حدثنا علي بن حَمْشاذ العدل، حدثنا محمد بن صالح الهمذاني، حدثنا عبد الصمد بن حسان، حدثنا سفيان الثوري، عن عطاء بن السائب، عن طاووس، عن ابن عباسٍ قال: قال رسولُ الله ﷺ: "الطَّوافُ بالبيت صلاةٌ إِلَّا أَنَّ الله قد أحلَّ لكم فيه الكلام، فمَن تكلَّمَ فلا يتكلَّمْ إلَّا بخير" (1).
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Tawaf of the House of Allah is just like prayer, except that Allah Almighty has made speaking lawful for you in it; so whoever speaks, let him speak only what is good."

Grading: This hadith is sahih, and this chain is hasan on account of Muhammad bin Salih (Hamdan al-Hamadhani) and his shaykh Abd al-Samad bin Hassan, since both are saduq and they are corroborated. Technical note / Defect ('illah): Although 'Ata' bin al-Sa'ib suffered from mental confusion (ikhtilat), Sufyan al-Thawri heard from him before the confusion. Important point: Al-Nasa'i, al-Bayhaqi, Ibn al-Salah, Ibn Hajar and others preferred the mawquf narration, while the vagueness over the Companion's name does no harm. Reference / Source: We have given the details of this in our notes on "Sharh Mushkil al-Athar" (5973). وأخرجه مرفوعًا الترمذي (960) عن قتيبة بن سعيد، عن جرير بن عبد الحميد، عن عطاء بن السائب بهذا الإسناد. وجرير بن عبد الحميد وإن كان سماعه من عطاء بعد الاختلاط، فقد تابعه سفيان الثوري في رواية الحاكم هذه، وسفيان بن عيينة في الحديث التالي بعد هذا، وسماعهما منه قبل الاختلاط. قال الترمذي: وقد روي هذا الحديث عن ابن طاووس وغيره عن طاووس عن ابن عباس موقوفًا، ولا نعرفه مرفوعًا إلّا من حديث عطاء. قلنا: بل قد رواه سعيد بن جبير عن ابن عباس مرفوعًا، فيما سيأتي برقم (3093) وإسناده صحيح. Reference / Source: Imam al-Tirmidhi (960) narrated it as marfu' by way of Jarir bin Abd al-Hamid from 'Ata'. Corroborating chains and supporting reports: Although Jarir heard from him after the confusion, he is corroborated by Sufyan al-Thawri and Sufyan bin 'Uyaynah, who heard from him before the confusion. Important point: Imam al-Tirmidhi says that it is known as marfu' only through the hadith of 'Ata', but we say that it is also narrated as marfu' from Sa'id bin Jubayr with a sahih chain (no. 3093). وأخرجه عبد الرزاق (9791) عن جعفر بن سليمان الضبعي، عن عطاء بن السائب، عن طاووس أو عكرمة أو كليهما، عن ابن عباس قوله. هكذا موقوفًا، وجعفر بن سليمان بصري، ورواية البصريين عن عطاء بعد الاختلاط. Reference / Source: Abd al-Razzaq (9791) narrated it by way of Ja'far bin Sulayman from Ibn 'Abbas (may Allah be pleased with him) as mawquf. Criticism of a narrator: Ja'far bin Sulayman is a Basran, and the Basrans' narration from 'Ata' dates from after his confusion. وأخرج النسائي في "الكبرى" (3931) من طريق إبراهيم بن ميسرة، عن طاووس، عن ابن¤ ¤ عباس قال: الطواف بالبيت صلاة، فأقلوا الكلام. Reference / Source: Imam al-Nasa'i narrated it in "al-Kubra" (3931) by way of Ibrahim bin Maysarah from Tawus from Ibn 'Abbas (may Allah be pleased with him) as mawquf: "Circumambulating the House is prayer, so speak little." وخالف ابنَ ميسرة الحسنُ بنُ مسلم فرفعه وأبهم الصحابي، أخرجه أحمد 24/ (15423) و 27 / (16612) و 38/ (23201)، والنسائي في "الكبرى" (3930) من طريق ابن جريج قال: أخبرني الحسن بن مسلم، عن طاووس، عن رجل أدرك النبي ﷺ، أن النبي ﷺ قال: "إنما الطواف صلاة، فإذا طفتم فأقلوا الكلام". قال أحمد بإثره: ولم يرفعه محمد بن بكر. وقال الحافظ ابن حجر في "التلخيص" 1/ 130 - 131: والظاهر أنَّ المبهم فيه هو ابن عباس، وعلى تقدير أن يكون غيره فلا يضر إبهام الصحابة. Variation in the chain: Al-Hasan bin Muslim went against Ibrahim bin Maysarah, narrating it as marfu' and leaving the Companion's name unspecified. Reference / Source: Ahmad and al-Nasa'i narrated it by way of Ibn Jurayj from al-Hasan bin Muslim from Tawus. Important point: Al-Hafiz Ibn Hajar says that the apparent view is that the unnamed Companion here is Ibn 'Abbas (may Allah be pleased with him) himself, and even if it is someone else, the Companion being unnamed does no harm. قلنا: قد جعله حنظلة بن أبي سفيان من حديث ابن عمر موقوفًا عليه، أخرجه من طريقه النسائي في "المجتبى" (2923) عن طاووس، عن ابن عمر قال: أقلوا الكلام في الطواف، فإنما أنتم في الصلاة. قال الدارقطني في "العلل" (3044): وقول من قال: ابن عمر، أشبه. Details of the narration: Hanzalah bin Abi Sufyan narrated it through Tawus from Ibn 'Umar (may Allah be pleased with him) as mawquf, which al-Nasa'i recorded at (2923). Important point: Imam al-Daraqutni says that the view of those who said "Ibn 'Umar (may Allah be pleased with him)" is the more likely (correct) one. وللشيخ الألباني ﵀ بحث نفيس في تخريج هذا الحديث والكلام عليه في "إرواء الغليل" (121) فلينظر.
