ما حدثنا أبو العباس محمد بن يعقوب، حدثنا أحمد بن عيسى التِّنِّيسي، حدثنا عمرو بن أبي سَلَمة، حدثنا صَدَقة بن عبد الله الدمشقي، عن ثَوْر بن يزيد، عن أبي حُمَيد الرُّعَينيِّ قال: كنّا جُلوسًا إلى عُتبةَ بن عبدٍ السُّلَمي، فأقبل يزيدُ ذو مِصْرٍ المُقْرائي فقال لعُتبة: يا أبا الوليد، إنّا خرجنا آنفًا في التِمَاسِ جَدْيِ نُسُكٍ، فلم نَكَدْ نجدُ شيئًا يُنْقِى غيرَ أنِّي وجدتُ ثَرْماءَ سمينةً، فقال عتبة: فلوما جئتَنا بها، فقال: اللهم غُفْرًا، أتجوزُ عنكَ ولا تجوز عنِّي؟ قال: نعم، قال: إنَّك تشُكُّ ولا أَشكُّ، قال: ثم أخرج عتبةُ يدَه فقال: إنَّما نَهَى رسولُ الله ﷺ عن خمسٍ: عن المُؤصَلَة والمُصْفَرَة والبَخْقاء والكَسْراء والمُشَيِّعة. قال: والمُؤصَلَةُ: المستأصَلَة قَرْنُها، والمُصْفَرَة: المستأصَلَة أُذُنها (1)، والبَخْقاء: البيِّنُ عَوَرُها (2)، والمُشيِّعة (3): المهزولة أو المريضة التي لا تَتْبعُ الغنمَ (4).
It is narrated from Abu Humayd al-Ru'ayni (may Allah have mercy on him) that: We were sitting with Sayyiduna Utbah bin Abd al-Sulami (may Allah be pleased with him) when Yazid Dhu Misr al-Muqra'i came and said to Utbah: O Abu al-Walid, we just went out looking for a young goat for sacrifice, but we could hardly find anything with marrow in its bones, except that I found a fat goat with broken front teeth. Utbah said: Why did you not bring it to us? He said: Allah forgive me! Is it valid on your behalf and not valid on mine? He said: Yes; you are in doubt and I am not in doubt. Then Utbah put out his hand and said: The Messenger of Allah (peace and blessings be upon him) forbade only five: "Al-mu'salah, al-musfarah, al-bakhqa', al-kasra' and al-mushayyi'ah." He explained that mu'salah means an animal whose horn has been uprooted, musfarah one whose ear has been cut off from the root, bakhqa' one whose loss of an eye is evident, kasra' one whose bone is broken, and mushayyi'ah an extremely weak or sick animal that cannot keep up with the flock.

(1) قال الخطابي: وأُراها سميت مُصْفَرة لأنَّ صِمَاخَيها قد صَفِرا من الأذنين، أي: خَلَوا، يقال: صَفِر الوعاءُ: إذا خلا. Note / Clarification: 'Allamah al-Khattabi says: I think it was called "musfarah" because its ear holes have become empty of the ears (since they were cut off). When a vessel becomes empty, one says: "safira al-wi'a'".
(2) أي: قد بُخِقَت عينها. Note / Clarification: It means an animal whose eye has been gouged out.
(3) المشيّعة بكسر الياء المشددة، قال الخطابي في "غريب الحديث": أي التي لا تزال تتبع الغنم عَجَفًا، يريد أنها لا تلحق الغنم، فهي أبدًا تشيِّعها، أي تكون من وراء القطيع. انتهى، وقال ابن الأثير في "النهاية": وإن فتحتها - يعني الياء - فلأنها تحتاج إلى من يُشيِّعُها: أي يسوقها لتأخرها عن الغنم. Note / Clarification: "Al-mushayyi'ah" (with kasrah on the ya') refers to a weak animal that always walks behind the flock and cannot keep up with it. According to Ibn al-Athir, if the ya' has a fathah it means one that needs someone to drive it on, because it lags behind out of sluggishness.
(4) إسناده ضعيف، صدقة بن عبد الله ضعيف، وأبو حميد الرعيني ويزيد ذو مصر مجهولان. Grading: Its chain is "da'if" (weak). Sadaqah bin 'Abdullah is a weak narrator, while Abu Humayd al-Ru'ayni and Yazid Dhu Misr are "majhul" (of unknown status). وسيأتي عند المصنف برقم (7727) من طريق عيسى بن يونس عن ثور بن يزيد. Repetition: This narration will come later with the author (al-Hakim) at number (7727) through the route of 'Isa bin Yunus from Thawr bin Yazid. ويأتي تخريجه هناك. Direction: See its takhrij there.
