Mustadrak al-Hakim — Hadith 1497

أخبرَناه أبو بكر بن أبي نَصْر المروَزيّ، حدثنا أحمد بن عيسى، حدثنا القَعْنبي فيما قَرأَ على مالك، عن زيد بن أسلم، عن عطاء بن يسار: أنَّ رسولَ الله ﷺ قال: "لا تَحِلُّ الصَّدقةُ لغنيٍّ إلَّا لخمسةٍ"، فذكر الحديث (1). هذا من شَرْطي في خطبة الكتاب أنه صحيح، فقد يُرسِلُ مالك في الحديث ويَصِلُه أو [يُسنِده] (2) ثقةٌ، والقولُ فيه قولُ الثقة الذي يَصِلُه ويُسنِده.
It is narrated from Imam Malik that the Messenger of Allah (peace and blessings be upon him) said: "Zakah is not lawful for a wealthy person except for five people," and then the narrator mentioned the complete hadith. This is sahih in my view, as I mentioned in the preface of the book: if a trustworthy narrator reports it with a connected chain, it is his word that is relied upon.

(1) حديث صحيح، وقد رجحنا قبلُ أنَّ عطاء بن يسار ربما أسنده مرة وأرسله أخرى، ولا تعلُّ إحداهما الأخرى. وعلى فرض إرساله فإنه يتقوى ويعتضد بعمل الأئمة، والله أعلم.
Grading: The hadith is sahih, and even if it is taken to be mursal, it is strengthened by the practice of the imams.
أحمد بن عيسى: هو أحمد بن محمد بن عيسى البرتي، نسب إلى جده، والقعنبي: هو عبد الله بن مسلمة.
Criticism of a narrator: Ahmad bin Isa is Ahmad bin Muhammad bin Isa al-Birti (attributed to his grandfather), and al-Qa'nabi is Abdullah bin Maslamah.
وأخرجه أبو داود (1635) عن عبد الله بن مسلمة القعنبي، بهذا الإسناد.
Reference / Source: Abu Dawud (1635) narrated it through al-Qa'nabi.
