حدَّثَناه علي بن حَمْشاذَ العدلُ، حدثنا العباس بن الفضل ومحمد بن أيوب، قالا: حدثنا سَهْل بن بَكَّار، حدثنا حمَّاد بن سَلَمة، عن محمد بن إسحاق، عن محمد بن يحيى بن حَبَّان، عن عمِّه واسع بن حَبَّان، عن جابر بن عبد الله: أنَّ رسول الله ﷺ رَخَّص في العَرايا الوَسْقَ والوَسْقين والثلاثةَ والأربعة، وقال: "في جادِّ كلِّ عشرة أوسُقٍ قِنوٌ يُوضَع للمساكينِ في المسجد" (1).
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) permitted 'araya, that is, exchanging dates on the tree for harvested dates, up to one, two, three or four wasq, and he said: "At harvest time, from every ten wasq one bunch should be placed in the mosque for the poor."

(1) إسناده حسن، وقد صرَّح محمد بن إسحاق بالسماع عند أحمد، فانتفت شبهة تدليسه، وقال ابن كثير في "تفسيره": هذا إسناد جيد. Grading: Its chain is hasan. Muhammad bin Ishaq stated explicitly that he heard it directly, in Imam Ahmad's narration, which removes the suspicion of his tadlis. Ibn Kathir said in his "Tafsir": "This is a good (jayyid) chain." وأخرجه أحمد 23/ (14866) و (14868)، وابن حبان (5008) من طريق إبراهيم بن سعد القرشي، وأحمد (14867)، وأبو داود (1662)، وابن حبان (3289) من طريق محمد بن سلمة الحراني، كلاهما عن محمد بن إسحاق، بهذا الإسناد. General principle: The Prophet's (peace and blessings be upon him) permission for "'araya" (selling fruit by estimation) is reported from Jabir bin 'Abd Allah (may Allah be pleased with him) through various routes, which Ahmad, al-Bukhari (2189 and others), Muslim (1543 and others), Abu Dawud, al-Tirmidhi and al-Nasa'i narrated. وفي الترخيص في العرايا عن ابن عمر أيضًا سيأتي برقم (8288). Note / Clarification: The narration of Ibn 'Umar (may Allah be pleased with him) about the permission for 'araya will come later at number (8288). قوله: رخص في العرايا، قال ابن الأثير في "النهاية" 3/ 224: قيل: إنه لما نهى عن المزابنة - وهو بيع الثمر في رؤوس النخل بالتمر - رخَّص في جملة المزابنة في العرايا، وهو أنَّ من لا نخل له من ذوي الحاجة يدرك الرطب، ولا نقد بيده يشتري الرطب لعياله، ولا نخل له يطعمهم منه، ويكون قد فَضَل له من قوته تمرٌ، فيجئ إلى صاحب النخل فيقول له: بعني ثمر نخلةٍ أو نخلتين بخَرْصها من التمر، فيعطيه ذلك الفاضلَ من التمر بثمر تلك النخلات ليصيب من رطبها مع الناس، فرخَّص فيه إذا كان دون خمسة أوسق. Important point: "Rakhkhasa fi al-'araya" (he gave permission for 'araya): Ibn al-Athir says in "al-Nihayah" (3/ 224) that when "muzabanah" (selling dates on the palm in exchange for picked dry dates) was forbidden, a permission was given in the form of "'araya". This refers to a needy person who has no palm tree of his own and wants fresh dates for his children, but has no cash, though he does have some dry dates beyond his needs. He goes to the owner of the orchard and buys the fruit of one or two trees by estimation (khars) in exchange for his dry dates, so that he too can eat fresh dates along with the people. The permission was given for quantities of less than five wasqs. وقوله: "جادّ عشرة" قال الخطابي: قال إبراهيم الحربي: يريد قدرًا من النخل يُجَدُّ منه عشرة أوسق، وتقديره تقدير مجدود فاعل بمعنى مفعول. Important point: His (peace and blessings be upon him) words "jadd 'asharah": al-Khattabi says that according to Ibrahim al-Harbi this means the quantity of palms from whose harvest (jadd) ten wasqs are obtained. Here "jadd" (active participle) is in the sense of "majdud" (passive participle). وأراد بالقنو: العِذق بما عليه من الرطب والبسر، يعلَّق للمساكين يأكلونه، وهذا من صدقة المعروف دون الصدقة التي هي فرض واجب. Important point: "Al-qinw" means the bunch of fresh and unripe dates that is hung up for the poor to eat. This is general voluntary charity, not the obligatory zakat.
