أخبرنا أحمد بن سَلْمان الفقيه ببغداد، حدثنا محمد بن إسماعيل السُّلَمي، حدثنا سعيد بن أبي مريم، أخبرنا يحيى بن أيوب، عن عُبيد الله بن أبي جعفر، عن نافع، عن ابن عمر وعائشة، أنَّ رسول الله ﷺ قال: "مَن طَلَبَ حقًّا فليطلُبْ في عَفافٍ، وافٍ أو غيرُ وافٍ" (2). هذا حديث صحيح على شرط البخاري، ولم يُخرجاه. وله شاهدٌ عن أبي هريرة: [التعليق - من تلخيص الذهبي] ترقيم العلميه 2238 - على شرط البخاري
It is narrated from Sayyiduna Abdullah bin Umar and Sayyidah Aishah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever seeks his right should seek it with restraint and decency, whether he receives it in full or not."
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs (Bukhari and Muslim) did not record it. It also has a supporting report (shahid) narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him).

(2) إسناده حسن من أجل يحيى بن أيوب: وهو الغافقي المصري. ¤ ¤ وأخرجه ابن ماجه (2421)، وابن حبان (5080) من طرق عن سعيد بن أبي مريم، بهذا الإسناد. Grading: The chain is "hasan" because of Yahya bin Ayyub al-Ghafiqi Reference / Source: Ibn Majah (2421) and Ibn Hibban (5080) narrated it through the chain of Sa'id bin Abi Maryam. وقال ابن حبان: قوله ﷺ: "في عفاف" شرطٌ أُريد به الزجر عن ضد العفاف مما لا يحلّ استعماله. Important point: Ibn Hibban says that the condition of "'afaf" (chastity/decency) was laid down to stress avoiding unlawful means. وقوله: "وافٍ أو غيرُ وافٍ" قال السندي في "حاشيته على سنن ابن ماجه" 2/ 78: أي: فليطلبه حال كونه ساعيًا في عدم الوقوع في المحارم مهما أمكن، تم له العفاف أم لا، وهذا المعنى هو ظاهر اللفظ، ويحتمل أن يجعل وافٍ حالًا عن الحق على أنه مجرور في اللفظ على الجوار، ويُحتمل أن يكون مرفوعًا، والجملة حال، أي: هو وافٍ، أي: الحق، فلا يتعدى إلى المحارم، سواء وصل إليه وافيًا أم لا، وهذا المعنى أمتن. Note / Clarification: "Wafin aw ghayru wafin" means that he should demand his right whether or not he attains full 'afaf (decency) in it Important point: According to al-Sindi, the better meaning is that he should demand his right while making every effort to avoid unlawful things, whether he receives his right in full or not.
