Mustadrak al-Hakim — Hadith 2301

أخبرني عبد الله بن الحسين القاضي بمَرْو، حدثنا الحارثُ بن أبي أسامة، حدثنا يزيد بن هارون، أخبرنا محمد بن إسحاق، عن نافع، عن ابن عمر، عن رسول الله ﷺ: أنه نهى أن تُباعَ السلعُ حيث تُشتَرى، حتى يَحُوزَها الذي اشتراها إلى رَحْلِه، وإن كان ليَبعَثُ رجالًا فيضرِبونا على ذلك (2)
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. وعند محمد بن إسحاق فيه إسنادٌ آخر:

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) forbade that goods be sold at the very place where they were bought, until the buyer moves them to his own place; and the situation was that he (peace and blessings be upon him) would send men specifically to punish us for violating this prohibition.
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) حديث صحيح، وهذا إسناد حسن، وقد صرَّح محمد بن إسحاق بسماعه عند أحمد فانتفت شبهة تدليسه، وقال في روايته: الأطعمة، بدل: السِّلَع، وهو الصحيح، كما سيأتي بيانه. وقد توبع محمد بن إسحاق.
Grading: The hadith is "sahih" and the chain is "hasan". Muhammad bin Ishaq explicitly stated that he heard it, which removes the suspicion of his tadlis. He used the words "al-at'imah" (food) in place of "al-sila'" (goods), which is correct.
وأخرجه أحمد 10/ (6191) من طريق إبراهيم بن سعد، عن ابن إسحاق، حدثني نافع، عن ¤ ¤ ابن عمر حدثهم: أنَّ رسول الله ﷺ كان يبعث عليهم إذا ابتاعوا الأطعمة من يمنعهم أن يتبايعوها حتَّى يؤووا إلى رِحالهم.
Reference / Source: Imam Ahmad (10/ 6191) narrated it with the chain Ibn Ishaq, from Nafi', that the Messenger of Allah (peace and blessings be upon him) used to send (supervisors) to those who bought grain so that they would not sell it on before moving it to their places (homes).
وأخرجه أحمد 1/ (395) و 10/ (5924)، ومسلم (1527) (33)، وأبو داود (3493)، والنسائي (6154) من طريق مالك بن أنس، وأحمد 8/ (4639)، والبخاري (2167)، ومسلم (1527) (34)، وأبو داود (3494)، وابن ماجه (2229)، والنسائي (6155)، وابن حبان (4986) من طريق عُبيد الله بن عمر، والبخاري (2123) من طريق موسى بن عقبة، و (2166) من طريق جويرية بن أسماء، والنسائي (6156) من طريق محمد بن عبد الرحمن بن عنج، كلهم عن نافع، عن ابن عمر بنحوه، لكن بلفظ "الطعام" عند جميعهم. وقد جاء في رواية موسى بن عقبة وجويرية وبعض الروايات عن عبيد الله بن عمر أنَّ هذا الحديث وارد في تلقي الركبان بأعلى السوق.
Reference / Source: Imam Ahmad, al-Bukhari (2167), Muslim (1527), Abu Dawud, Ibn Majah, al-Nasa'i and Ibn Hibban narrated it through the various routes of Imam Malik, Ubayd Allah bin Umar and Musa bin Uqbah with the word "ta'am" (grain). According to some narrations, this ruling concerns meeting caravans outside the market to strike deals (talaqqi al-rukban).
وجاء في رواية جويرية وموسى بن عقبة ومحمد بن عبد الرحمن ما يفسر المراد بحيازة الطعام إلى الرَّحل، وهو نقله إلى حيث يباع الطعام، أي: إلى السوق.
Note / Clarification: The narrations of Musa bin Uqbah and others make clear that bringing the grain to the "rahl" (place) means moving it to the place where grain is sold, that is, bringing it inside the market.
ووقع في بعض روايات عبيد الله بن عمر: طعامًا جِزافًا. فقُيِّد بالجزاف، وهو ما لم يكن مكيلًا ولا موزونًا. وهذا قيد مهمّ، فقد نصَّ ابن عبد البر في "التمهيد" 13/ 343 على الإجماع على أنَّ ما يُستوفى بالكيل أو الوزن أنه يجوز بيعُه في موضعه.
Juristic point: In the narration of Ubayd Allah bin Umar there is the restriction "ta'aman juzafan" (grain bought by estimate), that is, grain that has not been measured or weighed. According to Ibn Abd al-Barr, there is consensus (ijma') that whatever is bought by measure or weight may be sold at the same place (after taking possession).
وأخرجه بنحوه أيضًا أحمد 8/ (4517)، والبخاري (2131)، ومسلم (1527) (37) و (38)، وأبو داود (3498)، والنسائي (6157) من طريق سالم بن عبد الله بن عمر، عن أبيه، بلفظ "الطعام"، ومقيدًا بالجزاف كذلك.
Reference / Source: Al-Bukhari, Muslim and al-Nasa'i also narrated it through the chain of Salim bin Abd Allah with the word "ta'am" and the restriction "juzaf" (without measuring or weighing).
وكأنَّ حديث ابن عمر هذا قد ورد في نقل وتحويل الطعام الذي اشتُري من الركبان بأعلى السوق، حتى يُنتهى به إلى داخل السوق، لكي يُتمكن من بيعه بالكيل أو بالوزن.
Important point: It appears that this hadith of Ibn Umar concerns grain bought outside the market, which must first be brought inside the market so that it can be sold by measure and weight.
وإذا ثبت ذلك لم يكن هذا الحديث بعينه دالًا على عموم النهي عن بيع المبيع قبل قبضه واستيفائه.
Juristic point: If this is established, then this particular hadith will not be evidence for the general prohibition of "selling any purchased item before taking possession of it".
لكن قد ثبت عن نافع عن ابن عمر، مرفوعًا: "من ابتاع طعامًا فلا يبعه حتى يستوفيه"، وفي رواية: "حتى يقبضه"، فهذا هو الذي يصلح حجة في النهي عن بيع المبيع قبل قبضه، لأنَّ الاستيفاء هو القبض، وهو عامٌّ في الطعام الجزاف وغيره، وفي ما تُلُقّي من أعلى السوق من الركبان وما اشتُري من داخل السُّوق. وقد ثبت عن عدد من الصحابة غير ابن عمر النهي عن بيع المبيع قبل قبضه.
Juristic point: However, it is established from Nafi', from Ibn Umar, as marfu': "Whoever buys grain should not sell it until he receives it in full (istifa')", and in one narration the words are "until he takes possession of it". This narration is the real proof for the prohibition of selling before taking possession, because it is general, whether the grain is by estimate or by measure and weight, from the market or from outside it.

