Mustadrak al-Hakim — Hadith 2232

حدثنا علي بن عيسى الحِيْري، حدثنا إبراهيم بن أبي طالب، حدثنا ابن أبي عُمر، حدثنا سفيان، حدثني محمد بن إسحاق، عن نافع، عن ابن عمر، قال: كان حَبَّان بن مُنْقِذٍ رجلًا ضعيفًا، وكان قد سُفِع في رأسه مأمومةً، فجعل له رسولُ الله ﷺ الخِيارَ فيما اشترى ثلاثًا، وكان قد ثَقُل لسانُه، فقال له رسول الله ﷺ: "بِعْ وقُل: لا خِلَابةَ". فكنتُ أسمَعُه يقول: لا خِذابةَ لا خِذابةَ. وكان يشتري الشيءَ ويجيء به أهلَه، فيقولون: هذا غالٍ، فيقول: إنَّ رسول الله ﷺ قد خَيَّرني في بَيعي (3).

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that Habban bin Munqidh (may Allah be pleased with him) was a weak man, and he had received a deep head wound that had reached the membrane of the brain. So the Messenger of Allah (peace and blessings be upon him) granted him an option of three days in anything he bought. His tongue had a stammer, so the Messenger of Allah (peace and blessings be upon him) said to him: "When you trade, say: 'La khilabah' (There is to be no deception)." The narrator said: I used to hear him say (because of his stammer): "La khidhabah, la khidhabah." He would buy something and bring it to his family, and they would say: "This is expensive," and he would reply: "The Messenger of Allah (peace and blessings be upon him) has given me the option (to return) in my sales."

Grading: The hadith is "sahih" except for the last sentence
Grading: Its chain is "hasan" on account of Muhammad bin Ishaq; he stated explicitly that he heard it, so there is no fear of tadlis
Technical note / Defect ('illah): The last sentence is "mudraj" (the narrator's own words), as we will make clear.
ابن أبي عمر: هو محمد بن يحيى بن أبي عمر العَدَني، وسفيان: هو ابن عيينة.
Note / Clarification: Ibn Abi Umar is al-Adani, and Sufyan is Ibn Uyaynah.
وأخرجه أحمد 10/ (6134) عن يعقوب بن إبراهيم بن سعد، عن أبيه، عن محمد بن إسحاق به. دون قوله في آخر الحديث: وكان يشتري الشيء … إلى آخره.
Reference / Source: Imam Ahmad (10/ 6134) narrated it through the route of Ya'qub bin Ibrahim, but that additional last sentence is not in it.
وهذه الزيادة المذكورة إنما سمعها ابن إسحاق من محمد بن يحيى بن حَبّان، قال: كان جدي منقذ بن عمرو … ، فذكره، وقد جاء بيان ذلك مفصَّلًا في رواية يونس بن بكير عند البيهقي 5/ 273، وعبد الأعلى بن عبد الأعلى عند الدارقطني (3011)، كلاهما عن محمد بن إسحاق، فما وقع في رواية الحاكم هنا إدراج، أوهمَ أنَّ هذه الجملة من قول ابن عمر، وليس كذلك.
Technical note / Defect ('illah): Ibn Ishaq heard this additional sentence from Muhammad bin Yahya, who said: "My grandfather Munqidh bin Amr…"; so in al-Hakim's narration this is an "idraj" (insertion), which gives the false impression that it is the saying of Ibn Umar, whereas it is not.
والحديث عند البخاري (2117)، ومسلم (1533) من طريق عبد الله بن دينار عن ابن عمر مختصرًا بلفظ: أنَّ رجلًا ذكر للنبي ﷺ أنه يُخدَع في البيوع، فقال: "إذا بايعتَ فقل: لا خِلابة"، فكان يقوله.
Reference / Source: This hadith is in al-Bukhari (2117) and Muslim (1533) in abridged wording: "When you trade, say: la khilabah" (no deception).
وفي الباب عن أنس بن مالك سيأتي برقم (7238).

والخِلابة: الخِداع.
Note / Clarification: "Al-khilabah" means deception.
