Mustadrak al-Hakim — Hadith 2215

حدثنا علي بن حَمْشاذَ العَدْلُ، حدثنا إسماعيل بن إسحاق القاضي، حدثنا سليمان بن حرب، حدثنا حماد بن زيد. وحدثنا أبو بكر بن إسحاق، حدثنا أبو المثنَّى، حدثنا مُسدَّد، حدثنا عبد الوارث بن سعيد. وحدثنا أبو عبد الله محمد بن يعقوب الحافظ، حدثنا يحيى بن محمد بن يحيى، حدثنا مُسدَّد، حدثنا يزيد بن زُريع؛ كلهم عن أيوب، عن عمرو بن شعيب، عن أبيه، عن جده، قال: قال رسول الله ﷺ: "لا يَحِلُّ سَلَفٌ وبَيعٌ، ولا شَرطانِ في بيعٍ، ولا رِبْحُ ما لم يُضْمَن، ولا بيعُ ما ليس عِندَك" (1).
هذا حديث على شرطِ جملةٍ من أئمة المسلمين صحيحٌ، وهكذا رواه داود بن أبي هند وعبد الملك بن أبي سليمان وغيرُهم عن عمرو بن شعيب. ورواه عطاء بن مسلم الخُراساني عن عمرو بن شعيب بزيادات ألفاظٍ:

It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "It is not lawful to combine a loan with a sale, nor to stipulate two conditions in one sale, nor to take profit on something for which you bear no liability (for loss), nor to sell what you do not have (in your possession)."
This hadith is sahih (authentic) on the condition of a group of the Imams of the Muslims, and it has likewise been narrated from Amr bin Shu'ayb by Dawud bin Abi Hind, Abd al-Malik bin Abi Sulayman and others.

وأخرجه النسائي (6160) عن عمرو بن علي الفلاس وحميد بن مسعدة، عن يزيد بن زريع، بهذا الإسناد. دون قوله: "ولا ربحُ ما لم يُضمَن".
Reference / Source: Imam al-Nasa'i narrated it at (6160) through Amr bin Ali al-Fallas and Humayd bin Mas'adah, from Yazid bin Zuray', with this same chain; except for the words: "wa la ribhu ma lam yudman" (nor profit on that for which liability/risk has not been taken on).
وأخرجه ابن ماجه (2188) عن أزهر بن مروان، عن حماد بن زيد، به. دون ذكر السلف والبيع والشرطين في بيع.
Reference / Source: Ibn Majah narrated it at (2188) through Azhar bin Marwan, from Hammad bin Zayd, with this same chain; but it does not mention credit and sale (salaf and bay') or two conditions in one sale.
وأخرجه أحمد 11/ (6671)، وأبو داود (3504)، وابن ماجه (2188)، والترمذي (1234)، والنسائي (6181) من طريق إسماعيل ابن عُليَّة، عن أيوب السختياني، به. وقال الترمذي: حسن صحيح.
Reference / Source: Imam Ahmad (11/ 6671), Abu Dawud (3504), Ibn Majah (2188), al-Tirmidhi (1234) and al-Nasa'i (6181) narrated it through the route of Isma'il Ibn Ulayyah, from Ayyub al-Sakhtiyani, with this same chain
Grading: Imam al-Tirmidhi called it "hasan sahih".

