Mustadrak al-Hakim — Hadith 1640

حدثنا أبو محمد المُزَني، حدثنا جعفر بن أحمد بن سَنَان، حدثنا عمّار بن خالد، حدثنا القاسم بن مالك المُزَني، عن الأعمش، عن زيد بن وهبٍ قال: قال عمر بن الخطّاب: إذا كان نَفَرٌ ثلاثةٌ فليؤمِّروا أحدَهم، ذاك أميرٌ أمَّره رسولُ الله ﷺ (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.
Zayd bin Wahb narrates that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) said: "When there is a group of three (on a journey), they should appoint one of them as their leader; he will be a leader appointed in accordance with the command of the Messenger of Allah (peace and blessings be upon him)."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), and they did not record it.

(1) إسناده قوي من أجل القاسم بن مالك المزني، فهو لا بأس به، لكنه انفرد هنا بزيادة "ذاك أميرٌ أمَّره رسول الله ﷺ"، فقد رواه الثقات من أصحاب الأعمش من قول عمر دون هذه الزيادة، وبذلك أعله الدارقطني والبزار وأبو نعيم الأصبهاني والذهبي في "ميزانه" 3/ 378، قال الدارقطني في "العلل" (176): رواه عبد الواحد بن زياد وأبو معاوية وغيرهما عن الأعمش عن زيد بن وهب عن عمر قوله، وهو الصواب. انتهى، لكن تعقبهم ابن القطان في "بيان الوهم والإيهام" 5/ 291 بقوله: القاسم بن مالك ثقة لا شك فيه، والراوي عنه وهو عمار بن خالد ثقة، فهذا الطريق صحيح، فإنَّ وقْفَ من وقفه لا يضره، لاحتمال أن يكون الأعمش قد رواه على الوجهين، والله أعلم.
Grading: The isnad is strong (qawi) on account of al-Qasim bin Malik al-Muzani,
Technical note / Defect ('illah): but al-Qasim is alone in adding the words "He is a commander whom the Messenger of Allah (peace and blessings be upon him) appointed". According to al-Daraqutni, the correct version is that it is the saying of 'Umar (may Allah be pleased with him) himself (mawquf), without this addition. However, Ibn al-Qattan, affirming that al-Qasim is thiqah, considered this route sahih.
وأخرجه البزار (329)، وابن خزيمة (2541)، والطحاوي في "مشكل الآثار" (4619)، وأبو نعيم في "الحلية" 4/ 172، وفي "أخبار أصبهان" 1/ 280 من طريق عمار بن خالد، بهذا الإسناد.
Reference / Source: It was narrated by al-Bazzar (329), Ibn Khuzaymah (2541), al-Tahawi and Abu Nu'aym via 'Ammar bin Khalid with this same chain.
وأخرجه عبد الرزاق (6960) عن معمر بن راشد، والبيهقي 9/ 359 من طريق أبي معاوية محمد بن خازم الضرير، كلاهما عن الأعمش، عن زيد بن وهب، عن عمر بن الخطاب. ولم يذكرا فيه قوله: "ذاك أمير .... " إلى آخره.
Details of the narration: Abd al-Razzaq and al-Bayhaqi narrated it via Ma'mar bin Rashid and Abu Mu'awiyah without this addition ("He is a commander").
وأخرجه كذلك علي بن حجر السعدي في "جزء حديث إسماعيل بن جعفر" (464) عن حبيب بن حسان، عن زيد بن وهب، عن عمر. وحبيب بن حسان هذا - وهو حبيب بن أبي الأشرس - متروك.
Criticism of a narrator: Habib bin Hassan also narrated it from Zayd bin Wahb from 'Umar, but this Habib is a "matruk" (abandoned) narrator.
وفي الباب عن عبد الله بن عمرو بن العاص عند أحمد 11/ (6647)، وفيه: "ولا يحل لثلاثة نفر يكونون بأرض فلاة إلّا أمروا عليهم أحدهم"، وإسناده ضعيف.
Corroborating chains and supporting reports: On this topic there is the hadith of Abd Allah bin 'Amr bin al-'As (may Allah be pleased with him) in Musnad Ahmad (11/ 6647): "It is not lawful for three people who are in open desert land not to appoint one of themselves as commander." Its isnad is weak.
وعن أبي سعيد الخدري، وعن أبي هريرة مرفوعًا أيضًا، أخرجهما أبو داود (2608) و (2609) بإسنادين رجالهما ثقات، وقد بيَّنا هناك أنَّ الصواب إرسالهما.
Corroborating chains and supporting reports: It is also narrated as marfu' from Abu Sa'id al-Khudri and Abu Hurayrah (may Allah be pleased with them) (Abu Dawud 2608, 2609). Their narrators are thiqah, but the correct view is that they are mursal.
وعن عبد الله بن مسعود عند أبي القاسم البغوي في "الجعديات" (430)، وأبي العباس السّرَّاج في "مسنده" (1288)، والطحاوي في شرح "مشكل الآثار" 5/ 43، والطبراني في "الكبير"¤ ¤ (8915)، وإسناده صحيح.
Corroborating chains and supporting reports: The narration of Abd Allah bin Mas'ud (may Allah be pleased with him) is found with a sahih chain in al-Baghawi, al-Tabarani and others.
