace and blessings be upon him) forbade it. As for a known and fixed rent (in cash), there is no harm in it. Al-Bukhari (2327) and Muslim (1548) (116) narrated it, and the wording is Muslim's.
