Mustadrak al-Hakim — Hadith 2278

أخبرنا الحسن بن يعقوب العَدْل، حدثنا يحيى بن أبي طالب، أخبرنا عبد الوهاب بن عطاء، أخبرنا سعيد بن أبي عَرُوبة، عن قَتَادة، عن عِكْرمة، عن ابن عباس، قال: نهى رسولُ الله ﷺ عن لبن الجَلَّالة، وعن أكل المُجَثَّمة، وعن الشُّرب من في السِّقَاء (2).
هذا حديث صحيح على شرط البخاري، ولم يُخرجاه. وله شاهدٌ عن عبد الله بن عُمر وأبي هريرة، أما حديث ابن عُمر:

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) forbade the milk of the jallalah (an animal that feeds on filth), eating the mujaththamah (an animal tied up and made a target), and drinking directly from the mouth of a water-skin.
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs (Bukhari and Muslim) did not record it. It also has supporting reports (shawahid) narrated from Ibn Umar and Abu Hurayrah (may Allah be pleased with them).

(2) حديث صحيح، وهذا إسناد قوي من أجل يحيى بن أبي طالب وعبد الوهاب بن عطاء، فهما صدوقان لا بأس بهما، وقد توبعا.
Grading: The hadith is "sahih", and the chain is "qawi" (strong) because of Yahya bin Abi Talib and Abd al-Wahhab bin Ata', since they are saduq and there is corroboration for them.
وأخرجه أحمد 5/ (3142) و (3143)، وابن حبان (5399) من طريق أبي عبد الصمد عبد العزيز بن عبد الصمد، وأحمد 4/ (2161) و 5/ (3142) عن محمد بن جعفر، والترمذي بإثر (1825) من طريق ابن أبي عدي، ثلاثتهم عن سعيد بن أبي عَروبة، بهذا الإسناد. غير أنَّ محمد بن جعفر قال في روايته: نهى عن المجثَّمة والجلّالة، فأطلق ذكر الجلالة دون تقييده بذكر لبنها، كرواية حماد بن سلمة عن قتادة المتقدمة برقم (1645).
Reference / Source: Imam Ahmad, Ibn Hibban and al-Tirmidhi narrated it through the chain of Sa'id bin Abi Arubah; however, in the narration of Muhammad bin Ja'far, "al-jallalah" (the animal that eats filth) is mentioned without qualification, with no restriction to its milk.
وإنما المنهيُّ عنه من الجلّالة ثلاثةُ أمورٍ: شرب لبنها، كما جاء مقيَّدًا في رواية عبد الوهاب بن عطاء وعبد العزيز بن عبد الصمد، وكما في رواية هشام الدستوائي عن قتادة، وسيأتي تخريجها، وكما في حديث ابن عُمر الآتي بعده. ¤ ¤ ويُنهى عن أكلها كذلك، كما في بعض روايات حديث ابن عباس، وكما في حديث ابن عُمر الآتي بعده، وحديث عبد الله بن عمرو الآتي برقم (2300)، وحديث أبي هريرة الآتي برقم (2281).
Main discussion: Regarding the jallalah animal, three things are prohibited: drinking its milk (as specified in the narrations of Abd al-Wahhab, Abd al-Aziz and Hisham), eating its meat (as in the narrations of Ibn Abbas and Ibn Umar), and riding it.
ويُنهى أيضًا عن ركوبها، كما في رواية حماد بن سلمة عن قتادة الآتية برقم (2528)، وكما في حديث ابن عُمر الآتي برقم (2280)، وحديث عبد الله بن عَمرو الآتي برقم (2529).
Corroborating chains and supporting reports: The prohibition of riding will come in the narrations of Hammad bin Salamah from Qatadah (number 2528) and of Ibn Umar (number 2280).
وأخرجه أحمد 3/ (1989) و 4/ (2671) و 5/ (2949)، وأبو داود (3786)، والترمذي (1825)، والنسائي (4522) و (6837) من طريق هشام الدستُوائي، عن قتادة، به.
Reference / Source: Imam Ahmad, Abu Dawud (3786), al-Tirmidhi and al-Nasa'i narrated it with the chain Hisham al-Dastuwa'i, from Qatadah.
