حدثنا أبو العباس محمد بن يعقوب، حدثنا بَحْر بن نَصْر الخَوْلاني، حدثنا عبد الله بن وهب، أخبرني عمرو بن الحارث، عن بُكير بن الأشَجّ، عن عِياض بن عبد الله، عن أبي سعيد الخُدْري، قال: أُصيبَ رجلٌ في عهد رسول الله ﷺ في ثمارٍ ابتاعَها، فكَثُر دَيْنُه، فقال رسول الله ﷺ: "تَصدَّقُوا عليه"، فتصدَّقُوا عليه، فلم يبلُغْ ذلك وفاءَ دَيْنِه، فقال رسول الله ﷺ: "خُذُوا ما وَجَدْتُم، وليس لكم إلّا ذلكَ" (4). هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه! It is narrated from Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) that in the blessed time of the Messenger of Allah (peace and blessings be upon him), a man bought some fruit on which he suffered a loss (due to a natural calamity), and his debts became very great. The Messenger of Allah (peace and blessings be upon him) said to the Companions: "Give him charity." The people gave him charity, but it was not enough to pay off his debt. So the Messenger of Allah (peace and blessings be upon him) said (to the creditors): "Take whatever you have found; you have nothing beyond that."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), and they did not record it.

(4) إسناده صحيح. Grading: Its chain is sahih. وأخرجه مسلم (1556)، والنسائي (6230) من طريقين عن عبد الله بن وهب، بهذا الإسناد. فاستدراك الحاكم له ذهولٌ منه. Reference / Source: Muslim (1556) and al-Nasa'i (6230) narrated it through two routes from Abd Allah bin Wahb with this same chain. Technical note / Defect ('illah): Imam al-Hakim's including it as an addition (istidrak) is an oversight (dhuhul) on his part. وأخرجه أحمد 17/ (11317)، ومسلم (1556)، وأبو داود (3469)، وابن ماجه (2356)، ¤ ¤ والترمذي (655)، والنسائي (6076) و (6230)، وابن حبان (5033) من طريق الليث بن سعد، عن بُكير بن عبد الله الأشج، به. Corroborating chains and supporting reports: Ahmad 17/ (11317), Muslim (1556), Abu Dawud (3469), Ibn Majah (2356), al-Tirmidhi (655), al-Nasa'i (6076) and (6230) and Ibn Hibban (5033) narrated it by way of al-Layth bin Sa'd, from Bukayr bin Abd Allah al-Ashajj, with the same (chain). وقد يتوهم التعارض بين هذا الحديث وبين حديث وضع الجوائح، لكن قال الخطابي: هذا الحديث ليس فيه ذكر الجائحة، وقد يحتمل أن يكون أصيب في تلك الثمار بعدما جَذَّها وآواها الجرين، فطرقها لص أو جرفها سيل، أو باعها، فافتات الغريم بحقه، وكل هذه الوجوه يصح إضافة المصيبة فيها إلى الثمار التي كان ابتاعها، وإذ كان كذلك لم يجب الحكمُ بذهاب حق رب المال. General principle: One may imagine an apparent contradiction between this hadith and the hadith about "remitting losses from calamities (wad' al-jawa'ih)", but Imam al-Khattabi (may Allah have mercy on him) said that there is no mention of a calamity in it; it is possible that the loss occurred after harvesting, on the threshing floor, and in such a case the right of the owner of the property does not lapse. قلنا: والجمع ممكن أيضًا بأن يكون وضع الجوائح خاصًا بما يكون أصاب الثمار قبل بدوّ صلاحها وطيبها كما في حديث أنس المتقدم برقم (2289) حيث جاء فيه: "أرأيت إن منع الله الثمرة، فبم يستحل أحدكم مال أخيه؟! ". فقد قال ابن حزم في "المحلى" 8/ 385: صح بهذين الخبرين أنَّ الجوائح التي أمر رسول الله ﷺ بوضعها هي التي تصيب ما بيع من الثمر سنين، وقبل أن يُزهي، وأنَّ الجائحة التي لم يسقطها وألزم المشتري مُصيبتها، وأخرجه عن جميع ماله بها، هي التي تصيب الثمر المبيع بعد ظهور الطِّيْب فيه وجواز بيعه، وبالله تعالى التوفيق. General principle: We say: reconciliation (between the hadiths) is also possible in that the ruling of "remitting losses from calamities" is specific to fruits that are struck by calamity before they ripen and become sound (buduww al-salah), as in the hadith of Anas (2289): "Tell me, if Allah withholds the fruit (does not let it grow), then for what would any of you consider his brother's property lawful?" Ibn Hazm said in "al-Muhalla" 8/ 385: It is established from these two reports (hadiths) that the calamities which the Messenger of Allah (peace and blessings be upon him) ordered to be remitted are those that strike fruits sold for years ahead, before they ripen (yuzhi), and the calamity whose cost he (peace and blessings be upon him) did not remove from the buyer is the one that strikes the fruit after it has ripened and its sale has become permissible. And success is from Allah.
