أخبرنا عبد الرحمن بن حَمْدان الجَلَّاب بهَمَذان، حدثنا أبو حاتم وإبراهيم بن نصر الرّازيّان، قالا: حدثنا أبو الوليد الطيالسي، حدثنا الليث بن سعد، عن بُكَير بن عبد الله بن الأشَجّ، عن عبد الملك بن سعيد بن سُوَيد الأنصاري، عن جابر بن عبد الله، عن عمر بن الخطاب أنه قال: هَشِشْتُ يومًا فقبَّلتُ وأنا صائم، فأتيتُ رسولَ الله ﷺ فقلت: صَنعتُ اليوم أمرًا عظيمًا فقبلتُ وأنا صائم، فقال رسول الله ﷺ: "أرأيتَ لو تَمَضْمَضْتَ ماءً وأنت صائمٌ؟ " قال: فقلت: لا بأسَ بذلك، فقال رسول الله ﷺ: "ففيمَ؟ " (1). حديث صحيح على شرط الشيخين، ولم يُخرجاه.
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) said: "One day I was overcome by affection and kissed (my wife) while I was fasting. Then I came to the Messenger of Allah (peace and blessings be upon him) and said: Today I have committed a grave mistake: I kissed while fasting. The Messenger of Allah (peace and blessings be upon him) said: What do you think, if you were to rinse your mouth with water (during ablution) while fasting (would that break the fast)?" I said: "There is no harm in that." Then the Messenger of Allah (peace and blessings be upon him) said: "Then why the concern over this (kiss)?"
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

Grading: Although its narrators are thiqah, Imam Ahmad declared it da'if, saying: "This is baseless." Imam al-Nasa'i also called it "munkar". Ibn Hibban (3544) narrated it through the chain of Hisham bin 'Abd al-Malik al-Tayalisi. وأخرجه أحمد 1/ (138) و (372)، وأبو داود (2385)، والنسائي (3036) من طرق عن الليث بن سعد، به. Reference / Source: Ahmad (1/ 138), Abu Dawud (2385) and al-Nasa'i (3036) narrated it through various routes from al-Layth bin Sa'd. قال النسائي: هذا حديث منكر، وبكير مأمون، وعبد الملك بن سعيد رواه عنه غير واحد، ولا ندري ممن هذا؟! قلنا: ووجه استنكار الإمامين أحمد والنسائي لهذا الحديث مع أنَّ رجاله ثقات، ما قاله ابن عبد الهادي في "التنقيح" 3/ 236 من أنَّ الثابت عن عمر خلافه، قال: روى عبد الرزاق (7406) عن معمر، عن الزهري، عن ابن المسيب: أنَّ عمر بن الخطاب كان ينهى عن القبلة للصائم، فقيل له: إنَّ رسول الله ﷺ كان يقبل وهو صائم، فقال: من ذا له من الحفظ والعصمة ما لرسول الله ﷺ؟! Technical note / Defect ('illah): According to Ibn 'Abd al-Hadi, the reason Imams Ahmad and al-Nasa'i called this hadith munkar is that the established practice of 'Umar (may Allah be pleased with him) was contrary to it: he used to forbid the fasting person from kissing, and would say that we are not protected and preserved as the Messenger of Allah (peace and blessings be upon him) was. وخبر عمر هذا أخرجه أيضًا إسحاق بن راهويه (663) من طريق الزبيدي، عن الزهري، به. Reference / Source: This report of 'Umar (may Allah be pleased with him) was narrated by Ishaq bin Rahawayh (663) through the chain of al-Zubaydi from al-Zuhri. وأخرجه مختصرًا ابن أبي شيبة 3/ 61، والطحاوي في "شرح معاني الآثار" 2/ 88 من طريق ابن أبي ذئب، عن الزهري، به. Reference / Source: Ibn Abi Shaybah (3/ 61) and al-Tahawi narrated it in abridged form through the chain of Ibn Abi Dhi'b from al-Zuhri. لكن مال ابن عبد البر إلى إعمال النصَّين جميعًا، فقد قال في "التمهيد" 5/ 112 - 113: لا أرى معنى حديث ابن المسيب في هذا الباب عن عمر إلّا تنزُّهًا واحتياطًا منه، لأنه قد روي فيه عن عمر حديث مرفوع، ولا يجوز أن يكون عند عمر حديث ويخالفه إلى غيره. ثم روى ابن عبد البر حديث الليث بن سعد عن بكير بن عبد الله، فذكره بإسناده والله تعالى أعلم. General principle: Ibn 'Abd al-Barr reconciled the two narrations: 'Umar's (may Allah be pleased with him) prohibition was based on caution and piety, since a marfu' hadith is also narrated from him, and it is not conceivable that 'Umar (may Allah be pleased with him) would have a hadith and then act contrary to it. قوله: هششتُ، بكسر الشين الأولى وفتحها، من قوله: هَشَّ لهذا الأمر يَهَشُّ ويَهِشُّ هشاشةً، إذا فرح به واستبشر، وارتاح له وخَفَّ. "النهاية" لابن الأثير. Important point: "Hashashtu" (I was delighted): Ibn al-Athir says in "al-Nihayah" that it means to be glad about something, to be cheerful, and to feel eager and ready for it.
