حدثنا أبو العباس محمد بن يعقوب، أخبرنا محمد بن عبد الله بن عبد الحَكَم، أخبرنا ابن وهب، أخبرني ابن جُرَيج، أنَّ أبا الزُّبَير حدثه، قال: سمعتُ جابر بن عبد الله يقول: نهى رسولُ الله ﷺ عن بيع الصُّبْرة من التَّمْر، لا يُعلَمُ مَكِيلُها بالكَيلِ المُسمَّى من التَّمْر (3). هذا حديث صحيح على شرط مسلم، ولم يُخرجاه! It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) forbade selling a heap of dates (whose quantity is not known) in exchange for a specified measure of dates.
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(3) إسناده صحيح. ابن وهب: هو عبد الله بن وهب المصري، وابن جُرَيج: هو عبد الملك بن عبد العزيز المكي، وأبو الزُّبَير: هو محمد بن مسلم بن تَدْرُس المكي. Grading: Its chain is "sahih" Note / Clarification: Ibn Wahb is Abd Allah al-Misri, Ibn Jurayj is al-Makki, and Abu al-Zubayr is Muhammad bin Muslim. وأخرجه مسلم (1530) عن أبي الطاهر أحمد بن عمرو بن سَرْح، عن ابن وهب، بهذا الإسناد. فاستدراك الحاكم له ذهولٌ منه. Reference / Source: In Sahih Muslim (1530), it is narrated from Ibn al-Sarh through this same chain of Ibn Wahb; Imam al-Hakim's including it in al-Mustadrak is an oversight (dhuhul) on his part. وأخرجه مسلم (1530)، والنسائي (6093) من طريقين عن ابن جُرَيج، به. Reference / Source: Muslim and al-Nasa'i also narrated it through two other routes from Ibn Jurayj. وأخرجه النسائي (6094) من طريق حجاج بن محمد، عن ابن جُرَيج، به. بلفظ: قال النبي ﷺ: "لا تُباع الصُّبْرة من الطعام بالصُّبْرة من الطعام، ولا الصُّبْرة من الطعام بالكيل من الطعام المسمّى". ¤ ¤ قال النووي في "شرح مسلم": هذا تصريح بتحريم بيع التمر بالتمر حتَّى تُعلَم المماثلةُ، قال العلماء: لأنَّ الجهل بالمماثلة في هذا الباب كحقيقة المفاضلة، لقوله ﷺ: "إلّا سواء بسواء" ولم يحصل تحقق المساواة مع الجهل، وحكم الحنطة بالحنطة والشعير بالشعير وسائر الرِّبَويات إذا بيع بعضها ببعض حكم التمر بالتمر، والله أعلم. Reference / Source: Al-Nasa'i (6094) narrated it with the chain Hajjaj bin Muhammad, from Ibn Jurayj, in these words: the Prophet (peace and blessings be upon him) said: "A heap of food is not to be sold for a heap of food, nor a heap of food for a specified measure (kayl) of food" Juristic point: Imam al-Nawawi says in "Sharh Muslim": This is an explicit statement that selling dates for dates is unlawful until equality is known with certainty Principle of jurisprudence: The scholars say that in this chapter "not knowing that there is equality" is exactly like "there actually being inequality" (al-jahl bi-l-mumathalah ka-haqiqat al-mufadalah), because the Prophet (peace and blessings be upon him) laid down the condition "like for like", and equality cannot be ascertained where there is ignorance; the same ruling applies to wheat, barley and other riba-bearing commodities. وقال الأزهري في "الزاهر" ص 140: الصُّبْرة: الكومة من الطعام، سميت صُبْرةً لإفراغ بعضها على بعض. Note / Clarification: Al-Azhari says in "al-Zahir" (p. 140): "al-subrah" is a heap of grain that has been gathered by pouring it one part over another.
