Mustadrak al-Hakim — Hadith 2213

أخبرنا أبو بكر أحمد بن إسحاق، حدثنا موسى بن إسحاق القاضي، حدثنا عبد الله بن أبي شَيْبة، حدثنا زيد بن الحُباب، عن الحسين بن واقد، حدثني عبد الله بن بُريدة، عن أبيه: أنَّ سلمان لما قَدِم المدينة أتى رسولَ الله ﷺ بهديةٍ على طَبَقٍ، فوضعها بين يديه، فقال: "ما هذا يا سلمانُ؟ " قال: صدقةٌ عليك وعلى أصحابك، قال: "إني لا آكُلُ الصدقةَ" فرفعها، ثم جاءه من الغدِ بمثلها، فوضعها بين يديه، فقال: "ما هذا؟ " قال: هديةٌ لك، فقال رسول الله ﷺ لأصحابه: "كُلُوا" قال: "لمن أنت؟ " قال: لقومٍ، قال: "فاطلُب إليهم أن يُكاتِبُوك"، قال: فكاتَبُوني على كذا وكذا نخلةً أغرِسُها لهم، ويقومُ عليها سلمانُ حتى تُطعِمَ، قال: ففَعَلُوا، قال: فجاء النبيُّ ﷺ فغَرَسَ النخلَ كلَّه إلّا نخلةً واحدةً غرسَها عمرُ، وأطعَمَ نخلُه مِن سَنَتِه إِلَّا تلك النخلةَ، قال رسول الله ﷺ: "مَن غَرَسَها؟ " قالوا: عمرُ، فَغَرَسَها رسولُ الله ﷺ من يده، فحَمَلَت من عامِها (1).
هذا حديث صحيح على شرط مسلم، أخرجه الشيخُ أبو بكر في باب الرخصة في اشتراط البائع خدمةَ العبد المَبيع وقتًا معلومًا. وله شاهد من حديث ابن عباس عن سلمانَ صحيحٌ على شرط مسلم:

It is narrated from Sayyiduna Buraydah (may Allah be pleased with him) that when Sayyiduna Salman al-Farisi (may Allah be pleased with him) came to Madinah, he came to the Messenger of Allah (peace and blessings be upon him) with a gift on a platter and placed it before him. He (peace and blessings be upon him) asked: "O Salman, what is this?" He said: "It is charity for you and your Companions." He (peace and blessings be upon him) said: "I do not eat charity." So it was taken away. Then the next day he brought the same (platter) and placed it before him. He (peace and blessings be upon him) asked: "What is this?" He said: "It is a gift for you." Then the Messenger of Allah (peace and blessings be upon him) said to his Companions: "Eat as well." Then he (peace and blessings be upon him) asked: "To whom do you belong (as a slave)?" He said: "To such-and-such people." He (peace and blessings be upon him) said: "Ask them to make a contract of kitabah (an agreement for freedom) with you." Salman (may Allah be pleased with him) said: So they made a contract of kitabah with me in return for planting such-and-such a number of date palms, which Salman would tend until they bore fruit. The narrator said: So they did so. Then the Prophet (peace and blessings be upon him) came and planted all the date palms with his own hand except one tree; that one tree was planted by Sayyiduna Umar (may Allah be pleased with him). The trees he (peace and blessings be upon him) had planted bore fruit that same year, except that one tree. The Messenger of Allah (peace and blessings be upon him) asked: "Who planted this one?" The people said: "Umar (may Allah be pleased with him)." So the Messenger of Allah (peace and blessings be upon him) planted it (again) with his blessed hand, and it too bore fruit that same year.
This hadith is sahih (authentic) on the condition of Muslim, and Imam Abu Bakr (al-Bayhaqi) has recorded it in the chapter on the permissibility of the seller stipulating the service of the sold (slave) for a fixed period of time.