وأخرجه بهذا اللفظ أيضًا أحمد 9/ (5064)، والبخاري (2133)، ومسلم (1527) (36)، والنسائي (6144)، وابن حبان (4981) من طريق عبد الله بن دينار، وأحمد 10/ (5900)، وأبو داود (3495)، والنسائي (6153) من طريق القاسم بن محمد، وابن حبان (4979) من طريق عمرو بن دينار، ثلاثتهم عن ابن عمر. لكن زاد القاسم في روايته: "طعامًا اشتراه بكيل" وعند أحمد زيادة: "أو وزن".
Reference / Source: Al-Bukhari, Muslim and al-Nasa'i also narrated it through the chain of Abd Allah bin Dinar. In the narration of al-Qasim bin Muhammad there is the addition "grain bought by measure", and in the narration of Ahmad the addition "by weight".
وقال الطحاوي في "شرح مشكل الآثار" بإثر (3166): هذا المروي عن عبد الله بن عمر عن رسول الله ﷺ نهيه عن بيع الطعام حتى يستوفى، وعنه عن رسول الله ﷺ نهيه عن ابتياع الجِزاف من الطعام أن يباع حتى ينقل إلى مكان آخر، فكان ذلك حكم بيع الطعام المشتَرى كيلًا، وحكم بيع الطعام المشترى جزافًا.
Important point: Imam al-Tahawi says that in the narrations from Ibn Umar, for grain sold by measure and weight the condition is "receiving it in full" (istifa'), while for grain bought by estimate (juzaf) the condition is "moving it" to another place.
قلنا: وكل ذلك عن ابن عمر بلفظ: "الطعام"، وبذلك يندفع الإشكال الذي يتبادر إلى الذهن عند النظر في حديث عُبيد بن حنين الآتي بعده عن ابن عمر، كما سيأتي بيانه.
Note / Clarification: All these narrations of Ibn Umar have the word "ta'am" (grain/food), which removes the difficulty that may arise in the mind on seeing the next hadith (that of Ubayd bin Hunayn).
