الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا ، وَيَأْخُذُ كُلُّ وَاحِدٍ مِنْهُمَا مِنَ الْبَيْعِ مَا يَهْوَى

أخبرنا الشيخ أبو الوليد، أخبرنا أحمد بن الحسن بن عبد الجبار، حدثنا أبو خَيْثمة زُهير بن حَرْب، حدثنا معاذ بن هشام، حدثني أبي، عن قَتَادة، عن الحسن، عن سَمُرة بن جُندُب، أنَّ رسول الله ﷺ قال: "البَيِّعانِ بالخِيار ما لم يَتَفَرّقا ويأخُذُ كلُّ واحدٍ منهما من البيع ما يَهْوَى" قالها ثلاثًا (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه بهذه الزيادة (2). حدثنا الحاكم أبو عبد الله محمد بن عبد الله الحافظ إملاءً في جمادى الآخرة سنة سبع وتسعين وثلاث مئة:

It is narrated from Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The two parties to a sale have the option (to cancel the deal) as long as they have not separated from one another, and each of them may take from the sale what he likes." He (peace and blessings be upon him) said this three times.
This hadith is sahih (authentic) on the condition of Imam Bukhari and Imam Muslim, but the two Shaykhs did not record it with this addition.

(1) إسناده صحيح، وقد ثبت سماع الحسن - وهو البصري - من سمرة كما بيناه برقم (151).
Grading: The chain is
sahih, and al-Hasan al-Basri's hearing from Samurah (may Allah be pleased with him) is established, as was made clear at number (151).
قتادة: هو ابن دِعامة السَّدُوسي، وهشام: هو ابن أبي عبد الله الدَّستُوائي.
Identification of narrators: Qatadah al-Sadusi and Hisham al-Dastuwa'i are important narrators in it.
وأخرجه النسائي (6029) عن عمرو بن علي الفلّاس، عن معاذ بن هشام، بهذا الإسناد.
Reference / Source: Imam al-Nasa'i narrated it via the chain of Mu'adh bin Hisham.
وأخرجه أحمد 33/ (20182) عن عبد الرحمن بن مهدي، عن هشام: به. دون قوله: "ويأخذ كل واحد" إلى آخره.

وأخرجه أحمد (20142) و (20253) من طريق سعيد بن أبي عَروبة، وأحمد أيضًا (20189) و (20252)، والنسائي (6030) من طريق همام بن يحيى، وأحمد (20241)، وابن ماجه (2183) من طريق شعبة بن الحجاج، ثلاثتهم عن قتادة، به. ولم يذكر سعيد وشعبة في روايتهما قوله في الحديث: "ويأخذ كل واحدٍ" إلى آخره، ولفظ همام: "ويأخذ كل واحدٍ منهما ما رضي من البيع".