وقوله: "لا يحلُّ سلف وبيع .. " يدخل في باب النهي عن بيعتين في بيعة، وذلك مثل أن يقول: أبيعك هذا العبد بخمسين دينارًا على أن تسلفني ألف درهم في متاع أبيعه منك إلى أجل، أو على أن تقرضني ألف درهم، ويكون معنى السلف: القرض، وذلك فاسد لأنه إنما يقرضه على أن يحابيه في الثمن، فيدخل الثمن في حد الجهالة، ولأنَّ كل قرض جرَّ نفعًا مشروطًا فهو ربا، ولأنَّ في العقد شرطًا ولا يصح.
General principle: His (peace and blessings be upon him) saying "la yahillu salafun wa bay'" (credit and sale are not lawful) falls under the chapter of the prohibition of two sales in one sale, for example someone says: I sell you this slave for fifty dinars on condition that you advance me a thousand dirhams for goods that I will sell you for a set term, or that you lend me a thousand dirhams; here salaf means "loan"
Important point: This deal is invalid (fasid) because he is lending to him on condition that he gives him a concession in the price, so the price enters the bounds of uncertainty (jahalah); also because every loan that draws a benefit is "riba" (usury); and also because the contract (agreement) contains a condition that does not allow it to remain valid.
وقوله: "ولا شرطان في بيع" وهو أيضًا بمنزلة بيعتين في بيعة، وهو مثل أن يقول: بعتك هذا الثوب حالًا بدينار ونسيئة بدينارين، فهذا بيع تضمن شرطين يختلف المقصود منه باختلافهما، وهو الثمن ويدخله الغرر والجهالة، ولا فرق في مثل ذلك بين شرط واحد أو شرطين أو أكثر عند أكثر العلماء لأنَّ العلة في ذلك واحدة، وفرَّق أحمدُ بين شرط وبين شرطين عملًا بظاهر الحديث.
General principle: His (peace and blessings be upon him) saying "wa la shartani fi bay'" (nor two conditions in one sale) is also of the same standing as two sales in one sale, for example he says: I have sold you this cloth for one dinar in cash and for two dinars on credit; so this is a sale containing two conditions whose purpose changes with the difference in prices, which brings "gharar" (deceptive uncertainty) and uncertainty into it
Note / Clarification: According to most scholars there is no difference in this matter between one condition, two or more, because the cause ('illah) is one; however, Imam Ahmad distinguished between one and two conditions, acting on the apparent wording of the hadith.
والمراد من هذه الشروط ما يناقض البيوع ويفسدها كالشروط التي تدخل الثمن في حدّ الجهالة أو ما يوقع في العقد أو في تسليم المبيع غررًا، أو يمنع المشتري من اقتضاء حق الملك في المبيع. ولا تدخل في ذلك الشروطُ التي هي من مصلحة العقد أو من مقتضاه، فهي جائزة.
General principle: What is meant by these conditions is those which contradict the requirements of the sale and invalidate it, such as conditions that take the price into the bounds of uncertainty, or that create deceptive uncertainty (gharar) in the contract or in the handover, or that prevent the buyer from the right of ownership
Note / Clarification: Conditions that serve the interest of the contract or accord with its requirements do not fall under this prohibition, so they are permissible.
وقوله: "ولا ربحُ ما لم يُضمن" فهو أن يبيعه سلعةً قد اشتراها ولم يكن قبضها فهي من ضمان البائع الأول، ليس من ضمانه، فهذا لا يجوز بيعه حتى يقبضه، فيكون من ضمانه.
General principle: His (peace and blessings be upon him) saying "wa la ribhu ma lam yudman" (nor profit on that for which liability/daman has not been taken on) means that a person sells something he has bought but has not yet taken possession of, so it is still under the liability (daman) of the first seller and has not come under his own liability; therefore selling such a thing before taking possession is not permissible, until it comes under his liability.
وقوله: "ولا بيع ما ليس عندك" يعني بيع العين دون بيع الصفة، وهو بيع ما ليس عند البائع في الحال، ويدخل في ذلك بيع كل ما ليس بمضمون على البائع أن يحصله، وكذا بيع الرجل مال غيره موقوفًا على إجازة المالك، وعلة النهي عن ذلك كله الغررُ واحتمال الوجود أو العدم، أفاد ¤ ¤ ذلك كلَّه الخطابي في "معالم السنن" 3/ 140 - 143، وابن الأثير في "النهاية" في المواد (سلف وشرط وضمن).
General principle: His (peace and blessings be upon him) saying "wa la bay'u ma laysa 'indak" (do not sell what is not with you) refers to the sale of a specific item ('ayn), not a sale on the basis of description (bay' al-sifah); that is, selling something that is not present with the seller at the time. Included in this is everything that the seller is not responsible for procuring, such as selling another person's property contingent on the owner's permission
Technical note / Defect ('illah): The reason for all these prohibitions is deceptive uncertainty (gharar) and the possibility of existence or non-existence
