Mustadrak al-Hakim — Hadith 2305

أخبرني أحمد بن محمد العَنَزي، حدثنا عثمان بن سعيد الدارمي، حدثنا علي بن عبد الله، حدثنا سفيان، عن حُميد بن قيس، عن سليمان بن عَتِيق، عن جابر: أنَّ النبي ﷺ وَضَعَ الجَوائح (1).

It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) issued the ruling of remitting for calamities: the waiving of the price when fruit is destroyed by natural disasters.

وأخرجه أحمد 22/ (14320)، ومسلم (1555) (17)، وأبو داود (3374)، والنسائي (6075)، وابن حبان (5031) من طرق عن سفيان بن عيينة، بهذا الإسناد.
Reference / Source: Imam Ahmad 22/ (14320), Muslim (1555) (17), Abu Dawud (3374), al-Nasa'i (6075) and Ibn Hibban (5031) narrated it through several routes from Sufyan bin Uyaynah with this same chain.
وقد تقدم من طريق أبي الزُّبَير عن جابر برقم (2287) بلفظ: "إن بعت أخاك تمرات، فأصابته جائحة، فلا يحلُّ لك أن تأخذ منه شيئًا، أو تأخذ مال أخيك بغير إذنه".
Details of the narration: This narration has passed earlier by way of Abu al-Zubayr from Jabir (may Allah be pleased with him) under number (2287) with these words: "If you sell your brother some dates and then a sudden calamity (ja'ihah) befalls them, it is not lawful for you to take anything from him, or to take your brother's property without his permission".
