Mustadrak al-Hakim — Hadith 1677

أخبرنا أبو عبد الله محمد بن يعقوب الحافظ، حدثنا الحسين بن الحسن المُهاجري، حدثنا هارون بن سعيد الأَيْلي، حدثنا ابن وَهْب، أخبرني يعقوب بن عبد الرحمن الزُّهري ويحيى بن عبد الله بن سالم، أن عَمْرًا مولى المُطَّلب أخبرهما عن المُطَّلب بن عبد الله بن حَنْطب، عن جابر بن عبد الله، عن رسول الله ﷺ أنه قال: "لَحمُ صَيدِ البَرِّ لكم حلالٌ، وأنتم حُرُم ما لم تَصِيدُوه أو يُصاد (1) لكم" (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The meat of land game is lawful for you (even in the state of ihram), as long as you do not hunt it yourselves and it has not been hunted for you."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) كذا الرواية هنا "يصاد" وكذلك هي في بعض المصادر، وفي مواضع أخرى من "المستدرك" وكذا في مصادر أخرى: "يصد" على الأصل في العطف على المجزوم، أما رواية "يصاد" فهي جائزة على لغةٍ، بل قال السندي في حاشية النسائي: الوجه نصب "يصاد" على أنَّ "أو" بمعنى: إلّا أن، وحينئذٍ فلا إشكال.
Important point: In our manuscripts the reading here is "yusadu" (is hunted), and in some sources it appears as "yusad" (the jussive form of the same verb, "is hunted"). Linguistically both are permissible; indeed, according to al-Sindi, "yusada" here is in the accusative, meaning "unless it is hunted (for him)".

(2) صحيح لغيره، وهذا إسناد حسن إن صحَّ سماع المطلب بن عبد الله بن حنطب من جابر ابن عبد الله، فقد قال أبو حاتم كما في "الجرح والتعديل" لابنه 8/ 359: يشبه أن يكون أدركه، وفي "المراسيل" لابنه أيضًا (785) قال: لم يسمع من جابر. قلنا: وعمرو مولى المطلب - وهو ابن أبي عمرو - صدوق لا بأس به، وقد اختلف عليه في هذا الحديث، فرواه بعضهم عنه عن المطلب عن جابر، كما هنا، ورواه بعضهم عنه عن رجل من الأنصار عن جابر، كما سيأتي برقم (1768)، وقال آخرون: عنه عن رجل ثقة من بني سلمة، وقال بعضهم: عنه عن المطلب عن أبي مو موسى، وقد فصلنا تخريج ذلك في "مسند أحمد" 23/ (14894).
Grading: This hadith is "sahih li-ghayrih" (sound due to other chains), and if al-Muttalib bin Abd Allah's hearing from Jabir (may Allah be pleased with him) is established, the chain is hasan.
Technical note / Defect ('illah): According to Abu Hatim, al-Muttalib probably met Jabir (may Allah be pleased with him), but his hearing from him is not established. There is variation in the chain of this hadith, the details of which we have set out in "Musnad Ahmad" 23/ (14894).
أخرجه أحمد (14894)، وأبو داود (1851)، والترمذي (846)، والنسائي (3796)، وابن حبان (3971) من طريقين عن يعقوب بن عبد الرحمن وحده، بهذا الإسناد. قال الترمذي: حديث جابر مفسَّر، والمطلب لا نعرف له سماعًا من جابر. ثم قال: قال الشافعي: هذا أحسن حديث روي في هذا الباب وأقيَس.
Reference / Source: Ahmad (14894), Abu Dawud (1851), al-Tirmidhi (846), al-Nasa'i and Ibn Hibban narrated it by way of Ya'qub bin Abd al-Rahman. Imam al-Tirmidhi said that al-Muttalib is not known to have heard from Jabir (may Allah be pleased with him), while Imam al-Shafi'i described it as the best hadith on this subject and the most consistent with analogy.
وسيأتي الحديث في "المستدرك" من طريق ابن وهب برقم (1766)، ومن طريق مالك بن أنس عن عمرو مولى المطلب برقم (1767)، ومن طريق سليمان بن بلال عن عمرو مولى المطلب برقم (1768)، ومن طريق عبد العزيز الدراوردي عن عمرو مولى المطلب عن رجل من الأنصار ¤ ¤ عن جابر برقم (1769).
Details of the narration: This hadith will come later in "al-Mustadrak" by way of Ibn Wahb (no. 1766), Imam Malik (1767), Sulayman bin Bilal (1768) and al-Darawardi (1769).
وفي الباب عن أبي قتادة عند أحمد 37/ (22526)، وإسناده صحيح.
Corroborating chains and supporting reports: On this subject there is the narration of Abu Qatadah (may Allah be pleased with him) in Musnad Ahmad 37/ (22526), and its chain is sahih.
وعن رجل من بهز عند أحمد 25/ (15744).
Corroborating chains and supporting reports: The narration from a man of the Bahz tribe is in Musnad Ahmad 25/ (15744).
وعن طلحة بن عبد الله عند أحمد أيضًا 3 / (1383)، وفي تلك المواضع من "المسند" تمام تخريج هذه الشواهد.
Corroborating chains and supporting reports: The narration of Talhah bin Abd Allah (may Allah be pleased with him) is found in Musnad Ahmad 3/ (1383).