وقد رواه أيوب عن عكرمة، فقال: عن أبي هريرة، بدل: ابن عباس، وهذا اختلاف لا يضر مثله، لأنَّ الإسناد حيث دار كان عن صحابي، ولهذا أخرج البخاري كلا الحديثين برقم (5628) و (5629) واقتصر فيهما على النهي عن الشرب من في السقاء.
Variation in the chain: Ayyub, narrating from Ikrimah, attributed it to "Abu Hurayrah" instead of Ibn Abbas, but this makes no difference because both are Companions; Imam al-Bukhari recorded both narrations (5628, 5629).
والجلّالة من الحيوان: التي تأكل العَذِرة، والجِلَّة: البعر، فوُضِع مَوضع العَذِرة، يقال: جَلَّت الدابة الجِلَّة، واجتلَّتها، فهي جالَّة وجلّالة: إذا التقطتها.
Note / Clarification: "Jallalah" is the name for an animal that eats human excrement; "jillah" in the language means dung, which is used here in the sense of excrement.
وقال الحربي في "غريبه" 1/ 115: إنما نُهي عن ألبانها، لأنَّ آكله يجد فيه طعم ما أكلت، وكذلك في لحومها، ونُهي عن ركوبها لأنها تعرق، فتوجد رائحته في عَرَقها، وراكبها لا يخلو أن يُصيبه ذلك أو يجدَ رائحته، فإن تحفَّظَ من ذلك جاز ركوبها، ولم يجُز شربُ ألبانها ولا أكلُ لحومها، إلّا أن يُصنَع بها ما يُزيلها.
Important point: Al-Harbi says that its milk and meat were prohibited because the taste of the filth comes into them, and riding it was prohibited because its sweat carries a foul smell that may get on the rider; if it is purified (that is, fed clean fodder for a certain number of days), it becomes permissible.
وقال الشافعي فيما نقله عنه ابن عبد البر في "التمهيد" 15/ 180: الجلالة المكروه أكلها إذا لم يكن أكله غير العَذِرة، أو كانت العذرة أكثر أكله، فإن كان أكثر أكله وعلفه غير العَذِرة لم أكرهه.
Juristic point: According to Imam al-Shafi'i, the jallalah is the animal whose food is mostly excrement; if it eats other things more, it is not disliked.
وأما المجثَّمة، فقال الخطابي في "المعالم" 4/ 273: هي المصبُورة، وذلك أنها قد جُثّمت على الموت، أي: حُبست عليه، بأن تُوثق وتُرمى حتى تموت.
Note / Clarification: Imam al-Khattabi says that "al-mujaththamah" is the animal that is tied up and made a target and shot until it dies.
ويشهد للنهي عن المجثَّمة غير ما حديثٍ كما سيأتي عند حديث العرباض برقم (2639).
Corroborating chains and supporting reports: Supporting reports for the prohibition of al-mujaththamah will come later in the hadith of al-Irbad bin Sariyah (number 2639).
وأما الشرب من في السقاء، فقال ابن الجوزي في "كشف المشكل" 2/ 433: إنما نهي عن ذلك لخمسة معانٍ، أحدها: أنه ربما كانت في السقاء هامّة أو قَذاة فانتشرت في الحلق، والثاني: أنه ربما وقع الشَّرَق باندفاق الماء، والثالث: أنه لا يمكن مصُّ الماء، بل يقع العَبُّ الذي يؤذي الكبد، والرابع: أنه يُغيّر ريح السقاء، والخامس: أنه يتخايل الشارب الثاني رجوع شيء من فم الأول فيستقذره.
Important point: Ibn al-Jawzi mentioned five reasons for the prohibition of drinking from the mouth of the waterskin: a harmful creature or dirt may go into the throat; the water may gush suddenly and cause choking; it may harm the liver; a smell may develop in the waterskin; and the next drinker may find it repulsive.
