حدَّثَناه أبو عبد الله محمد بن يعقوب، حدثنا يحيى بن محمد، حدثنا مُسدَّد، حدثنا مسلم بن خالد، عن هشام بن عُرْوة، عن أبيه، عن عائشة: أنَّ رجلًا اشترى غلامًا في زمن النبي ﷺ وبه عَيبٌ لم يَعلَمْ به، فاستغلَّه، ثم عَلِمَ العيبَ فردَّه، فخاصمَه إلى النبي ﷺ، فقال: يا رسول الله، إنه استغلَّه منذ زمان، فقال رسول الله ﷺ: "الغَلَّةُ بالضَّمَان" (1). هذا حديث صحيح الإسناد، ولم يُخرجاه. وقد رواه ابنُ أبي ذئب، عن مَخلَد بن خُفَافٍ، عن عُرْوة، عن عائشة مختصرًا (2). It is narrated from Sayyidah Aishah (may Allah be pleased with her) that in the time of the Prophet (peace and blessings be upon him) a man bought a slave who had a defect of which he was unaware. He made use of the slave (or earned income from him); then when he learned of the defect, he returned him. Then the two parties took their dispute to the Prophet (peace and blessings be upon him), and the seller said: O Messenger of Allah, he has benefited from him for a long time. The Messenger of Allah (peace and blessings be upon him) said: "The income is in return for the liability (responsibility for loss)."
The chain of this hadith is sahih (authentic), but the two Shaykhs did not record it. Ibn Abi Dhi'b has also narrated it in abridged form through Makhlad bin Khufaf from Sayyidah Aishah.