Grading: The chain is
strong (qawi) on account of al-Husayn bin Waqid, who is a saduq (truthful) narrator.
وأخرجه أحمد 38/ (22997) عن زيد بن الحباب، بهذا الإسناد. وانظر ما بعده.
Reference / Source: Imam Ahmad narrated it through the chain of Zayd bin al-Hubab.
قوله: "يُكاتبوك" من المكاتبة: وهو أن يُكاتِب الرجلُ عبدَه على مالٍ يؤدّيه إليه العبدُ منجّمًا (أي: مقسَّطًا) فإذا أدّاه صار حُرًّا، وسميت كذلك لأنه يكتب على نفسه لمولاه ثمنه، ويكتب مولاه له عليه العتق.
Linguistic explanation:
"Mukatabah" is when a slave makes an agreement with his master for his freedom in return for a fixed sum, which he pays in instalments.
وقوله: "أطعَمَ نخلُه" أي: أثمر، أي: صار ذا طَعْم وشيئًا يؤكل منه.
Linguistic explanation:
"At'ama nakhluhu" means that the palm tree became able to bear fruit and its fruit became fit to eat.
وقد اختلفت الروايات فيما أدَّاهُ سلمان الفارسي مقابل مكاتبته، ففي رواية بُريدة هنا أنه أدَّى كذا وكذا نخلة. هكذا دون تقييد، وزاد أحمد في روايته: فاشتراه رسول الله ﷺ بكذا وكذا درهمًا، وعلى أن يغرس نخلًا.
Variation in the chain: The narrations differ over the price of the mukatabah of Salman al-Farisi (may Allah be pleased with him). In the narration of Buraydah the number is left vague, while the narration of Ahmad mentions dirhams and the planting of palm saplings.
وفي رواية ابن عباس، عن سلمان، وستأتي بعده: أنه كاتب على ثلاث مئة نخلة وبأربعين أوقية. وقد ساق ابن إسحاق في "السيرة" روايةَ ابن عباسٍ بطولها.
Reference / Source: The narration of Ibn Abbas (may Allah be pleased with him) mentions 300 palm trees and 40 uqiyah of silver, and Ibn Ishaq recorded it in detail.
وفي رواية أبي عثمان النهدي عن سلمان الآتية برقم (2898): أنه كاتب على خمس مئة فَسيلة (أي: فسيلة النخل).
Reference / Source: The narration of Abu Uthman (2898) mentions 500 palm saplings (fasilah).
وفي رواية أبي الطُّفيل عن سلمان الآتية برقم (6689): أنه كاتب على مئة نخلة، وعلى قطعة من ذهب بوزن نواة. ويوافقه مرسل سعيد بن المسيب عند عبد الرزاق (15765) وغيره، بذكر عدد النخل، لكن دون ذكر قطعة الذهب. ورجاله ثقات.
Reference / Source: The narration of Abu al-Tufayl (6689) mentions 100 palm trees and a piece of gold the weight of a date-stone, and this is supported by the mursal narration of Sa'id bin al-Musayyib.
وفي رواية زيد بن صوحان عن سلمان الآتية برقم (6688): أنَّ أبا بكر اشتراه فأعتقه.
Reference / Source: The narration of Zayd bin Suhan (6688) states that Abu Bakr (may Allah be pleased with him) bought him and set him free.
واختلفت هذه الروايات أيضًا فيما نبت من النخل المذكور، ففي رواية بُريدة هنا أنها نبتت كلها إلّا واحدة، كان عمر بن الخطاب غرسها بيده. وكذلك في رواية أبي عثمان، غير أنه ذكر أنَّ التي لم تنبت كان سلمان نفسه هو من غرسها.
Variation in the events: There is also a difference about the growing of the saplings; according to one narration a single sapling planted by Umar (may Allah be pleased with him) did not grow, while in another that sapling was planted by Salman (may Allah be pleased with him) himself.
وفي رواية ابن عباس أنه ما مات منها نخلة واحدة.
Reference / Source: According to Ibn Abbas (may Allah be pleased with him), not a single one of the saplings was lost.
وقد أشار البيهقيُّ في "سننه الكبرى" 10/ 322 إلى بعض هذه الاختلافات، ثم قال: وفي ثبوت بعض هذه الروايات نظر.
Research note: Imam al-Bayhaqi pointed to these differences and questioned whether some of the narrations are established.
وقال ابن كثير في "البداية والنهاية" 3/ 520: وطريق محمد بن إسحاق أقوى إسنادًا، وأحسن اقتصاصًا.
Grading: Allamah Ibn Kathir says that the chain related by Muhammad bin Ishaq is the strongest, and the best in its telling of the story.
